ROLL CALL Present: 6 - Rud Browne, Barry Buchanan, Tyler Byrd, Todd Donovan, Ben Elenbaas, and Carol Frazey Absent: 1 - Kathy Kershner FLAG SALUTE ANNOUNCEMENTS COUNTY EXECUTIVE'S REPORT Satpal Sidhu, County Executive, reported on the following: • Congratulations to the newly re-elected and elected Councilmembers • A recent audit exit meeting from the State Auditor with no findings • A breakdown of the Ferry in October, a resulting declaration of emergency, and a recently submitted a $10 million grant from the County Road Administration Board for the ferry • The appointment of a new County Medical examiner • The mid -biennium budget adjustment, allocation of American Rescue Plan Act funds, and the general fund balance. • Money that may be coming for specific items from the Federal Infrastructure Bill and an upcoming Social Infrastructure Bill MINUTES CONSENT Donovan moved to accept the minutes consent items. AB2021..-61, 5 Request authorization for the County Executive to enter into an interlocal agreement between Whatcom County and City of Bellingham for partial funding of maintenance and operations of the Crisis Stabilization Center, in the amount of $65,000 Frazey reported for the Finance and Administrative Services Committee and moved that the Interlocal be AUTHORIZED. The motion was seconded by Browne. Perry Mowery, Health Department, answered questions about how the funding will be ongoing, where the dollars have come from, what percentage of the Interfund Transfer was for the total annual maintenance expenses for the Crisis Stabilization Center, and whether there is more long-term funding now. AB2021-612 Discussion and request for motion regarding County Council meeting broadcast on Bellingham public access television (BTV) and streaming on YouTube Buchanan reported for the Committee of the Whole and stated there was consensus to have Councilmember Browne draft a letter to the Bellingham City Council and bring it back to the Council in two weeks. This agenda item was DISCUSSED. (No Committee Assignment) 9. AB2021Resolution approving the 2021 Whatcom County Climate Action Plan The following people briefed the Councilmembers: • Chris Elder, Public Works Department • Ellyn Murphy, Climate Impact Advisory Committee Buchanan moved and Donovan seconded that the Resolution be APPROVED. Satpal Sidhu, County Executive, thanked the advisory committee, and proposed that there should be a county -wide plan and Cities can take up certain types of actions they would like to take within a coordinated effort. Councilmembers and the speakers discussed the motion and whether some projects should be prioritized. Browne moved to amend the motion to adopted the plan with a caveat that any suggestion that comes back to the Council must be costed. Browne restated his motion that we adopt the Climate Action Plan but as the recommendations come to us they must have a good faith estimate of cost and a good faith estimate of return. Councilmembers and the speakers discussed the motion to amend and Elenbaas seconded the motion. Councilmembers discussed the motion and expressed that they love the idea. Satpal Sidhu, County Executive, described how the idea came to be and answered a question about an upcoming ceremony. Al071-629 Request confirmation of the County Executive's appointments of Brian Hunter and Prakash Sundaresan to the Point Roberts Community Advisory Committee Donovan moved and Frazey seconded that the Executive Appointment be CONFIRMED. Councilmembers discussed the item. Prakash Sundaresan addressed the Council and introduced himself. Councilmembers voted on the item (see the vote below). AB2021.65 5 Request confirmation of the County Executive's appointment of Roger Kubalek to the Agricultural Advisory Committee Frazey moved and Byrd seconded that the Executive Appointment be CONFIRMED. Satpal Sidhu, County Executive, answered who this individual is replacing on the Agricultural Advisory Committee and Councilmembers discussed the motion, why the Council confirms Executive appointments, and whether the Agricultural Advisory Committee is representative of the actual agricultural community. Tyler Schroeder, Executive's Office, answered a question about where to find the current committee members and whether the list is up to date. Councilmembers and Sidhu continued to discuss the motion. Frazey's motion that the Executive Appointment be CONFIRMED carried by the following vote: Aye: 6 - Browne, Buchanan, Byrd, Donovan, Elenbaas, and Frazey Nay: 0 Absent: 1 - Kershner ITEMS ADDED BY REVISION 1. AB20 h 1-668 Discussion and request for motion regarding the Justice Project (Public Health, Safety, and Justice Facility Needs Assessment) Buchanan reported for the Criminal Justice and Public Safety Committee and moved that he be appointed to serve on the Stakeholder Advisory Committee to work on the Justice Facility Needs Assessment. The motion was seconded by Browne. The file was forwarded to Council without a recommendation from the committee. Donovan amended his motion and moved to introduce agenda items 1 through 7 and 9 through 18. The motion was seconded by Frazey. Councilmembers voted on the motion (see motion and votes on individual items below). Councilmembers discussed. COMMITTEE REPORTS, OTHER ITEMS, AND COUNCILMEMBER UPDATES Councilmembers gave committee reports. They discussed AB2021-553 (Presentation from the Whatcom Mountain Bike Coalition on trail maintenance and the possibility of allowing for limited trail construction during seasonal closures), whether there will be more discussion at a later date, and whether the Council will have to take an action or make a recommendation. Tyler Schroeder, Executive's Office, stated it sounded like Eric Brown would come back again to the Public Works and Health Committee and discuss additional information, and if the Committee at that point wants to recommend staff from the Planning Department to coordinate with Public Works and Parks to look into options to bring back to Council, the Administration would be amenable to that. Buchanan stated it will get scheduled in the Public Works and Health Committee at some point. Councilmembers discussed AB2021-605 (Discussion on proposed amendments to the Whatcom County Code Title 20 (Zoning) to provide wbatcom County Page 16 Printed on 121312021 Council Minutes - Final November 9, 2021 additional affordable housing options). Byrd stated he requested in committee that he get together with the stakeholders and Planning and Development Services staff then come back to the committee with a version that may resolve the questions they have had. Dana Brown -Davis, Clerk of the Council, answered whether the discussion could just be held in Committee but stated the related Ordinance should be pulled from Introduction. Donovan moved that AB2021-606 (Ordinance adopting amendments to the Whatcom County Code Title 20, Zoning, to provide additional affordable housing options, including allowing and regulating tiny homes and allowing duplexes in planned unit developments) be withdrawn from introduction. The motion was seconded by Elenbaas. The motion carried by the following vote: Aye: 6 - Browne, Buchanan, Byrd, Donovan, Elenbaas, and Frazey Nay: 0 Donovan asked about how long AB2021-605 would be held and Brown -Davis stated that the motion in Committee was to hold the discussion in Committee until December 7.
