RESOLUTION APPROVING THE WHATCOM COUNTY SIX -YEAR TRANSPORTATION IMPROVEMENT PROGRAM FOR THE YEARS 2018 THROUGH 2023 (AB2017 -261) Joe Rutan, Public Works Department, gave a staff report and answered questions about the Slater Road intersection improvement project and speed limits in the Lake Whatcom watershed. Buchanan opened the public hearing, and the following person spoke: Larry Williams spoke about bicyclists on Marine Drive and improvements that don't address the lack of space for both cars and bicycles. Hearing no one else, Buchanan closed the public hearing. Browne moved to approve the resolution and program, except item R3. The motion was seconded. The motion carried by the following vote: Ayes: Brenner, Mann, Sidhu, Browne, Buchanan, Weimer and Donovan (7) Nays: None (0) Browne moved to approve item R3 of the program. The motion was seconded. ORDINANCE IMPOSING AN INTERIM MORATORIUM ON THE ACCEPTANCE AND PROCESSING OF APPLICATIONS AND PERMITS FOR NEW OR EXPANDED FACILITIES IN THE CHERRY POINT URBAN GROWTH AREA, THE PRIMARY PURPOSE OF WHICH WOULD BE THE SHIPMENT OF UNREFINED FOSSIL FUELS NOT TO BE PROCESSED AT CHERRY POINT (AB2016 -256C) Buchanan opened the public hearing, and the following people spoke: Warren Sheay stated he supports adopting the ordinance to protect citizens from dangerous conditions. Dena Jensen stated she supports adopting the ordinance to protect the community from threats to public safety, health, environment, transportation, and the economy. Sandy Robson stated she supports the ordinance to provide land use planning policy guidelines and protect the marine environment and cultural treaty rights. Wendy Harris stated she supports the ordinance to protect the safety of residents and the environment. Regular County Council Meeting, 9/26/2017, Page 3 1 Max Perry stated they must consider the taxes that the Cherry Point industries pay 2 to Whatcom County. 3 4 Carole Perry stated the Council should make sure public hearings are more balanced. 5 6 Robert Earl submitted a handout (on file) and stated he supports an ordinance to 7 protect refining jobs at Cherry Point. 8 9 Wendy Bartlett stated she supports the ordinance to protect air and water quality 10 and future generations. 11 12 Mike Sennett stated he supports the ordinance, which will not hurt the financial 13 outlook of the refineries, to complete the study. 14 15 Jessica Spiegel, Western States Petroleum Association, submitted and read from a 16 handout (on file) and stated she does not support the ordinance, which will limit commerce 17 of certain commodities and prevent business planning. 18 19 John Campbell stated he supports the ordinance because it will protect the jobs. 20 21 Anna Miller stated she supports the ordinance to protect people, natural resources, 22 and current jobs at Cherry Point. 23 24 Steve Gary stated he supports the preservation of refinery jobs and not giving 25 industry a reason to prematurely leave the community. 26 27 Jessica Zimmerle, Earth Ministry Program Outreach, stated she supports the 28 ordinance to protect the environment for future generations. 29 30 Alyssa Barton, Puget Sound Keeper Alliance, stated she supports the ordinance to 31 protect the community from threats of expanding fossil fuel infrastructure at Cherry Point. 32 33 Alex Ramel stated he supports the ordinance to protect against hazardous conditions 34 from facilities and to protect the environment and refinery jobs. 35 36 John Anderson, Phillips 66 Refiner, stated he does not support the ordinance, which 37 raises constitutional questions about restricting business. 38 39 Carl Garrison stated he does not support the ordinance because it is bad for 40 business, jobs, and the cost of gas. 41 42 Joe Murphy, Phillips 66 Refinery, stated he is opposed to the ordinance due to the 43 impacts on business competitiveness, the existing laws and regulations they must follow, 44 and the negative impact on refinery jobs. 45 46 Brian Walkenhauer stated he is opposed to the ordinance due to the impact on 47 business and the legal ramification to county residents. 48 49 Eddy Ury stated he supports the ordinance to protect public health, safety, the 50 economy, and the environment and suggested an amendment. 51 Regular County Council Meeting, 9/26/2017, Page 4 1 Joe Wilson, Peterson Brothers Vice - President, stated he is opposed to the ordinance 2 due to existing environmental controls and to the taxes and wages they pay in the 3 community. 4 5 Jack McBride submitted and read from a handout (on fi /e) and stated he supports the 6 ordinance. 7 8 Ronna Loerch stated she supports the ordinance to give time to complete the study 9 and to protect the environment. 10 11 Abe Jacobson stated he supports the ordinance to complete the study and create 12 adequate information to make decisions. 13 14 Carole Jacobson stated she supports the ordinance. The people are for the 15 ordinance, and BP is contributing to Council candidate campaigns. 16 17 Tony Larson, Whatcom Business Alliance, stated he is opposed to the ordinance to 18 support business and protect Cherry Point jobs. 19 20 Kent Murray stated he is opposed to the ordinance to protect Cherry Point jobs and 21 allow industry to grow. 22 23 Dirk Vermeeren stated he supports the ordinance to protect from long -term negative 24 impacts on the community due to potential for hazardous incidents. 25 26 Gwen Hunter stated she supports the ordinance to protect workers from a dying 27 industry and the threat to the fishing industry. 28 29 Paula Rotondi stated she supports the ordinance to protect public health, safety, and 30 Cherry Point jobs. 31 32 Ronald Coleson stated he supports the ordinance to protect the environment, 33 34 Yoshe Revelle stated he supports the ordinance to protect the environment and fight 35 climate change. 36 37 John Holstein stated he supports the ordinance to protect the environment and fight 38 climate change. 39 40 David Kershner stated he supports the ordinance to study the legal options and 41 amend development regulations to keep oil industry jobs in the county. 42 43 Charles Bailey stated he supports the ordinance to protect public health and safety, 44 to protect future generations, and to complete the study. 45 46 Amy Glasser stated she supports the ordinance to protect the rights of the Lummi 47 Nation. 48 49 RB McKeon, BP Cherry Point Refinery, stated she does not support the ordinance 50 because it inhibits the company from responding to changing business direction. 51 52 Chris Colon stated he does not support the ordinance to protect jobs that provide 53 living wages. The industry would like to work with the Council to find solutions Regular County Council Meeting, 9/26/2017, Page 5 1 2 Bobby Burr stated he supports the ordinance to protect the environment. 3 4 TJ Lee, Phillips 66 Refinery, stated he is opposed to the ordinance due to concerns 5 about protecting the long -term future of the business and investments in cleaner fuels and 6 efficiency. 7 8 Josh Summers, Phillis 66 Refinery, stated he is opposed to the ordinance due to 9 constitutional concerns and the need to preserve jobs. 10 11 Maggie Rose stated she supports the ordinance to find alternative energy sources 12 and end pollution. 13 14 Patrick Alesse stated industries must pay for their contribution to global warming. 15 16 Dana Briggs stated he supports the ordinance to protect from potential hazardous 17 incidents and protect the environment. 18 19 Bill Lafreniere stated he is opposed to the ordinance due to the potential for lost 20 industries and jobs. 21 22 Larry Williams stated he supports the ordinance to protect the environment from 23 global warming. 24 25 Jeff Ten Pas, BAI Environmental Services Vice - President and Partner, stated he is 26 opposed to the ordinance because it doesn't protect businesses at Cherry Point and the local 27 economy. 28 29 Everett Barton spoke about homeless housing issues in the county. 30 31 Cathy McDevitt stated she supports the ordinance due to concerns with 32 transportation issues. 33 34 Natalie Chavez stated she supports the ordinance to protect the environment and 35 native culture. 36 37 Hamilton Dutcher stated he supports the ordinance to move toward better energy 38 sources. 39 40 Hearing no one else, Buchanan closed the public hearing. 41 42 Browne moved to adopt the ordinance. 43 44 The motion was seconded. 45 46 Councilmembers spoke about problems with acidification from Asia, existing 47 environmental protection for the local refineries, successfully transitioning away from fossil 48 fuel energy, lesser environmental rules at refineries in Asia, preparing to address impacts 49 from potential industrial expansion and major project permits, working collaboratively with 50 industry representatives, the intent to not shut down the refineries, historic prohibition on 51 exporting crude oil, business future planning for the next 20 years, demand for petroleum 52 and gas in Asia, concerns about identifying butane and propane as unrefined fuels, potential Regular County Council Meeting, 9/26/2017, Page 6 1 job loss from converting refineries to export terminals, the public cost that could result from 2 a disastrous event, and taking time necessary to develop better code regulations. 3 4 The motion carried by the following vote: 5 Ayes: Mann, Sidhu, Browne, Buchanan, Weimer and Donovan (6) 6 Nays: Brenner (1) 7 8 (Clerk's Note: The Council took a 15- minute break at 9:44 p.m.) 9 10 11 OPEN SESSION 12 13 The following people spoke: 14 • Bill Lafreniere submitted and read from a handout (on file) and spoke about 15 funding for a proposed new County jail. 16 • Bob Burr spoke about contingency planning in case the jail sales and use tax 17 ballot measure fails. 18 • Lynn Murphy, Puget Sound Energy, spoke about the company's transition 19 away from coal and a Utilities Technology Council (UTC) settlement with 20 conditions. 21 • Kathy McDevitt spoke about problems with vacation rental units. 22 • Carole Perry spoke about protecting future generations by addressing 23 problems now. 24 • Eddy Ury spoke about the interim moratorium ordinance (AB2016 -256C) 25 26 27 CONSENT AGENDA 28 29 Browne reported for the Finance and Administrative Services Committee and 30 moved to approve Consent Agenda items one and two. 31 32 The motion carried by the following vote: 33 Ayes: Brenner, Mann, Sidhu, Browne, Buchanan, Weimer and Donovan (7) 34 Nays: None (0) 35 36 1.
