SUMMARY STATEMENT OR LEGAL NOTICE LANGUAGE:
Ordinance adopting amendments to the Unified Fee Schedule relating to density credit fees for
increasing the size of accessory dwelling units. The proposed fee is $8 per square foot of increased size
of an accessory dwelling unit.

AMENDMENT NO. 1 TO ORDINANCE NO. 2020-062 ADOPTING THE 2021
WHATCOM COUNTY UNIFIED FEE SCHEDULE
WHEREAS, the County Council approved the 2021 Whatcom County Unified Fee Schedule on
November 24, 2020, and
WHEREAS, The Whatcom. County TDRIPDR Multi -Stakeholder Work Group Final Report was
issued on October 3, 2018. This report included a number of recommendations, including the following:
... Accessory dwelling units are currently limited to 1,248 square feet... The TDR/PDR Work
Group recommends increasing the size limit by 500 square feet to a maximum of 1,748 square
feet if density credits are purchased. It is recommended that the price should be $8/square foot up
to the 500 square foot maximum... (p. 34); and
WHEREAS, the Whatcom County Council is considering a separate ordinance in 2021 that
would allow an increase in the size of accessory dwelling units if density credit fees are paid by the
applicant; and
WHEREAS, an additional density credit fee is proposed in accordance with WCC 20.91.030.
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that the Planning
and Development Services section of the Whatcom County Unified Fee Schedule is hereby amended as
presented on Exhibit A.
