HomeMy WebLinkAboutSpecial Council August 28 20151 WHATCOM COUNTY COUNCIL 2 Special Council Meeting 3 4 August 28, 2015 5 CALL TO ORDER 6 7 Council Chair Carl Weimer called the meeting to order at 3:44 in the Council 8 Chambers, 311 Grand Avenue, Bellingham, Washington. 9 10 ROLL CALL 11 12 Present: Barbara Brenner, Ken Mann, Satpal Sidhu, Carl Weimer, Pete Kremen, 13 Rud Browne and Barry Buchanan. 14 Absent: None. 15 16 COMMITTEE DISCUSSION 17 18 1. DISCUSSION AND APPROVAL OF FINDINGS PURSUANT TO WCC 2.56.020 IN 19 COMMON THREADS, ET AL. V. WHATCOM COUNTY, ET AL., SKAGIT COUNTY 20 CAUSE NO. 15 -2- 01088 -6 (AB2015 -018) 21 22 Weimer stated the County Council just met in executive session concerning the 23 lawsuit with Common Threads, et al. v. Whatcom County, et.al. He moved to authorize 24 defense and indemnification pursuant to Whatcom County Code Chapter 2.56 for Rud 25 Browne. He further moved to adopt the following findings: 26 • Rud Browne was acting in a matter in which the county had an interest; 27 • Rud Browne was acting in the discharge of a duty imposed or authorized by law; 28 and 29 • Rud Browne acted in good faith. 30 31 Mann seconded the motion. 32 33 Browne stated he recuses himself from the vote. 34 35 The motion carried by the following vote: 36 Ayes: Mann, Sidhu, Brenner, Buchanan, Weimer and Kremen (6) 37 Nays: None (0) 38 Recuses: Browne (1) 39 40 Weimer moved to authorize defense and indemnification pursuant to Whatcom 41 County Code Chapter 2.56 for Satpal Sidhu. He further moved to adopt the following 42 findings: 43 • Satpal Sidhu was acting in a matter in which the county had an interest; 44 • Satpal Sidhu was acting in the discharge of a duty imposed or authorized by law; 45 and 46 • Satpal Sidhu acted in good faith. 47 48 Mann seconded the motion. 49 50 Sidhu stated he recuses himself from the vote. 51 52 The motion carried by the following vote: 53 Ayes: Mann, Browne, Brenner, Buchanan, Weimer and Kremen (6) 54 Nays: None (0) 55 Recuses: Sidhu (1) Special Council Meeting, 8/28/2015, Page 1 1 2 Weimer moved to authorize defense and indemnification pursuant to Whatcom 3 County Code Chapter 2.56 for Pete Kremen. He further moved to adopt the following 4 findings: 5 • Pete Kremen was acting in a matter in which the county had an interest; 6 • Pete Kremen was acting in the discharge of a duty imposed or authorized by law; 7 and 8 • Pete Kremen acted in good faith. 9 10 Buchanan seconded the motion. 11 12 Kremen stated he recuses himself from the vote. 13 14 The motion carried by the following vote: 15 Ayes: Mann, Browne, Brenner, Buchanan, Weimer and Sidhu (6) 16 Nays: None (0) 17 Recuses: Kremen (1) 18 19 Weimer moved to authorize defense and indemnification pursuant to Whatcom 20 County Code Chapter 2.56 for Ken Mann. He further moved to adopt the following 21 findings: 22 • Ken Mann was acting in a matter in which the county had an interest; 23 • Ken Mann was acting in the discharge of a duty imposed or authorized by law; 24 and 25 o Ken Mann acted in good faith. 26 27 Buchanan seconded the motion. 28 29 Mann stated he recuses himself from the vote. 30 31 The motion carried by the following vote: 32 Ayes: Kremen, Browne, Brenner, Buchanan, Weimer and Sidhu (6) 33 Nays: None (0) 34 Recuses: Mann (1) 35 36 Weimer moved to authorize defense and indemnification pursuant to Whatcom 37 County Code Chapter 2.56 for Barry Buchanan. He further moved to adopt the following 38 findings: 39 • Barry Buchanan was acting in a matter in which the county had an interest; 40 • Barry Buchanan was acting in the discharge of a duty imposed or authorized by 41 law; and 42 0 Barry Buchanan acted in good faith. 43 44 Mann seconded the motion. 45 46 Buchanan stated he recuses himself from the vote. 47 48 The motion carried by the following vote: 49 Ayes: Kremen, Mann, Brenner, Browne, Weimer and Sidhu (6) 50 Nays: None (0) 51 Recuses: Buchanan (1) 52 53 Special Council Meeting, 8/28/2015, Page 2 1 Weimer moved to authorize defense and indemnification pursuant to Whatcom 2 County Code Chapter 2.56 for Barbara Brenner. He further moved to adopt the following 3 findings: 4 • Barbara Brenner was acting in a matter in which the county had an interest; 5 • Barbara Brenner was acting in the discharge of a duty imposed or authorized by 6 law; and 7 • Barbara Brenner acted in good faith. 8 9 Buchanan seconded the motion. 10 11 Brenner stated she recuses herself from the vote. 12 13 The motion carried by the following vote: 14 Ayes: Kremen, Mann, Browne, Buchanan, Weimer and Sidhu (6) 15 Nays: None (0) 16 Recuses: Brenner (1) 17 18 Browne moved to authorize defense and indemnification pursuant to Whatcom 19 County Code Chapter 2.56 for Carl Weimer. He further moved to adopt the following 20 findings: 21 . Carl Weimer was acting in a matter in which the county had an interest; 22 • Carl Weimer was acting in the discharge of a duty imposed or authorized by law; 23 and 24 .
