Tuesday, January 26, 2021 2:40 PM Virtual Meeting COUNCILMEMBERS Rud Browne Todd Donovan Carol Frazey CLERK OF THE COUNCIL Dana Brown -Davis, C.M.C. Council Public Works & Health Committee Minutes - Final January 26, 2021 Committee Call To Order Roll Call Committee member Carol Frazey called the meeting to order at 2:42 p.m. in a virtual meeting. Present: 3 - Carol Frazey, Todd Donovan and Rud Browne Absent: None Also Present: Barry Buchanan, Tyler Byrd, Ben Elenbaas, and Kathy Kershner Special Order of Business 1. AB2021-071 Nomination and appointment of committee chair Donovan moved that Frazey be NOMINATED AND APPOINTED. The motion carried by the following vote: Aye: 3 - Frazey, Donovan and Browne Nay: 0 Absent: 0 Frazey was appointed as Committee Chair and continued the meeting. Committee Discussion 1. AB2021-073 Discussion of proposed ordinance authorizing the closure of a portion of 4th Street in Custer, Washington, related to COVID-19 economic relief Donovan moved that the Ordinance be recommended to the full Council. Elenbaas briefed the Councilmembers on the proposed ordinance. He stated it is written as a regular ordinance but he would like to see it go through as an emergency ordinance. The following staff discussed the proposed ordinance with the Councilmembers: • Jon Hutchings, Public Works Department Director • Jim Karcher, Public Works Department • Karen Frakes, Prosecuting Attorney's Office They discussed whether a road closure is needed, doing a temporary right-of-way permit, how the ordinance should proceed, whether it meets Wkatcom County Page 1 Council Public Works & Health Committee Minutes - Final January 26,2021 Committee the criteria of an emergency ordinance, and whether policy should be written and brought forward to establish limitations on these types of situations. Donovait withdreip his motion because the ordinance is scheduled for introduction tonight. Karcher stated they could do a temporary right-of-way permit and let the ordinance go through its regular process. This agenda item was DISCUSSED.
