7 ORDINANCE ESTABLISHING THE CENTRAL SHOP NPDES STORMWATER
8 IMPROVEMENTS PROJECT BASED BUDGET

10 WHEREAS, Chapter 40, CFR 122.26[b][14] requires the Whatcom County Central
11 Shop to have and comply with an Industrial Stormwater General Permit (ISGP); and
12

14 WHEREAS, as part of the compliance with the Industrial Stormwater General Permit
15 #WAR 011715, the Department of Ecology (DOE) issued a Level 3 Corrective action
16 which mandated stormwater improvements; and
17

19 WHEREAS, DOE set a Fall 2024 deadline to achieve these mandated water quality
20 improvements; and

23 WHEREAS, the project will evaluate the facility site at 901 West Smith Road,
24 Bellingham, WA 98226, as well as the nearby surface water and groundwater
25 sources to design and construct appropriate best management practices (BMPs) to
26 treat stormwater to the standard set by DOE; and

30 WHEREAS, this request includes costs associated with contracted professional
31 engineering services, county survey and permit assistance, permit fees and county
32 staff time for project management; and

36 WHEREAS, this request doesn't include costs associated with the construction
37 oversight or project construction costs, which will require an additional request; and

41 WHEREAS, all local funding for this request will come from the Road Fund; and

45 WHEREAS, Section 6.80 of the Whatcom County Home Rule Charter allows for
46 project based capital budget appropriation ordinances that lapse when the project
47 has been completed or abandoned or when no expenditure or encumbrance has been
48 made for three (3) years,

52 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that a new
53 fund is hereby established, effective immediately, known as the Central Shop NPDES
54 Stormwater Improvements Project Fund. This fund shall be used to account for the
55 revenues and expenditures related to the project listed above; and

BE IT FURTHER ORDAINED by the Whatcom County Council that the Central Shop
NPDES Stormwater Improvements Project Fund is approved with an initial project
budget, as described in Exhibit A, of $255,500.
