Whatcom County Public Works has recommended that right of way within the intersection of W. Main
Street and Berthusen Road be transferred to the City of Lynden in support of the City of Lynden's
future road improvements at that intersection

RESOLUTION NO.2023 - 015
A RESOLUTION GRANTING A QUITCLAIM RIGHT OF WAY DEED
TO THE CITY OF LYNDEN
WHEREAS, Whatcom County is holder of the county road rights of way described in
Exhibit A (Right of Way); and,
WHEREAS, in the improvement of the intersection of Berthusen Road and West Main Street
by the City of Lynden, it is necessary and advisable for the City of Lynden to acquire the
County's rights for said Right of Way; and,
WHEREAS, after due consideration by the Whatcom County Council, it appears to the
Council that it will be in the best interests of both the County and the City of Lynden that the
County convey said rights to the City of Lynden by Quitclaim Deed for and in consideration
of the benefits derived by the traveling public; and,
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council, through the
County Executive, executes, notarizes and delivers said Quitclaim Deed to the City of
Lynden.

Legal Description of Right of Way to be quitclaimed
All of Berthusen Road Right -of -Way and West Main Street Right -of -Way extending
northerly 400 feet from the centerline of the intersection of Berthusen Road and West Main
Street, along with that certain triangular land area abutted by Berthusen Road and West Main
Street as depicted on Exhibit A. Also including any portion of West Main Street Right -of -
Way at said intersection that is outside of city limits of the City of Lynden. All located in the
Northeast Quarter of the Northeast Quarter of Section 23 and the Northwest Quarter of the
Northwest Quarter of Section 24, Township 40 North, Range 2 East, W.M.
