7 Council Vice -Chair Todd Donovan called the meeting to order at 1:15 p.m. in the
8 Council Conference Room, 311 Grand Avenue, Bellingham, Washington.

12 Present: Tim Ballew, Barbara Brenner, Barry Buchanan, Tyler Byrd, Todd
13 Donovan, and Satpal Sidhu.

18 1. DISCUSSION WITH CHIEF CIVIL DEPUTY PROSECUTOR KAREN FRAKES REGARDING
19 PENDING LITIGATION, KORTLEVER, ET AL. V. WHATCOM COUNTY JAIL (AB2018-

23 Donovan stated that discussion of agenda item one may take place in executive
24 session pursuant RCW 42.30.110(1)(i). Executive session will conclude no later than 2:15
25 p.m. If the meeting extends beyond the stated conclusion time, he will step out of the
26 meeting to make a public announcement.

28 Buchanan moved to go into executive session until no later than 2:15 p.m. to
29 discuss the agenda items pursuant to RCW citations as announced by the Council Chair.
30 The motion was seconded.

32 The motion carried by the following vote:
33 Ayes: Ballew, Brenner, Buchanan, Byrd, Donovan, and Sidhu (6)
34 Nays: None (0)
