CALL TO ORDER
Committee Chair Ken Mann called the meeting to order at 3:00 p.m. in the Council
Chambers, 311 Grand Avenue, Bellingham, Washington.
ROLL CALL
Present: Ken Mann, Barbara Brenner, and Rud Browne
Absent: None
Also Present: Pete Kremen
COMMITTEE DISCUSSION
1. DISCUSSION REGARDING A PROPOSED ORDINANCE AMENDING WHATCOM
COUNTY CODE TITLE 20 AND THE WHATCOM COUNTY COMPREHENSIVE
PLAN RELATED TO DEVELOPMENT REGULATIONS IN LIMITED AREAS OF
MORE INTENSIVE RURAL DEVELOPMENT (LAMIRDS) (AB2015 -085B)
Gary Davis, Planning and Development Services Department, described the changes.
He submitted and read from a presentation (on file).
The councilmembers discussed whether the Hearings Board talked about allowing
remote communities to access services such as groceries without having to drive far away,
the definition of an essential public facility, whether the maximum limits are about the
footprint or floor area, whether parties to the settlement approve of these changes, and
whether Futurewise can continue the lawsuit after this settlement agreement.
Kristen Reid, Belcher Swanson Law Firm, answered questions.
COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL
1. REQUEST APPROVAL OF A ONE -YEAR EXTENSION OF THE GENERAL BINDING
SITE PLAN FOR THE BIRCH BAY SQUARE (NORTH) DEVELOPMENT (AB2015-
252)
Amy Keenan, Planning and Development Services Department, gave a staff report.
Brenner moved to recommend approval to the full Council.
The motion to amend carried by the following vote:
Ayes: Mann, Brenner and Browne (3)
