CALL TO ORDER
Committee Chair Barbara Brenner called the meeting to order at 1:30 p.m. in the
Council Chambers, 311 Grand Avenue, Bellingham, Washington.

Present: Barbara Brenner, Barry Buchanan, and Carol Frazey
Absent: None
Also Present: Tyler Byrd, Todd Donovan, and Satpal Sidhu
COMMITTEE DISCUSSION
2. AB2019-283 DISCUSSION REGARDING THE BELLINGHAM SCOTTISH
GATHERING
The following people answered questions:
• Mike McFarlane, Parks and Recreation Department Director
• Heather Richendrfer, Bellingham Scottish Gathering
• Jack Louws, County Executive
Councilmembers, staff, and the applicant discussed whether insurance requirements
regarding animal activity versus animal display were waived for a proposed event at
Hovander Homestead Park, insurance requirements, plans for fencing the animals, and
potential for grant funding to pay the insurance costs.
COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL
1. AB2019-262 RESOLUTION IN THE MATTER OF CONSIDERING
VACATION OF SAFSTEN ROAD
Andrew Hester, Public Works Department, submitted information (on file), gave a
staff report, and answered questions.
Councilmembers and staff discussed the site, historic uses, and potential cost
savings to the county from not maintaining the road.
Buchanan moved to recommend approval to the full Council.

2. AB2019-266 CONSIDERATION OF CITIZEN APPEAL OF ADDRESS
CHANGE DUE TO ROAD NAMING REQUIREMENT
Doug Ranney, Public Works Department, answered questions on code requirements
for not leaving a road unnamed.
Buchanan moved to forward to the Council with no recommendation to hear from
the appellant.
Joe Rutan, Public Works Department, answered questions about how the
administration handles road name and address questions.

COMMITTEE DISCUSSION
3. AB2019-134 DISCUSSION REGARDING AN ORDINANCE GRANTING
DEER CREEK WATER ASSOCIATION A FRANCHISE AND THE RIGHT,
PRIVILEGE, AND AUTHORITY THEREUNDER TO LOCATE, SET, ERECT, LAY,
CONSTRUCT, EXTEND, SUPPORT, ATTACH, CONNECT, MAINTAIN, REPAIR,
REPLACE, ENLARGE, OPERATE AND USE FACILITIES IN, UPON, OVER,
UNDER, ALONG, ACROSS AND THROUGH THE FRANCHISE AREA TO ALLOW
FOR THE PROVISION OF WATER SERVICES
Douglas Whittaker, Deer Creek Water Association, answered questions about the site
locations and applications, wording in the franchise agreement, who received letters of
denial, defining "timely and reasonable," whether a franchise agreement would change
permissible development inside rural areas, lawsuits against the association, getting the
language and bylaws for all the water associations with franchise agreements, whether the
County has liability issues, and the association's policies and procedures.
The following staff answered questions:

• Jon Hutchings, Public Works Department Director
Buchanan moved to hold in committee until they get a legal opinion.
