Council Planning and Development Committee Minutes - Final September 13, 2022 Committee Call To Order Roll Call Committee Chair Ben Elenbaas called the meeting to order at 2:37 p.m. in a hybrid meeting. Present: 3 - Todd Donovan, Ben Elenbaas, and Kaylee Galloway Absent: None Also Present: Barry Buchanan, Tyler Byrd, Carol Frazey, and Kathy Kershner Announcements Committee Discussion 1. A132022-490. Discussion of proposed ordinance adopting various amendments to WCC Title 20 Chapters 20.51 and 20.71 and other references to the Department of Ecology Stormwater Manual Cliff Strong, Planning and Development Services Department, read from the Staff Report (on file) and answered whether there is an Ordinance that is proposed that would have the Planning Commission's language, and whether this Ordinance is scheduled for introduction tonight. Donovan moved to amend the Ordinance to change the word "shall" to "may" in the four sections of the code in Exhibit A referenced by Strong (20.51.430(7e), 20.51..440(7e), 20.71.354(7e), and 20.71.356(7s) and in issue number four so that it reads "Financial sureties for replacement trees ,94+all--r 4A7 be required"). Councilmembers and Strong discussed the effect of the motion. The motion carried by the following vote: Aye: 3 - Donovan, Galloway, and Elenbaas Nay: 0 Strong continued to read from the Staff Report and answered whether Public Works stormwater projects have to be reviewed by Planning and Development Services for stormwater compliance now and the change suggested in Policy Issue number five from the Staff Memo proposes that those projects would be exempt from review. Michael Kershner, Planning and Development Services Department, answered why the code sections under "Deletion of unused sections" (Staff Miatcom County Page I Council Planning and Development Committee Minutes - Final September 13, 2022 Committee Report issue number seven) are not used. Strong answered whether there has been any study to determine if these code changes will reduce the stormwater runoff and phosphorus into Lake Whatcom.
