property be sold by negotiation as per RCW 36.35.150(1)(b), when the county legislative authority determines that it is not practical to
build on the property due to the physical characteristics of the property or legal restrictions on construction activities on the property;
subject to a covenant to bind.

NOTICE OF HEARING OF THE
SALE OF COUNTY TAX TITLE PROPERTY
BY NEGOTIATION
REQUEST NO. TR2017-04
1 WHEREAS, the following described property is now, and has been the property of
2 the County of Whatcom, State of Washington since: as noted per parcel below; and,
3 WHEREAS, the Whatcom County The Property Management Committee
4 determined the property be sold by negotiation as per RCW 36.35.150(1)(b), when the
5 county legislative authority determines that it is not practical to build on the property due to
6 the physical characteristics of the property or legal restrictions on construction activities on
7 the property; subject to a covenant to bind; and,
8

12 WHEREAS, the Whatcom County Property Management Committee recommends
13 its sale by negotiation; and,
14 WHEREAS, the Whatcom County Property Management Committee recommends
15 the Whatcom County Treasurer enter into negotiations with the applicant; and,
16 WHEREAS, the principal taxes, interest, penalties, title search and foreclosure costs
17 total 1 800.93; and,
18 WHEREAS, the Whatcom County Council does deem it in the best interest of the
19 County and the people thereof that said property be sold for no less than the principal
20 taxes, interest, penalties, title search and foreclosure costs; and,
21 WHEREAS, Resolution 95-005 designated the Whatcom County Treasurer as
22 negotiator in such sales; and,

23 WHEREAS, RCW 36.35.120 requires the Council to establish the minimum price for
24 said units of property and to determine whether or not a contract will be allowed, or if it will
25 be a cash price;
26 NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County
27 to sell for a price to be negotiated by the Whatcom County Treasurer, the following
28 Tax -Title property acquired 11/19/2010,

31 For no less than the principal taxes, interest, penalties, title search and foreclosure costs of
32 $1,800.93

34 BE IT FURTHER RESOLVED by the Whatcom County Council, that a public hearing on
35 the matter of the sale of said property, under said terms, be held on
36 the day of 2017, at p.m., at the
37 Whatcom County, Washington; and,
38 BE IT FURTHER RESOLVED that the Clerk of the Whatcom County Council shall
39 give notice of such hearing in the manner prescribed by law under RCW 36.34.030.
