Council Planning and Development Committee Minutes - Final October 13, 2020 Committee Call To Order Roll Call Because Committee Chair Elenbaas was joining the meeting via phone, Tyler Byrd acted as committee chair for the entirety of the meeting. Present: 3 - Rud Browne, Tyler Byrd and Ben Elenbaas Absent: None Also present: Barry Buchanan, Todd Donovan, Carol Frazey, and Kathy Kershner Committee Discussion 1. AB2020-421 Discussion and Council motion to approve the Public Participation Plan for Whatcom County Comprehensive Plan and Development Regulation Amendments Elenbaas moved approval of the item but it was withdrawn so they could receive a staff report first. Matt Aamot, Planning and Development Services Department, briefed the Councilmembers and answered whether item three referred to in the memo (3. Removing Amendments - Deleting amendments that were previously initiated but have completed the review process or were withdrawn) means amendments that were withdrawn by the Council, whether any of the changes are substantial changes from what they have had in the past, and why the recommendation is to change the language from the "Planning and Development Staff' to "The County" as it relates to remote participation in public hearings. Browne moved to approve the Public Participation Plan as proposed. Elenbaas moved to amend to accept the following changes proposed by the Planning Commission as outlined in the memo: • Remote Participation - New Section 1.2 in Chapter 1 (p. 1-3): Planning ^lla Deve opmef4 staff The County should identify methods for remote public participation for all public hearings (for example, online or telephonic participation). The motion to amend carried by the following vote: Aye: 3 - Browne, Elenbaas, and Byrd Nay: 0 Whatcon: County Page I Council Planning and Development Committee Minutes - Final October 13, 2020 Committee The motion to approve as amended carried by the following vote: Aye: 3 - Elenbaas, Browne, and Byrd Nay: 0 This agenda item was DISCUSSED AND MOTION(S) APPROVED. 2. AB2020-414 Discussion regarding proposed ordinance amending Whatcom County Code 24.02, Mobile Home Park Regulations, to create additional housing options within mobile home parks Mark Personius, Planning and Development Services Department Director, briefed the Councilmembers and referred to a recent memo sent to the Council. He and the following staff answered questions: • Curtis Metz, Planning and Development Services Department • Nick Smith, Planning and Development Services Department Staff answered questions about why updates to the International Residential Code (IRC) concerning minimum square footage are not currently reflected in the guidebook, the difference between a manufactured home and a manufactured tiny home, whether a new definition of tiny homes is needed, what is involved in the County changing the zoning to allow a tiny house in a single-family residence lot as an accessory as opposed to using a development right, the definition of a park model home, whether the Health Code needs to be updated to allow premanufactured tiny homes, getting more clarity from Karen Frakes, Prosecuting Attorney's Office, and the process for needed to go forward with Code changes.
