CALL TO ORDER
Committee Chair Todd Donovan called the meeting to order at 9:30 a.m. in the
Council Chambers, 311 Grand Avenue, Bellingham, Washington.

1. DISCUSSION REGARDING PREVIOUSLY ISSUED BP RAIL CAPACITY
EXPANSION PROJECT PERMIT (AB2018 -277)
Donovan referenced a list of questions he submitted to staff (on file) and asked how
the existing rail spur was approved.
Mark Personius, Planning and Development Services Department Director, referenced
his memo to the Council dated October 8, 2018, gave a staff report, and answered
questions.
Councilmembers and Personius discussed what impacts determinations of non -
significance (DNS), addressing concerns through the permit process instead of the State
Environmental Policy Act (SEPA) process, what triggers a major project permit, adding a
category that triggers a major project permit regarding transportation of potentially
hazardous substance, mitigating additional railroad traffic, how to determine whether there
will be significant impacts without doing an environmental impact statement (EIS),
referencing scientific guidelines as greenhouse gas thresholds, and the process for
scheduling items in committee.
