HomeMy WebLinkAboutPlanning September 13 20161 WHATCOM COUNTY COUNCIL 2 Planning and Development Committee 3 4 September 13, 2016 5 6 7 8 CALL TO ORDER 9 10 Committee Chair Carl Weimer called the meeting to order at 3:03 p.m. in the Council 11 Chambers, 311 Grand Avenue, Bellingham, Washington. 12 13 14 ROLL CALL 15 16 Present: Carl Weimer, Barbara Brenner, and Todd Donovan 17 Absent: None 18 Also Present: Rud Browne, Barry Buchanan, Satpal Sidhu, and Ken Mann 19 20 21 COMMITTEE DISCUSSION 22 23 1. DISCUSSION OF PROPOSED AMENDMENTS TO WHATCOM COUNTY CODE 24 TITLE 20, ZONING, AND TITLE 23, SHORELINE MANAGEMENT, REGARDING 25 VACATION RENTAL UNITS (AB2016 -270) 26 27 Gary Davis, Planning and Development Services Department, referenced and read 28 from the staff report on Council packet page 322. With Council direction, staff can prepare 29 a resolution for the Department of Ecology. He answered councilmember questions about 30 the processes for adopting these ordinances in 2017, and; whether bed and breakfast 31 establishments are allowed in the commercial zone. 32 33 Nick Smith, Planning and Development Services Department, answered questions 34 about whether larger inns should be allowed in resource lands. 35 36 Mann stated allow an exception to the requirement for a business license for folks 37 who want to rent their home as a vacation rental for only a few days a year. Davis stated 38 there may be enforcement problems. 39 40 Davis answered questions about whether there will be problems with the registration 41 process; ensuring health and safety of renters; a lack of enforcement despite the Council 42 allocating more money in the budget for enforcement, and; outreach. 43 44 Mark Personius, Planning and Development Services Department, answered 45 questions about enforcement staffing. 46 47 Browne referenced items a, b, c, f.4, and f.8 on pages 330 -331 and stated that 48 information should be on the County website. 49 50 Davis stated he would like approval to bring forward a resolution to send the Title 23 51 to the Department of Ecology and to go forward with Title 20. In the meantime, they will 52 begin outreach, developing a registration system, enhancing the online information, and 53 amendments to the unified fee schedule. Planning and Development Committee, 9/13/2016, Page 1 1 2 Weimer moved to recommend to the full Council that the staff prepare a resolution 3 to submit to the Department of Ecology. 4 5 The motion was seconded. 6 7 The motion to amend carried by the following vote: 8 Ayes: Weimer, Brenner, and Donovan (3) 9 Nays: None (0) 10 11 Sally Harper stated vacation rental units are increasing density in her neighborhood. 12 Don't encourage more tourism on Lake Whatcom. 13 14 Carole Perry stated the vacation rental industry regulates itself through customer 15 feedback websites online. They don't need more regulations. 16 17 Kelvin Barton stated he supports a registration process for both the owner and the 18 property. 19 20 Patrick Alesse stated he supports the comments of the previous two speakers. He 21 supports a registration and taxing process. 22 23 24 2. DISCUSSION OF PROPOSED ORDINANCE ADOPTING AMENDMENTS TO 25 WHATCOM COUNTY CODE TITLE 20, ZONING, RELATING TO COMMERCIAL 26 AND INDUSTRIAL LAND USES IN LIMITED AREAS OF MORE INTENSIVE 27 RURAL DEVELOPMENT (AB2016 -272) 28 29 Gary Davis, Planning and Development Services Department, referenced and read 30 from the staff report beginning on Council packet page 347. 31 32 Nick Smith, Planning and Development Services Department, answered questions on 33 the outdoor manufacture and fabrication of products. REVIEW AND CONSIDERATION OF THE DRAFT PUBLIC PARTICIPATION PLAN (AB2016 -271) Matt Aamot, Planning and Development Services Department, gave a staff report and referenced the substitute plan (on file). Brenner moved to amend to require Council public hearings for all levels 1, 2, and 3 before anything is adopted. The motion to amend carried by the following vote: Ayes: Brenner and Donovan (2) Nays: Weimer (1) Councilmembers discussed the changes in the substitute version plan. Donovan moved to recommend approval of the substitute as amended. The motion carried by the following vote: Ayes: Weimer, Brenner, and Donovan (3) Nays: None (0) OTHER BUSINESS There was no other business.
