AB2019-021 ORDINANCE GRANTING DEER CREEK WATER ASSOCIATION A 23 FRANCHISE AND THE RIGHT, PRIVILEGE, AND AUTHORITY THEREUNDER TO 24 LOCATE, SET, ERECT, LAY, CONSTRUCT, EXTEND, SUPPORT, ATTACH, 25 CONNECT, MAINTAIN, REPAIR, REPLACE, ENLARGE, OPERATE AND USE 26 FACILITIES IN, UPON, OVER, UNDER, ALONG, ACROSS AND THROUGH THE 27 FRANCHISE AREA TO ALLOW FOR THE PROVISION OF WATER SERVICES 28 29 Byrd moved to recommend adoption to the full Council. 30 31 The motion was seconded. 32 33 Karen Frakes, Prosecutor's Office, answered questions on the length of the franchise 34 agreement. 35 36 Councilmembers discussed the Council's authority to address disputes and service 37 requirements through a franchise agreement, the need to update the coordinated water 38 system plan (CWSP), and whether water associations are owned by their members. 39 40 The motion carried by the following vote: 41 Ayes: Browne, Buchanan, Byrd, Donovan, Frazey, and Sidhu (6) 42 Nays: Brenner (1) 43 44 2. AB2019-167 ORDINANCE GRANTING GLENHAVEN LAKES CLUB INC. A 45 FRANCHISE AND THE RIGHT, PRIVILEGE, AND AUTHORITY THEREUNDER TO 46 LOCATE, SET, ERECT, LAY, CONSTRUCT, EXTEND, SUPPORT, ATTACH, 47 CONNECT, MAINTAIN, REPAIR, REPLACE, ENLARGE, OPERATE AND USE 48 FACILITIES IN, UPON, OVER, UNDER, ALONG, ACROSS AND THROUGH THE 49 FRANCHISE AREA TO ALLOW FOR THE PROVISION OF WATER SERVICES 50 51 Byrd moved to recommend adoption to the full Council. 52 53 The motion was seconded. AB2019-285 ORDINANCE AMENDING WHATCOM COUNTY CODE TITLE 3, 8 REQUIRING THAT PUBLIC FUNDS USED FOR CONSTRUCTION PROJECTS DO 9 DOUBLE DUTY BY ALSO PROVIDING APPRENTICES WITH JOB TRAINING 10 HOURS TO MEET THE REQUIREMENTS NECESSARY TO BECOME THE NEXT 11 GENERATION OF SKILLED TRADES PERSONS 12 13 This item was withdrawn from the agenda. 14 15 16 COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL 17 18 1. AB2019-358 RESOLUTION FORWARDING CASCADIA LAW GROUP'S 19 RECOMMENDATIONS FOR CHERRY POINT UGA COMPREHENSIVE PLAN AND 20 ZONING CODE AMENDMENTS 21 22 Byrd moved to forward to the Planning and Development Services Department for 23 review with legal staff. 24 25 The motion was seconded. 26 27 Mark Personius, Planning and Development Services Department Director, answered 28 questions. 29 30 Councilmembers and staff discussed who is working with Cascadia Law Group, the 31 timeline for review, getting clarity on the proposals, review of the Comprehensive Plan 32 changes, and State Environmental Policy Act (SEPA) review. 33 34 The motion carried by the following vote: 35 Ayes: Brenner, Browne, Buchanan, Byrd, Donovan, Frazey, and Sidhu (7) 36 Nays: None (0) 37 38 Councilmembers and staff discussed the need to define "expansion" that would be 39 allowed. 40 41 Donovan moved for councilmembers to send questions to legal counsel and Mark 42 Personius by Friday. 43 44 The motion was seconded. 45 46 The motion carried by the following vote: 47 Ayes: Browne, Buchanan, Byrd, Donovan, Frazey, and Sidhu (6) 48 Nays: Brenner (1) 49 50 51 OTHER BUSINESS 52 53 There was no other business.
