ROLL CALL Present: 7 - Ben Elenbaas, Carol Frazey, Kaylee Galloway, Kathy Kershner, Barry Buchanan, Tyler Byrd, and Todd Donovan Absent: None FLAG SALUTE ANNOUNCEMENTS COUNTY EXECUTIVE'S REPORT Satpal Sidhu, County Executive, reported on the following: A Whatcom County project to replace the Lummi Island ferry has been approved for a $10 million grant from the County Road Administration Board. This recommendation goes to the Legislature for the 2023 session for fund allocations in the next biennium budget. The Whatcom County grant application for the federal Rebuilding American Infrastructure with Sustainability and Equity (RAISE) grant of $25 million has been approved. A letter sent to the Council and the Executive by all the seven Whatcom County city mayors asking for immediate action and financial commitment from the County Council to start work on a public safety facility replacement project and pledging financial and other resources MINUTES CONSENT Buchanan moved to accept the minutes consent items. AB2022-380 Ordinance granting Cascade Natural Gas Corporation a franchise for the transportation of natural gas in Whatcom County Andrew Hester, Public Works Department, briefed the Councilmembers and stated he was available for questions. Donovan opened the Public Hearing and, hearing no one, closed the Public Hearing. Byrd moved and Buchanan seconded that the Ordinance Requiring a Public Hearing be ADOPTED. AB2022 -425 Ordinance temporarily amending Whatcom County Code Section 11.20.025, flotation devices on the South fork of the Nooksack River, to better protect ESA -listed Chinook salmon Dana Brown -Davis, Clerk of the Council, answered if there needs to be two separate public hearings for this and the next item since one is a version of the Ordinance that is interim and one is a version of the Ordinance that is permanent. The following people presented: • RoseNlary LaClair, Nooksack Chairwoman • Ned Currence, Nooksack Tribe • GI James, Lummi Nation Council They answered what is considered an encounter, whether they do any counts on the number of salmon at the mouth of the river and at different intervals up the river so they can see how far the fish are making it on average, whether there is any data at all then that shows how far up fish are making it and what percentage, what the primary concern is with floaters on the river, and whether this Resolution would fix the problem. Treva Coe, Nooksack Tribe Natural & Cultural Resources Department, spoke about concerns about recreation on the river and the trampling of reds. James and Currence answered when reds hatch in the South Fork, whether 2,500 fish died during or before the flood in November of 2021, whether there was an increase of salmon while a lot of tubing was still occurring, whether an Ordinance in 2005 (AB2005-173A or Ord 2005-089) only closed tubing up to Acme bridge, whether it is more the condition and temperature of the river than tubers that affect the salmon, and whether there are some other solutions that could be looked at to lower the temperature of the water or maybe make some deeper pools. John Thompson, Public Works Department, spoke about the reason for the closure area in the 2005 Ordinance. LaClair spoke about whether there is something they could do to lower the Whtucom County Page 3 Printed on 911912022 Council Minutes - Final August 9, 2022 temperature of the river rather than banning tubing. Elenbaas spoke about what other factors might be involved in the decline of salmon, what we need to do to get back to the harvest levels of 1985, and working together to determine what measures are effective. Whatcom County Page 4 Printed on 911912022 Council Minutes - Final August 9, 2022 Councilmembers spoke about the Ordinance and the motion, keeping recreation opportunities for people and also doing everything they can to protect salmon, whether they should put up educational signage in key areas, whether education is better than a ban, a concern that there is no way to really enforce a ban, and getting more information on what netting the river entails. Galloway's motion that the Ordinance Requiring a Public Hearing be adopted FAILED by the following vote: Aye: 3 - Galloway, Buchanan, and Donovan Nay: 4 - Elenbaas, Frazey, Kershner, and Byrd Absent: 0 3. Af32022-411,7 Ordinance amending Whatcom County Code Section 11.20.025, flotation devices on the South fork of the Nooksack River, to better protect ESA -listed Chinook salmon Karen Frakes, Prosecuting Attorney's Office, stated given what happened on the temporary Ordinance it is pretty clear what would happen on the permanent Ordinance and suggested they bring forward a motion to withdraw the Ordinance so that would negate the need to have a second public hearing. Byrd moved and Kershner seconded that the Ordinance Requiring a Public Hearing be WITHDRAWN. AB202_.,2a440 Request for a Motion to grant the City of Bellingham notice to proceed in applying for a Major Project Permit for their Umbrella Mitigation Bank Elenbaas moved the following: The Whatcom County Council has reviewed the City of Bellingham's Umbrella Mitigation Bank Prospectus and finds it complete, technically Whatcom County Page 12 Printed on 9/19/2022 Council Minutes - Final August 9, 2022 accurate, and consistent with the purpose and intent of Whatcom County Code (WCC) Chapter 16.16 (Critical Areas). Furthermore, the proposed bank involves no conversion of agricultural land to nonagricultural uses. We therefore grant the City of Bellingham notice to proceed in applying for a Major Project Permit for the project. The motion was seconded by Byrd. Analiese Burns, City of Bellingham Habitat and Restoration Manager, and Cliff Strong, Planning and Development Services Department, answered whether the City is primarily bearing the cost on this, how the public comment period worked and what the comments were, how people knew there was a public comment period, whether there will be further opportunity for public comment when the major project permit process starts, the major project permit process itself, whether this is a binding vote, and whether the City can hold them liable in the future in a court of law if they do not vote the same way next time. Karen Frakes, Prosecuting Attorney's Office, stated she did not want to offer a legal opinion at this time but could look into it for the Council. Resolution establishing priorities for Whatcom County's 2025 Comprehensive Plan update Donovan reported for the Committee of the Whole and stated another substitute (version 7) was emailed to the Councilmembers. Galloway spoke about the changes in the substitute. Elenbaas moved to approve the Resolution without Exhibit A. The motion was seconded by Kershner. Councilmembers discussed the motion. Karen Frakes, Prosecuting Attorney's Office, answered whether the statement in the Resolution that says, 66BE IT FURTHER RESOLVED, by Whatcom County Page 13 Printed on 911912022 Council Minutes - Final August 9, 2022 the Whatcom County Council that the attached Exhibit A be considered as possible implementation strategies and actions that could help accomplish the priorities listed in this resolution" makes it clear enough that Exhibit A is not binding. Elenbaas spoke about open session comments and requested that the Council accept the offer to get together with the Lummi Nation to talk about the river, salmon, and agriculture. Councilmembers gave other updates and discussed the issues going on at 22 North and Galloway stated she would support an opportunity to do a work session in September to work on solutions. Satpal Sidhu, County Executive, spoke about a recent meeting on the issue. He stated we are not giving Northwest Youth Services a pass but giving them a pathway. We have to find a solution.
