March 13, 2018
CALL TO ORDER
Council Vice -Chair Todd Donovan called the meeting to order at 3:30 p.m. in the
Council Chambers, 311 Grand Avenue, Bellingham, Washington.
ROLL CALL
Present: Tim Ballew, Barbara Brenner, Barry Buchanan, Tyler Byrd, and Todd
Donovan.
Absent: Rud Browne and Satpal Sidhu.
COMMITTEE DISCUSSION
I. DISCUSSION REGARDING RECOMMENDATIONS OUTLINED IN CASCADIA
LAW GROUP'S REPORT ENTITLED REDUCING IMPACTS FROM FOSSIL FUEL
PROJECTS (FULL REPORT, WITH APPENDICES, CAN BE FOUND AT

Donovan stated the outstanding question is whether it is within the scope of the
contract to retain attorney Rodney Brown to write an ordinance.
Jack Louws, County Executive, stated the scope of work indicates the Cascadia Law
Group would prepare ordinance changes as directed by Council. There should be adequate
money left in the contract amount to complete the scope of work, and they may need to
extend the contract another 60 -days. Council should specifically instruct what items in the
Code it would like changed.
Buchanan moved to request the Executive to extend the contract for 60 days.
The motion was seconded.
Louws stated a motion is not necessary, and he commits to sign a 60 -day extension.
The motion was withdrawn.
Donovan stated the full Council needs to communicate to Mr. Brown about what they
want in an ordinance. Hold in Committee of the Whole for two weeks. They will check with
legal counsel about how best to communicate with Mr. Brown.
Karen Frakes, Prosecutor's Office, answered questions on how to continue to work
with Cascadia Law Group to draft an ordinance that amends the Code.
