ROLL CALL Present: Rud Browne, Ken Mann, and Satpal Sidhu Absent: None Also Present: Todd Donovan, Carl Weimer, Barry Buchanan and Barbara Brenner SPECIAL ORDER OF BUSINESS 1. NOMINATION AND APPOINTMENT OF COMMITTEE CHAIR (AB2017 -021) Mann moved to appoint Browne. The nomination was seconded. The motion carried by the following vote: Ayes: Browne, Mann, and Sidhu (3) Nays: None (0) COUNTY EXECUTIVE'S REPORT Louws reported on the following items: • Public Works Department award from the American Council of Engineering for the Potter Road bridge • Kendall Trail and funding related action items • Emergency medical services (EMS) budget supplemental requests for new staff • Washington State Association of Counties (WSAC) Legislative Steering Committee meeting last week and • Funding needs from the State legislature for Jordan Creek and for Swift Creek environmental cleanup COMMITTEE DISCUSSION I. DISCUSSION REGARDING AMENDMENTS TO CONTRACT #201205028 (CH2M HILL) AND CONTRACT #201205029 (PACIFIC INTERNATIONAL INC. AND BNSF) (AB2017 -054) Tyler Schroeder, Executive's Office, referenced the additional information submitted on January 19 and gave a staff report on the contracts. He answered questions on whether all parties have accepted the correct version of the contract, the County's ownership of the documents created from the contract, and who is responsible for paying CH2MHill. PUBLIC WORKS TO REPORT ON THE FEDERAL RAILROAD 2 ADMINISTRATION'S RESPONSE TO A PROPOSED QUIET ZONE DESIGN FOR 3 THE YACHT CLUB ROAD AT GRADE RAILROAD CROSSING (AB2017 -043) 4 5 Joe Rutan, Public Works Department, gave a staff report. If the County were to pay 6 for the project, the total cost would be an estimated $42,147. 7 8 Mann moved to authorize the Public Works Department to amend the budget to get 9 spending authority, approve county forces to do the work since it's not in the annual 10 program, and to grant legislative authority to proceed with the petition to the Utility and 11 Transportation Commission (UTC). 12 13 Rutan answered questions on liability for accidents staying with the railroad, not the 14 County. 15 16 The councilmembers discussed whether or not the County should pay the cost of the 17 construction and prioritizing all the crossings in the County's jurisdiction. 18 19 Kathy Bovenkamp, Chuckanut Bay Community Association, thanked the 20 councilmembers and Public Works Department staff for their help on this project. ORDINANCE AMENDING THE 2017 WHATCOM COUNTY BUDGET, FIRST 31 REQUEST, IN THE AMOUNT OF $170,302 (AB2017 -039) 32 33 Mann moved to recommend adoption to the full Council. 34 35 Patty Proctor, Health Department, answered a question about the history of the 36 Whatcom Community Foundation research project. 37 38 The motion carried by the following vote: 39 Ayes: Browne, Mann, and Sidhu (3) 40 Nays: None (0) 41 42 2. ORDINANCE AMENDING ORDINANCE 2015 -037, WHICH AMENDED 43 ORDINANCE 2015 -025 (ESTABLISHMENT OF THE WHATCOM COUNTY 44 INCARCERATION PREVENTION AND REDUCTION TASK FORCE) TO EXTEND 45 DUE DATES FOR DELIVERY OF THE INITIAL AND FINAL PHASE III REPORTS 46 (AB2017 -040) 47 48 Mann moved to recommend adoption to the full Council and gave a staff report. 49 50 The motion carried by the following vote: 51 Ayes: Browne, Mann, and Sidhu (3) 52 Nays: None (0) 53 Finance and Administrative Services Committee, 1/24/2017, Page 2 3. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT BETWEEN WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT AND APPLIED GEOMORPHOLOGY FOR THE PREPARATION OF A DETAILED GEOMORPHIC ASSESSMENT OF THE LOWER NOOKSACK RIVER IN SUPPORT OF AN UPDATE TO THE COMPREHENSIVE FLOOD HAZARD MANAGEMENT PLAN, IN THE AMOUNT OF $150,000 (COUNCIL ACTING AS THE WHATCOM COUNTY FLOOD CONTROL ZONE DISTRICT BOARD OF SUPERVISORS) (AB2017 -044) Mann moved to recommend adoption to the full Council. Paula Harris, Public Works Department, answered questions on the contractor selection process. The motion carried by the following vote: Ayes: Browne, Mann, and Sidhu (3) Nays: None (0) COUNCIL "CONSENT AGENDA" ITEMS 1. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO AN INTERLOCAL AGREEMENT BETWEEN WHATCOM COUNTY AND THE WHATCOM CONSERVATION DISTRICT FOR NON -DAIRY AGRICULTURE TECHNICAL ASSISTANCE, IN THE AMOUNT OF $100,000 (AB2017 -045) Sidhu moved to recommend approval to the full Council. Erika Douglas, Public Works Department, answered questions on why the program is only for non -dairy agriculture and if it will cover septic systems possibly failing and in need of repair. The motion carried by the following vote: Ayes: Mann, and Sidhu (2) Nays: None (0) Abstains: Browne (1) 2. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT AMENDMENT BETWEEN WHATCOM COUNTY AND NORTHWEST REGIONAL COUNCIL TO PROVIDE NURSING SERVICES TO OFFENDERS AT THE DOWNTOWN JAIL, THE WORK CENTER AND JUVENILE DETENTION, IN THE AMOUNT OF $33,045, FOR A TOTAL AMENDED AMOUNT OF $1,247,947 (AB2017 -046) Mann moved to recommend approval to the full Council. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT AMENDMENT BETWEEN WHATCOM COUNTY AND DESIGN2LAST, INC. TO PROVIDE BUILDING ASSESSMENT STUDIES AND COST ESTIMATES Finance and Administrative Services Committee, 1/24/2017, Page 3 1 FOR CAPITAL IMPROVEMENTS AT THE JAIL AND WORK CENTER, IN THE 2 AMOUNT OF $218,404.26, FOR A TOTAL AMENDED AMOUNT OF $370,287.20 3 (AB2017 -047) 4 5 Sidhu moved to recommend approval to the full Council. 6 7 Jack Louws, County Executive, gave a staff report on the Council's request to take 8 another look at the facility. This contract anticipates the jail will be open until the end of 9 2022. Staff chose the most critical repairs necessary until a new jail is opened. He 10 answered questions about the timing of doing all repairs in certain areas of the jail at one 11 time, spending money on the current jail versus the new jail, critical needs for mental 12 health areas, making a decision on a ballot measure soon, and the cost of relocating 13 inmates during construction. 14 15 The following staff answered questions: 16 • Garrett Maupin, Administrative Services Department 17 . Bill Elfo, County Sheriff 18 19 Staff answered questions on what this contract will pay for, the need for more 20 assessment to define each project and create a schematic design, and identifying hidden 21 costs. 22 23 The motion carried by the following vote: 24 Ayes: Browne, Mann, and Sidhu (3) 25 Nays: None (0) 26 27 Bill Elfo, Sheriff, described the dire need for these repairs. 28 29 Louws gave an update on the Jail Stakeholder Workgroup work for a new jail bond 30 measure. Also, the administration needs Council leadership on determining the size of the 31 new jail. It's time to begin discussing it. 32 33 4. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A 34 CONTRACT AMENDMENT BETWEEN WHATCOM COUNTY AND WASHINGTON 35 STATE UNIVERSITY TO CONTINUE THE SHARE AGENT COSTS FOR THE WSU 36 WHATCOM COUNTY EXTENSION FOR 2017, IN THE AMOUNT OF $161,437, 37 FOR A TOTAL AMENDED AMOUNT OF $1,570,535.90 (AB2017 -048) 38 39 Mann moved to recommend approval to the full Council. 40 41 The motion carried by the following vote: 42 Ayes: Browne, Mann, and Sidhu (3) 43 Nays: None (0) 44 45 S. REQUEST APPROVAL FOR THE COUNTY EXECUTIVE TO AWARD BID #16 -53 46 AND AUTHORIZE THE EXECUTIVE TO ENTER INTO A CONTRACT WITH 47 JENSEN LEE CONSTRUCTION FOR THE HEALTH DEPARTMENT CREEKSIDE 48 OFFICES PROJECT, IN AN AMOUNT NOT TO EXCEED $54,094.55 (AB2017- 49 049) 50 51 Mann moved to recommend approval to the full Council. 52 Finance and Administrative Services Committee, 1/24/2017, Page 4 Patty Proctor, Health Department, answered questions on how they are allowed to use chemical dependency fund dollars on capital construction instead of programs.
