Council Finance and Administrative Committee Minutes - Final September 28, 2021 Services Committee Call To Order Roll Call Cathy Halka, Council Legislative Analyst, announced that the Finance and Administrative Services Committee will start at 10:10 a.m. Committee Chair Rud Browne called the meeting to order at 10:10 a.m. in a virtual meeting. Present: 3 - Rud Browne, Tyler Byrd, and Carol Frazey Absent: None Also Present: Barry Buchanan, Todd Donovan, Ben Elenbaas, and Kathy Kershner Announcements Special Presentation 1. AE2021 m536 Report from Superior Court This agenda item was WITHDRAWN. 2. AB2021-556 Report from the Administrative Services Department Facilities Division Rob Ney, Administrative Services Department, gave a presentation and answered questions. Tyler Schroeder, Executive's Office, also answered questions. Councilmembers and staff discussed the community donations of $300,000 for the State Street Way Station project, how many years the bond for construction would be, how the County was planning on paying for the NW Annex project before the availability of federal COVID-19 dollars, getting an alternate funding solution for that project, whether Coronavirus Aid, Relief, and Economic Security (CARES) Act dollars should be used for infrastructure, and whether caf6s or childcare are a permitted uses in the zone for the NW Annex project. This agenda item was REPORTED. Committee Discussion and Recommendation to Council 1. AB2021-5112 Ordinance amending the 2021 Whatcom County Budget, request no. 14, in the amount of $315,947 Frazey moved that the Ordinance be RECOMMENDED FOR ADOPTION. AB2021_-522 Resolution amending the Flood Control Zone District 2021 budget, request no. 3, in the amount of $175,000 (Council acting as the Whatcom County Flood Control Zone District Board of Supervisors) Byrd moved that the Resolution (FCZDBS) be RECOMMENDED FOR APPROVAL. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 3. A112021-527 Request approval for the County Executive to enter into an agreement with Cascadia Policy Solutions, LLC, for the purpose of developing and implementing a collaborative water solutions table in the amount of $190,000 (Council acting as the Flood Control Zone District Board of Supervisors) Frazey moved that the Contract (FCZDBS) be RECOMMENDED FOR AUTHORIZATION. Gary Stoyka, Public Works Department, answered questions about whether this contract will include concrete solutions to address water issues, whether the contract would be useful since some of the stakeholders are not included, what major issues might need to be dealt with first before involving all stakeholders, and whether the Planning Unit can submit feedback now. Frazey's motion that the Contract (FCZDBS) be RECOMMENDED FOR AUTHORIZATION carried by the following vote: Aye: 2 - Browne, and Frazey Nay: 1 - Byrd Absent: 0 4. AB2021 533_ Request approval for the County Executive to enter into an agreement with Kramer Consulting, Inc. for facilitation services for the WRIA 1 Drainage Based Management Pilot Project in the amount of $100,000 (Council acting as the Flood Control Zone District Board of Supervisors) Byrd moved that the Contract (FCZDBS) be RECOMMENDED FOR 91talcom County Page 2 Council Finance and Administrative Committee Minutes - Final Services Committee AUTHORIZATION. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 September 28, 2021 5. AB2021-534 Request Council approval of the 2021-2023 Criminal Justice Treatment Account Plan Update Frazey moved that the Request for Motion be RECOMMENDED FOR APPROVAL OF REQUEST. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 6. AB2021-545 Request authorization for County Executive to enter into an Interlocal Grant Agreement between Whatcom County and the Administrative Office of the Courts to reimburse Whatcom County for extraordinary costs associated with the Blake decision in the amount of $1,790,621 Byrd moved that the Interlocal be RECOMMENDED FOR AUTHORIZATION. Councilmembers discussed the funding source. The following people answered questions: • Tyler Schroeder, Executive's Office • Karen Frakes, Prosecuting Attorney's Office They answered whether a new account would be set up for this money, how costs would be tracked, whether there have been any reimbursement requests, and what requestors would be compensated for. Byrd's motion that the Interlocal be RECOMMENDED FOR AUTHORIZATION carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 7. AB2021-551 Request authorization for the County Executive to enter into a contract amendment between Whatcom County and Opportunity Council to operate the Whatcom Whatcont County page 3 Council Finance and Administrative Committee Minutes - Final September 28, 2021 Services Committee Homeless Service Center in the amount of $162,400 for a total amended contract amount of $1,113,951 Frazey moved that the Contract be RECOMMENDED FOR AUTHORIZATION. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 8. AB2021-555 Request authorization for the County Executive to enter into a contract amendment between Whatcom County and Pacific Security to provide COVID-related security services in the amount of $51,752 for a total amended contract amount of $123,488 Frazey moved that the Contract be RECOMMENDED FOR AUTHORIZATION. Sue Sullivan, Health Department, answered and Councilmembers discussed whether there have been any updates to the idea of cost sharing with other counties, whether access to available rooms is based on a first come first served basis, whether there should be an agreement for equal cost sharing amongst the participating counties, and who currently has priority for usage of the facility. Frazey's motion that the Contract be RECOMMENDED FOR AUTHORIZATION carried by the following vote: Aye: 2 - Browne, and Frazey Nay: 1 - Byrd Absent: 0 Council "Consent Agenda" Items 1. A202.1-488 Request authorization for the County Executive to execute a contract amendment between Code Publishing Company and Whatcom County for legal code publishing services Frazey moved that the Contract be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 Whatcom County Page 4 Council Finance and Administrative Committee Minutes - Final September 28, 2021 Services Committee 2. AB2021-513 Request authorization for the County Executive to enter into a transfer option agreement between Whatcom County and Opportunity Council for the property located at Laurel and Forest streets for the appraised amount of $1,230,000 Byrd moved to remove AB2021-513 and AB2021-562 from the consent agenda. Councilmembers and Dana Brown -Davis, Clerk of the Council, discussed whether the motion should be made in committee or in the Council meeting. There was no vote on Byrd's motion. Browne read AB2021-513 into the record and the item failed to get a motion to approve. Clerk's note: See further discussion on this item after AB2021-517 below. This agenda item was FORWARDED TO COUNCIL WITHOUT A RECOMMENDATION. 3. A132021-517 Request authorization for the County Executive to enter into an interlocal agreement between Whatcom County and Washington State Department of Ecology for solid waste planning and implementation activities, in the amount of $732,835 Frazey moved that the Interlocal be RECOMMENDED FOR AUTHORIZATION BY CONSENT. Byrd moved approval of the consent agenda in its entirety minus the two items (AB2021-513 and A132021-562). Dana Brown -Davis, Clerk of the Council, spoke about standard practice of the Council for the Consent Agenda items and Councilmembers discussed the motion. Byrd's motion was not voted on after Browne and Frazey stated they would not support it. Frazey's motion that the Interlocal be RECOMMENDED FOR AUTHORIZATION BY CONSENT carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 Whatcom County Page 5 Council Finance and Administrative Committee Minutes - Final September 28, 2021 Services Committee 2. AB2021-513 Request authorization for the County Executive to enter into a transfer option agreement between Whatcom County and Opportunity Council for the property located at Laurel and Forest streets for the appraised amount of $1,230,000 Councilmembers went back to AB2021-513 and discussed whether this is simply the property transfer agreement and not contingent on any sources of funds. Tyler Schroeder, Executive's Office, answered whether the transfer is just surplus with zero value. 4, A13021-526 Request authorization for the County Executive to enter into an interlocal agreement between Whatcom County and Washington State Department of Commerce for FYI Justice Assistance Grant, in the amount of $155,053.00 Byrd moved that the Interlocal be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 5. AB2021-529 Request approval for the County Executive to enter into an agreement with Washington State Recreation and Conservation Office in order to secure matching funds for the VanderWerff Agricultural Conservation Easement through the Conservation Easement Program Frazey moved that the Contract be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 6. AB2021 -530 Request approval for the County Executive to enter into an agreement with the Washington State Recreation and Conservation Office in order to secure matching funds for the Moors Forestry Conservation Easement through the Conservation Easement Program Byrd moved that the Agreement be RECOMMENDED FOR AUTHORIZATION BY CONSENT. AB2021.532 Request authorization for the County Executive to enter into an interlocal agreement between Whatcom County and Washington State Department of Children, Youth, and Families for high quality home visiting services to vulnerable families, in the amount of $355,339 Frazey moved that the Interlocal be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 8. AB2021 ^540 Request approval for the County Executive to enter into an agreement with the United States Department of Interior, Geological Survey in the amount of $145,225 (Council acting as the Flood Control Zone District Board of Supervisors) Byrd moved that the Contract (FCZDBS) be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 9. AB2021-542 Request approval for the County Executive to enter into an interagency agreement between the State of Washington Puget Sound Partnership and the Whatcom County Flood Control Zone District, acting as the fiscal agent for the Local Integrating Organization (LIO) to coordinate the County LIO (Council acting as the Flood Control Zone District Board of Supervisors) Frazey moved that the Contract (FCZDBS) be RECOMMENDED FOR AUTHORIZATION BY CONSENT. AB2021-554, Request authorization for the County Executive to enter into a contract amendment between Whatcom County and Northwest Youth Services to support operations at the Ground Floor Day Use Center in the amount of $10,000 for a total amended contract amount of $145,000 Byrd moved that the Contract be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 11. A B2021-557 Request authorization for the County Executive to enter into a contract amendment between Whatcom County and Catholic Community Services to provide behavioral health support at Francis Place and other permanent supportive housing programs in the amount of $60,757 for a total amended contract amount of $306,173 Frazey moved that the Contract be RECOMMENDED FOR AUTHORIZATION BY CONSENT. The motion carried by the following vote: Aye: 3 - Browne, Byrd, and Frazey Nay: 0 Absent: 0 12. AB2021`562 Request authorization for the County Executive to enter into a contract amendment between Whatcom County and G6 Hospitality Group to extend the agreement for an additional three months Frazey moved that the Contract be RECOMMENDED FOR AUTHORIZATION BY CONSENT.
