SUMMARY STATEMENT OR LEGAL NOTICE LANGUAG
This ordinance would adopt a revised system of assessment to provide revenue for the Drainage
Improvement District No. 7. The existing method of assessment is based solely on a relative ratio per
acre per lot and does not take into consideration the greater contribution of runoff from and the greater
benefit associated with conveying runoff away from a higher value asset within the District. The
proposed system of assessment will be based on a combination of a relative ratio per acre (including
minimum fee for lots smaller than one -acre) and a relative ratio of improvement value (per Assessor)
per lot within the District. The revised system is being proposed to improve the equity of property
assessments

ORDINANCE NO. 2023 - 027
FINALIZING A REVISED SYSTEM OF ASSESSMENT FOR
DRAINAGE IMPROVEMENT DISTRICT NO. 7
WHEREAS, the governing body of Drainage Improvement District No. 7, at
their meeting held on March 4, 2022 for said District, supported revising the existing
system of assessment for said District to improve the equity of assessments; and
WHEREAS, the existing system of assessment is based solely on a relative
ratio per acre per lot and does not take into consideration the greater contribution of
runoff from and the greater benefit associated with conveying runoff away from a
higher value asset within the District; and
WHEREAS, a revised preliminary system of assessment for Drainage
Improvement District No. 7 has been prepared by the County Engineer (see attached)
and public notice has been provided, as required by RCW 85.38.160 (2); and
WHEREAS, the revised system of assessment will be based on a combination
of a relative ratio per acre per lot (including minimum fee for lots smaller than one -
acre) and a relative ratio of improvement value (per Assessor) per lot within the
District; and
WHEREAS, said system of assessment will improve the equity of
assessments; and
WHEREAS, a public hearing on said system of assessment was scheduled for
and held on May 9, 2023;

NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
the system of assessment for Drainage Improvement District No. 7, prepared by the
County Engineer and/or changed by the County Council, is just and equitable.
Accordingly, the system of assessment, as attached, is hereby approved and finalized
and the assessments set forth are hereby levied for each parcel of land in said
District; provided that any parcel assessment that is less than the cost of billing and
collection shall be cancelled if no other tax, fee, or assessment is levied against the
parcel. Initially, the cost of billing and collection shall be deemed to be one dollar
($1.00) with any increase subject to agreement of the County Treasurer and County
Engineer.
