ROLL CALL Present: Ken Mann, Barbra Brenner, and Rud Browne Absent: None Also Present: Satpal Sidhu COMMITTEE DISCUSSION 1. DISCUSSION REGARDING THE PROPOSED ORDINANCE AMENDING WHATCOM COUNTY CODE TITLE 20 AND THE WHATCOM COUNTY COMPREHENSIVE PLAN RELATED TO DEVELOPMENT REGULATIONS IN LIMITED AREAS OF MORE INTENSIVE RURAL DEVELOPMENT (LAMIRDS) (AB2015 -085A) Gary Davis, Planning and Development Services Department, submitted and read from a presentation (on file) and gave a staff report. He submitted a substitute for Exhibit A (on file). The councilmembers discussed whether both sides of the agreement agree that the substitute exhibit A is acceptable, whether they include any kind of use, the lack of residential size limits in unincorporated Whatcom County, whether this does not make anything more restrictive, exceptions in the size and use chart, when the Supreme Court will make a ruling, and the ability to build an adequately -sized grocery store outside the urban growth area (UGA). Karen Frakes, Prosecuting Attorney's Office, answered questions. Browne moved to recommend that the Council introduce the ordinance with the substitute Exhibit A. The motion was seconded. The motion carried by the following vote: Ayes: Mann, Brenner and Browne (3) Nays: None (0) The councilmembers discussed whether there is a law that prevents Cities from annexing areas that are not contiguous to the city limits, such as the City of Bellingham annexing Sudden Valley, for example. Planning and Development Committee, 10/27/2015, Page 1 COMMITTEE DISCUSSION AND RECOMMENDATION TO COUNCIL 1. REQUEST APPROVAL OF TWO ONE -YEAR EXTENSIONS FOR FINAL APPROVAL OF THE MONTEREY HEIGHTS LONG SUBDIVISION AND PLANNED UNIT DEVELOPMENT (AB2015 -122) Amy Keenan, Planning and Development Services Department, gave a staff report and stated these extensions will allow the applicant to work with the County and State on a wetland delineation, so they can develop the property as planned. The councilmembers discussed reasons for the extension being beyond their control. Browne moved to recommend approval to the full Council. The motion was seconded. The motion carried by the following vote: Ayes: Mann, Brenner and Browne (3) Nays: None (0) OTHER BUSINESS There was no other business.
