ORDINANCE NO. 2023-004
INSTALLATION OF STOP SIGNS ON CERTAIN COUNTY ROADS
WHEREAS, in compliance with RCW 36.32.120 and 46.61.200, it is found necessary
and expedient to install traffic control signs on certain County Roads; and
WHEREAS, in compliance with Whatcom County Code Title 15, that adopted the
2018 International Fire Code, including Appendix D and;
WHEREAS, 2018 IFC Appendix D section D107 requires developments of one- and
two-family dwellings where the number of dwelling units exceeds 30 shall be provided with
two separate and approved fire apparatus access roads; and
WHEREAS, Birch Point Road, north of Birch Bay Drive is the approved second fire
apparatus access road for The Horizons at Semiahmoo, Division 1; and
WHEREAS, this segment of Birch Point Road will be now be open to the public; and
WHEREAS, the County Engineer has determined that traffic control is now necessary
at the intersection of Birch Point Road and Birch Bay Drive; and
WHEREAS, the County Engineer has agreed that it is necessary to formally establish
these new stop signs; and
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that stop
signs be established for:
1) Southbound traffic on Birch Point Road at the intersection with Birch Bay Drive in
section 23, Township 40 North, Range 1 West, W.M.
2) Westbound traffic on Birch Bay Drive at the intersection with Birch Point Road in
section 23, Township 40 North, Range 1 West, W.M.
BE IT FURTHER ORDAINED, by the Whatcom County Council that the following be
added to the Whatcom County Code Section 10.16.1705:

BE IT FURTHER ORDAINED, that the County Engineer is hereby directed to install
the appropriate signs and the Whatcom County Sheriff and the Washington State Patrol be
notified by a copy of this ordinance.
ADOPTED this 21st day of February , 2023.
