Call To Order
Roll Call
Council Vice Chair Todd Donovan called the meeting to order at 1 p.m. in the
Council Conference Room, 311 Grand Avenue, Bellingham, Washington.
Present: 5 - Barbara Brenner, Barry Buchanan, Tyler Byrd, Council Vice Chair Todd
Donovan and Carol Frazey
Absent: 2 - Rud Browne and Satpal Sidhu
Committee Discussion
1. AB2019-470 Discussion with Chief Civil Deputy Prosecutor Karen Frakes regarding potential
litigation related to RCW 42.56.070(8), the "commercial purposes prohibition" in the
Public Records Act

Attorneys present: Karen Frakes and George Roche
Donovan stated that discussion of agenda item one may take place in executive
session pursuant to RCW42.30.140(4)(a). Executive session will conclude no later
than 1:30 p.m. If the meeting extends beyond the stated conclusion time, he will step
out of the meeting to make a public announcement.
Buchanan moved to go into executive session until no later than 1:30 p.m. to discuss
the agenda items pursuant to RCW citations as announced by the Council Chair. The
motion was seconded
The motion carried by the following vote:
Aye: 5- Brenner, Buchanan, Byrd, Donovan and Frazey
Nay: 0
At 1:30 p.m., Donovan announced that the executive session would extend to no later
than 1:35 p.m.
This agenda item was DISCUSSED in Executive Session.
The meeting adjourned at 1:35 p.m.
The County Council approved these minutes on September 24, 2019.
