Members of the Whatcom County Council will utilize county -provided email accounts when conducting county business via e-mail whenever possible. 2. When using a county -provided email account, a copy of every email message sent or received by a councilmember will be retained by the county in electronic format and remain usable, searchable, retrievable, and authentic for the length of the designated retention period. 3. The use of personal email accounts is highly discouraged. If, for any reason, a councilmember must use a personal account to conduct official county business, copies of all emails sent or received must be forwarded to the councilmember's county -provided email account. Councilmember will notify anyone who communicates to their personal email account that all future emails regarding county business must be sent to their official county email address. 4. Councilmembers can access their county email account from a remote location or from a non -county computer that has internet access using webmail. 5. Councilmembers are responsible for the security of their email account, including their account password. 6. Emails between non -county email addresses (such as citizens, businesses, and other non -county parties), and councilmember email addresses are public records subject to records retention and public records disclosure laws. A disclosure statement shall be posted on the council's webpage, alerting interested parties to the fact that email messages sent to or received by councilmembers are public records subject to public disclosure upon request. A similar disclosure statement shall be automatically inserted into all email messages originating from a councilmember or a member of the council's staff. 7. Councilmembers are individually responsible for the content of every email they send. 8. Email exchanges between councilmembers can create an unintended quorum by "serial communication" and violates the Open Public Meetings Act. Councilmembers should avoid email exchanges that ultimately involve or create a quorum of the entire council or any of its committees. If a councilmember wishes to send an informational email to a majority of the council, he or she must make it abundantly clear in the email that the information is being provided for review only and that no response is desired. 9. Carbon copies (cc) of emails are public records and are fully subject to the Open Public Records Act. 10. Blind copying (bc) emails is specifically prohibited, including the use of blind distribution lists. A blind copy is a public record subject to public disclosure under the Open Public Records Act. 11. Metadata associated with electronic documents, such as the "to" and "from" fields in an e-mail, will be retained with the original email message and is a public record subject to disclosure upon request. 12. Personal email should be transmitted via personal email accounts and not from a county -provided email account. The state constitution, state and federal laws, and Whatcom County Code 2.104, Code of Ethics, strictly prohibit certain activities and 5 certain use of county resources. The following are examples of inappropriate or prohibited uses of the county's email system: a. Any use for the purpose of conducting an outside business or private employment; b. Any use for the purpose of supporting, promoting the interests of, or soliciting for an outside organization or group, including, but not limited to a private business, a non-profit organization, or a political party; C. Any use for the purpose of assisting a campaign for election of a candidate to an office, or for the promotion of, or opposition to, a ballot proposition; d. Any use related to conduct that is prohibited by federal or state law or rule, or a county policy; e. Gambling; f. Any transmission of confidential information to unauthorized persons or organizations. 13. Email should be used cautiously when seeking legal advice or to discuss matters of pending litigation or other "confidential" county business. In general, email is discoverable in litigation. 14 All county -assigned email accounts and access information shall be the property of Whatcom County. The Comprehensive Plan update and UGA review is being conducted in close coordination with the seven cities in Whatcom County. The County Council will review the Comprehensive Plan, including UGA proposals, over a six month period between January and June 2016. This review will include staff briefings, review of Planning Commission recommendations, city presentations, public hearings, and consideration of public input. It is anticipated that the Council will adopt an ordinance relating to the Comprehensive Plan update and UGA review by the June 30, 2016 state deadline. EXHIBIT "A" Amendment #1 (SCOPE OF WORK) OPERATION OF THE DISPOSAL OF TOXICS FACILITY Contractor shall operate the Disposal of Toxics facility ('the facility") for the collection, storage, and disposal of moderate risk waste which includes household hazardous waste and small quantity generator (SQG) waste as well as universal waste.. The waste will be collected, sorted, and packed for proper reuse, recycling, or disposal. Contractor will be responsible for disposal. The facility will be operated on a scheduled basis and be also available to service commercial SQGs of moderate risk waste on a user fee basis. Contractor will be responsible for setting up a billing system to collect user fees from commercial SQGs. It is understood that there will be no cash transactions between facility employees and SQG customers. Operation will be in accordance with approved plan of operation by the Whatcom County Health Department. Reusable items including oil, oil -based paint, latex paint, and other household materials will be made available to the public for reuse. Contractor will be responsible for all disposal costs. Contractor will be responsible for all equipment used to operate the facility, including computer and phone systems, a forklift and truck, other necessary equipment and all utilities including phone, cable/internet services associated with the site. The Contractor will also be responsible for cleaning and waxing office floor, restroom and hazardous waste portion of facility, and all necessary supplies. Contractor will also provide all necessary, miscellaneous, disposable items such as office materials and safety equipment and supplies. Contractor will also be responsible for all required annual maintenance applications such as fire -suppression system certification, back - flow prevention service check and maintenance and commercial scale certification. All existing County property, including phone system and paint can crusher remains the responsibility of Whatcom County. Whatcom County will be responsible for property taxes and major repairs of County - owned equipment such as the paint -can crusher, as well as landscaping, keeping gutters debris free and other routine maintenance of the grounds. Whatcom County will also be responsible for upgrades to the facility structure including those required by WAC 173-350-360. Contractor shall be responsible for maintenance, service, transportation and disposal of used oil and antifreeze from these three satellite locations: 1. Cedarville Transfer Station 2. Birch Bay Transfer Station 3. Nooksack Valley Disposal Contractor will also be responsible for receiving used oil from the Pt. Roberts Transfer Station to the Disposal of Toxics Facility. Transportation will be provided by a third party hauler. Contractor will be responsible for recycling or disposal of used oil. At the discretion of the County, Contractor shall hold up to two off -site collection events at various locations throughout Whatcom County. This grant flows from DHS through the Washington State Military Department — Emergency Management Division and Snohomish County to Whatcom County (Whatcom County Contract # 201411010). DSH provides SHSP funds for projects supporting efforts to build, sustain, and deliver core capabilities across the Prevention, Protection, Mitigation, Response, and Recovery mission areas to achieve the National Preparedness Goal of a secure and resilient Nation. Description of request: The US Dept of Homeland Security (DHS) FFY2014 State Homeland Security Program (SHSP-2014) grant awarded $79,998 to Whatcom County Sheriffs Ofice Division of Emergency Management (WCSO- DEM) to support the building, sustainment, and delivery of core capabilities across the Prevention, Protection, Mitigation, Response, and Recovery mission areas that are essential to achieving the National Preparedness Goal of a secure and resilient Nation (Whatcom County Contract #201411010). This is the 12th year that Whatcom County has received an SHSP grant. $41,437 was expended in 2015. WCSO- DEM is requesting budget authority to expend the remaining $38,561 in 2016. 1 b. Primary customers: Local emergency management, partner agencies, and the residents of Whatcom County. 2. Problem to be solved: Whatcom County is at risk from a number of natural and man-made hazards, including floods, wildfires, earthquakes, tsunamis, volcanoes, severe weather, hazardous materials, and terrorist activities. Catastrophic events that are not prevented, prepared for, or responded to quickly and effectively have the potential to inflict great harm on the people, property, economy, and environment of Whatcom County. 3a. This grant was applied for and authorized by the County Council in May of 2015, and the contract has been executed. The grant is a CDBG General Purposes grant from the Washington State Department of Commerce. Whatcom County has been designated by the Dept. of Commerce as the grantee for the purpose of contracting with Opportunity Council as a subrecipient for this grant award of $750,000.00. This grant will partially fund the estimated $1.5-million project. The project involves construction of a community facility for a food bank aggregation/distribution center with space for youth recreation activities and other community events. This grant supports the East Whatcom Regional Resource Center (EWRRC) expansion project which will result in a new food bank distribution center as well as other multi -use programming space. 1b. Primary customers: Low and moderate income residents in east Whatcom County 2. Problem to be solved: This state grant source is required to pass through the local jurisdiction. Following the Council's approval of the grant application in Spring 2015, the grant contract was awarded. We are now entering into a Subrecipient Agreement with Opportunity Council , who will complete the project scope of work and fulfill the grant contract requirements. 3a. Options /Advantages: N/A 3b.
