ROLL CALL Present: Barbara Brenner, Todd Donovan, and Ken Mann Absent: None Also Present: Barry Buchanan, Rud Browne, Satpal Sidhu, and Carl Weimer SPECIAL PRESENTATIONS 1. PUBLIC WORKS DIRECTOR HUTCHINGS' REPORT TO COUNCIL ON PUBLIC WORKS ACTIVITIES (AB2017 -068) Dr. Jon Hutchings, Public Works Department Director, submitted handouts (on file). He reported and answered questions on snow and ice response and removal, the possibility of using private snow plow operators during snow events, educating the public on the snowplow priority map, and an estimate of road damage. 2. PROJECT UPDATE ON THE DESIGN AND CONSTRUCTION OF THE BIRCH BAY DRIVE AND PEDESTRIAN FACILITY (AB2017 -079) Jim Karcher, Public Works Department, submitted and read from a presentation (on file). He answered questions about the total estimated cost and the number of tribes being consulted. COMMITTEE DISCUSSION 1. DISCUSSION OF PROPOSED ORDINANCE AMENDING WHATCOM COUNTY CODE 24.05, ON -SITE SEWAGE SYSTEM REGULATIONS (FROM 1/24 AND 2/7) (AB2017 -053) Brenner submitted a substitute for Chapter section 24.05.160. John Wolpers, Health Department, stated staff approves of the substitute. He answered questions on the financial burden of annual inspections and whether there can be financial assistance for people who qualify, whether the Health Department can contract with inspectors in a program with various cost tiers, how to collect information on property transfers, whether these amendments will satisfy the Growth Management Hearings Board and litigants, updated information on failure rates, and whether Form 17 is adequate for indicating that a system has been inspected. Mike Kim, Health Department, answered questions on collecting information when properties transfer. PRESENTATION AND DISCUSSION REGARDING TRAFFIC PATTERNS AND POSTED SPEED LIMITS IN THE MARINE DRIVE /MARIETTA AREA (FROM 2/7) (AB2017 -062) This item is withdrawn from the agenda. COMMITTEE DISCUSSION AND RECOMMENDATIONS TO COUNCIL 1. RESOLUTION AUTHORIZING THE USE OF PARKS PROPERTY FOR ROAD PURPOSES (AB2017 -080) Mike McFarlane, Parks Department Director, gave a staff report and answered questions on the current use of the property. Brenner moved to recommend approval to the full Council. The motion carried by the following vote: Ayes: Brenner, Donovan, and Mann (3) Nays: None (0) 2. DISCUSSION AND RECOMMENDATIONS FOR APPROVAL OF FUNDING PRIORITIES FOR THE CRIMINAL JUSTICE TREATMENT ACCOUNT ESTABLISHED UNDER RCW 71.24.580 (AB2017 -082) Jackie Mitchell, Health Department, gave a staff report. Donovan moved to recommend approval to the full Council. The motion carried by the following vote: Ayes: Brenner, Donovan, and Mann (3) Nays: None (0) 3. RESOLUTION ESTABLISHING A NEW LEVEL OF SERVICE FOR THE LUMMI ISLAND FERRY SYSTEM (AB2017 -081) Nancy Ging, Lummi Island Ferry Advisory Committee, gave a report on creating a level of service for the ferry. She answered questions on whether the County is currently meeting safety standards. Jon Hutchings, Public Works Department Director, answered questions on whether a used ferry can be converted to an electric ferry and staff's support of the resolution. Jack Louws, County Executive, answered questions on the possibility of partnering with Skagit County to get a discount on the purchase of two ferries and the County's plans for purchasing a new ferry in the future. Roland Middleton, Public Works Department, answered questions about comparing all the design and funding options through an alternatives analysis, moving from the leased lands at the end of the lease in 2046, how the current level of service is measured, and the goals of the Lummi Island community for the ferry's level of service. The motion carried by the following vote: Ayes: Brenner and Donovan (2) Nays: Mann (1) Brenner moved to reconsider the previous vote. The motion to reconsider carried by the following vote: Ayes: Brenner, Donovan, and Mann (3) Nays: None (0) Mann moved to hold in committee The motion to hold in committee carried by the following vote: Ayes: Brenner, Donovan, and Mann (3) Nays: None (0) Councilmembers discussed concerns about identifying wait times and other issues. Donovan moved to recommend approval to the full Council. The motion carried by the following vote: Ayes: Brenner and Donovan (2) Nays: Mann (1) OTHER BUSINESS There was no other business.
