December 6, 2022
Committee Chair Kaylee Galloway called the meeting to order at 10:16
a.m. in a hybrid meeting.
Present: 3 - Todd Donovan, Ben Elenbaas, and Kaylee Galloway
Absent: None
Also Present: Barry Buchanan and Carol Frazey
Clerk's note: Elenbaas was not present at roll call but joined the meeting
shortly thereafter.
Announcements
Committee Discussion and Recommendation to Council
1. AB2022-636 Ordinance amending Whatcom County Code 2.118, reactivating the Whatcom
County Wildlife Advisory Committee beyond December 31, 2022
The following people briefed the Councilmembers:
• Jon -Paul Shannahan, Planning and Development Services
Department
• Barry Wenger, Wildlife Advisory Committee
Donovan moved that the Ordinance be RECOMMENDED FOR ADOPTION
and stated it was good to get an update from an advisory committee and hear
what they are doing. He stated he appreciates their work.
Wenger thanked the Council for all they do.
Elenbaas stated he would abstain from the vote because he was not able to
hear the presentation.
Donovan's motion that the Ordinance be RECOMMENDED FOR
ADOPTION carried by the following vote:
Aye: 2 - Donovan, and Galloway
Nay: 0
Absent: 0
Abstain: 1 - Elenbaas

2. AB2022-661 Ordinance amending Whatcom County Code 16.20, Whatcom County Shellfish
Protection Districts
Erika Douglas, Public Works Department, briefed the Councilmembers and
answered questions about the incorporation of the Birch Bay Advisory
Committee into Birch Bay Watershed and Aquatic Resource Management
(BB WARM).
Donovan moved that the Ordinance be RECOMMENDED FOR
ADOPTION. Councilmembers voted on the item (see motion and vote
below) then continued to discuss it after the vote.
Douglas and Gary Stoyka, Public Works Department, answered what it costs
the County to run these advisory committees, whether the law allows a fee
to be charged to fund the program, and who would be charged.
Donovan's motion that the Ordinance be RECOMMENDED FOR
ADOPTION carried by the following vote:
Aye: 3 - Donovan, Elenbaas, and Galloway
Nay: 0
Absent: 0
