TITLE FOR AGENDA ITEM:
Resolution amending the 2023 Flood Control Zone District & Subzones Budget, request no. 1, in the
amount of $12,096,245 (Council acting as the Whatcom County Flood Control Zone District Board of
Supervisors)
SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE:
Supplemental # 1 requests from the Flood Control Zone District Fund:
1. To appropriate $2,517,712 to fund the elevation of homes, from grant proceeds, of fourteen
properties to mitigate future flood damages.
2. To appropriate $9,578,533 to fund the acquisition of fifteen properties with structures that were
substantially damaged, from grant proceeds.
3. To amend Exhibit B Flood Capital Program to allow transfer of unused budget authority from
Jones Creek Deflection Berm and Truck Road 2020 Damage projects to Marine Drive Levee
2020 Damage Repair project.

RESOLUTION NO. 2023 - 009
(A resolution of the Whatcom County Flood Control Zone District Board of Supervisors)
AMENDMENT NO. 1 OF THE 2023 BUDGET
WHEREAS, the 2023 budget for the Whatcom County Flood Control Zone District and
Subzones was adopted November 22, 2022; and,
WHEREAS, changing circumstances require modifications to the approved 2023 budget;
and,
WHEREAS, numerous residences were impacted by the November 2021 floods throughout
the County. One method of mitigating future flood risk is elevation of structures above the flood
elevation; and,
WHEREAS, the Federal Emergency Management Agency (FEMA) has recognized that
mitigation of flood damages improves resiliency of communities; and,
WHEREAS, local partners including the City of Sumas and the City of Ferndale have
identified residents exposed to flood risks and have pledged a working relationship; and,
WHEREAS, FEMA and State partners have made available funding in the amount of
$2,517,712 through the Hazard Mitigation Program (HMP) to assist 14 property owners in the
elevation of their homes; and,
WHEREAS, numerous structures that reside on properties within the County were destroyed
during the November 2021 Floods; and,
WHEREAS, FEMA has recognized that private property within the County resides in a high -
risk flood plain and residual damage to properties as a result of the November 2021 floods
exists; and,
WHEREAS, local partners including the City of Everson and the City of Sumas have
recognized high -risk flood plains within their respective limits and have pledged a working
relationship; and,
WHEREAS, FEMA, the United States Department of Housing and Urban Development
(HUD), and State partners have made available funding in the amount of $9,578,533 to restore,
purchase, and restrict 15 identified properties and develop floodways in order to mitigate future
damage to property; and,
WHEREAS, the Jones Creek Deflection Berm costs are under budget by $500,000; and,
WHEREAS, the Truck Road 2020 Damage project will not move forward this year resulting in
unused budget capacity of $2,500,000; and,
WHEREAS, the Marine Drive Levee 2020 Damage Repair project needs additional budget
capacity as costs will be $3,000,000 higher than initially projected; and,
WHEREAS, a budget transfer of excess capacity from Jones Creek Deflection Berm and
Truck Road 2020 Damage will cover the additional expenditures of Marine Drive Levee 2020
Damage Repair without a supplemental budget request; and,
WHEREAS, a budget transfer does not update Exhibit B Flood Capital Program the way a
supplemental budget request would,
NOW, THEREFORE, BE IT RESOLVED by the Whatcom County Flood Control Zone
District Board of Supervisors that the 2023 budget is hereby amended increasing budget
authority $12,096,245 to accomplish goals related to the November 2021 floods as presented
in Exhibit A.
BE IT FURTHER RESOLVED by the Whatcom County Flood Control Zone District Board of
Supervisors that the transfer of unused budget authority from Jones Creek Deflection Berm
and Truck Road 2020 Damage projects presented in Resolution 2022-048, Exhibit B Flood
Capital Program is hereby amended as displayed in attached Exhibit B.
