Committee Chair Ben Elenbaas called the meeting to order at 2:40 p.m. in a
hybrid meeting.
Present: 3 - Tyler Byrd, Ben Elenbaas, and Kaylee Galloway
Also Present: Barry Buchanan, Todd Donovan, Carol Frazey, and Kathy Kershner

Committee Discussion
1. AB2023-398 Discussion of an ordinance adopting various amendments to WCC Title 20, Zoning,
regarding home -based businesses
Cliff Strong, Planning and Development Services Department, briefed the
Councilmembers on the proposed code changes and answered whether the
parcel size of a type IV home -based business would still have the
requirement that it "not be less than 10 acres" even if it is adjoined to other
parcels that exceed ten acres, and suggested language that would fix that. He
answered questions about the time constraints on noise and whether they
are too restrictive, the reason for the limit of 24 outdoor events per year,
and whether there is any way in the code that a parcel purchased specifically
to be an event venue would not fall under those limits.
Councilmembers and Strong discussed the peace and quiet hours noted in
Washington Administrative Code (WAC) 332.52.130 which are, "after
10:00 p.m. and before 7:00 a.m. every day of the week" and whether we
could just make sure our code is consistent with the State, whether the
Whatcom County Code has a noise ordinance, what the timeline for this
Ordinance is, amending the parcel size restrictions, and whether this could
be held and brought back later in July.
Galloway moved to recommend that they hold off on introducing this
Ordinance until the July 25th meeting and bring it back to committee at that
meeting as well so that action would be available for August 8th.
Councilmembers and Dana Brown -Davis, Clerk of the Council, discussed
the dates of upcoming regular meetings.
Galloway amended her motion and moved to recommend to the full
Council that they bring the discussion of the Ordinance back to Committee

on July 25, and hold off on introducing the Ordinance until August 8 for
action on September 12th.
Elenbaas asked whether the one -hour limit for amplified music is a State
law.
The motion carried by the following vote:
Aye: 3 - Byrd, Elenbaas, and Galloway
Nay: 0

Councilmembers and Dana Brown -Davis, Clerk of the Council, discussed
whether the Ordinance for short term rentals should follow the same
timeline as the Ordinance discussed above.
