ORDINANCE NO. 2022-025
REPEAL OF ORDINANCE 2022-005 ORDERING THE TEMPORARY CLOSURE OF GULF
ROAD
WHEREAS, an Ordinance, "Ordering the Temporary Closure of Gulf Road South of
Henry Road," was introduced as AB2022-039 on January 25, 2022 as a proposal to
temporarily close Gulf Road to vehicular traffic; and
WHEREAS, a notice of public hearing for the Ordinance proposing to temporarily
close Gulf Road to vehicular traffic (AB2022-039) was published on January 30, 2022; and
WHEREAS, Council approved introducing the Ordinance to temporarily close Gulf
Road to vehicular traffic (AB2022-039) on January 25, 2022 as a matter for consideration at
the Council's February 8, 2022 meeting; and
WHEREAS, Council received a presentation from Public Works staff on the proposed
Ordinance at the February 8, 2022 meeting; and
WHEREAS, Council held a public hearing on the Ordinance Ordering the Temporary
Closure of Gulf Road South of Henry Road, at the February 8, 2022 Council meeting; and
WHEREAS, Council received a single public comment on the ordinance at the public
hearing; and
WHEREAS, Council voted to adopt the Ordinance Ordering the Temporary Closure of
Gulf Road South of Henry Road as Adopted Ordinance 2022-005 at the February 8, 2022
meeting; and
WHEREAS, Council subsequently received substantial public comment on Ordinance
2022-005 after Council adopted it and after the Executive approved the Ordinance; and
WHEREAS, Council discussed the possibility of rescinding Ordinance 2022-005 at
the Council's February 22, 2022 meeting, but was not able to rescind given parliamentary
procedures; and
WHEREAS, Council wishes to reconsider the temporary closure of Gulf Road to
vehicular traffic in order to consider additional public comment on the matter; and
WHEREAS, a repeal of Ordinance 2022-005 does not preclude subsequently
adopting a similar or amended version of the repealed ordinance in the future; and
WHEREAS, Council recognizes private property rights and repealing Ordinance 2022-
005 only affects the County right-of-way and does not invite trespass on adjacent private
lands; and

NOW, THEREFORE, BE IT ORDAINED, that Ordinance 2022-005 is repealed.
