Call To Order
Roll Call
Council Vice Chair Carol Frazey called the meeting to order at 9:05 a.m. in
a virtual meeting.
Present: 6 - Rud Browne, Barry Buchanan, Tyler Byrd, Todd Donovan, Carol Frazey and
Ben Elenbaas
Absent: 1 - Kathy Kershner
Committee Discussion
Attorney Present: Chris Quinn and Karen Frakes.
Frazey stated that discussion of agenda item one and three may take place in
executive session pursuant to RCW 42.30.110(1)(i)] and item two may take
place in executive session pursuant to RCW 42.30.110 (1)(c)]. Executive
session will conclude no later than 10:30 a.m. If the meeting extends
beyond the stated conclusion time, Council staff will make a public
announcement.
Donovan moved to go into executive session until no later than 10:30 a.m.
to discuss the agenda items pursuant to the RCW citations as announced by
the Council Vice Chair. The motion was seconded by Browne.
The motion carried by the following vote:
Aye: 5 - Browne, Byrd, Donovan, Elenbaas, and Frazey
Nay: 0
Out of the Meeting: 1 - Buchanan
Absent: 1 - Kershner
Clerk's note: Buchanan joined the meeting right after the vote.
1. AB2021-156 Discussion of pending litigation with Civil Deputy Prosecutor Chris Quinn: Ericksen v.
Whatcom County Flood Control Zone District, Whatcom County Superior Court
Cause No. 20-2-00650-37 [Discussion of this item may take place in executive
session (closed to the public) pursuant to RCW 42.30.110(1)(i)] (Council acting as
the Whatcom County Flood Control Zone District Board of Supervisors)

2. AB2021-213 Discussion regarding a potential sale of county owned surplus property [Discussion of

expanded recreational cannabis growing and/or processing facilities [Discussion of this

RCW42.30.110 (1) (i)]
