ROLL CALL Present: Barbara Brenner, Barry Buchanan, and Carol Frazey Absent: None Also Present: Rud Browne, Todd Donovan, and Satpal Sidhu SPECIAL PRESENTATION 1. AB2019-324 QUARTERLY REPORT FROM WHATCOM COUNTY PUBLIC WORKS Jon Hutchings, Public Works Department Director, introduced new staff in the department. He submitted information (on file), reported, and answered questions on the summer road construction program, road closure barriers, information available to the public on the department website, the Birch Bay Drive & Pedestrian Facility Project, and website information on each project's funding source. Kraig Olason, Public Works Department, answered questions. 2. AB2019-323 PUBLIC WORKS STAFF TO PRESENT A BRIEF PRESENTATION ABOUT THE EAST SMITH ROAD AND HANNEGAN ROAD INTERSECTION IMPROVEMENTS Jim Karcher, Public Works Department, submitted handouts (on file) and reported on an upcoming project at the E. Smith Road and Hannegan Road intersection. He described two alignment options for the project and answered questions on engaging property owners in the area, when they will decide on an option, plans for detours during construction, and minimum diameter requirements for a roundabout. COMMITTEE DISCUSSION 1. AB2019-021 ORDINANCE GRANTING DEER CREEK WATER ASSOCIATION A FRANCHISE AND THE RIGHT, PRIVILEGE, AND AUTHORITY THEREUNDER TO LOCATE, SET, ERECT, LAY, CONSTRUCT, EXTEND, SUPPORT, ATTACH, CONNECT, MAINTAIN, REPAIR, REPLACE, ENLARGE, OPERATE AND USE FACILITIES IN, UPON, OVER, UNDER, ALONG, ACROSS AND THROUGH THE FRANCHISE AREA TO ALLOW FOR THE PROVISION OF WATER SERVICES Brenner stated all franchise agreements with water associations should include a current water system plan that lists policies and is kept updated, documents must be Public Works and Health Committee, 6/4/2019, Page 1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 subject to release of information, notification and public hearings for land owners if expanding into a new area, and an appeal process through the County Council. Councilmembers discussed whether there is a deadline for adopting the ordinances and the possibility of adding the four conditions to the agreements. Brenner moved to hold this item and the next item in committee for two weeks and to schedule in executive session. Councilmembers discussed holding an executive session. The motion carried by the following vote: Ayes: Brenner, Buchanan, and Frazey (3) Nays: Buchanan (0) 2. AB2019-167 ORDINANCE GRANTING GLENHAVEN LAKES CLUB INC. A FRANCHISE AND THE RIGHT, PRIVILEGE, AND AUTHORITY THEREUNDER TO LOCATE, SET, ERECT, LAY, CONSTRUCT, EXTEND, SUPPORT, ATTACH, CONNECT, MAINTAIN, REPAIR, REPLACE, ENLARGE, OPERATE AND USE FACILITIES IN, UPON, OVER, UNDER, ALONG, ACROSS AND THROUGH THE FRANCHISE AREA TO ALLOW FOR THE PROVISION OF WATER SERVICES This item was held in committee.
