ROLL CALL Present: Rud Browne, Barry Buchanan, and Satpal Sidhu Absent: None Also Present: Pete Kremen, Carl Weimer, Ken Mann and Barbara Brenner WHATCOM COUNTY BUSINESS PRESENTATION 1. PRESENTATION BY KEVIN MENARD, TRANSITION BIKES (AB2015 -134A) Kevin Menard, Transition Bikes, submitted and read from a presentation (on file). The committee discussed bike leases, the company's strategy for success, bike technology, global distribution, business advantages and disadvantages in Bellingham and Whatcom County, the positive aspects of developing new and modern industries, electric assist mountain bikes, and access to the U.S. market by Canadian companies and vice versa. EXECUTIVE REPORTS Jack Louws, County Executive, welcomed the new Public Works Department Director, Dr. John Hutchings. COMMITTEE DISCUSSION 1. DISCUSSION OF A PROJECT PROPOSAL AND POTENTIAL WASHINGTON STATE COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) APPLICATION FROM THE OPPORTUNITY COUNCIL (AB2015 -138) Jack Louws, County Executive, introduced the presentation of a multi -use facility project in East Whatcom county. Dave Finet, Opportunity Council, introduced Cheryl Thompson and Rebecca Boonstra. Rebecca Boonstra, East Whatcom Community Council Chair, described the East Whatcom Regional Resource Center development, use, operation, and staff. The new focus for the future will be food access and youth services. Finance and Administrative Services Committee, 4/28/2015, Page 1 Cheryl Thompson, Foothills Food Bank Board President, described the 2013 strategic planning process, existing refrigerator and freezer capacity, number of households served, fundraising for a refrigerated storage container and storage space, and the food distribution schedule. Half the people served by the food bank are children. They also serve seniors. They focus on how to get more perishable foods in people's diets. People and businesses are donating more perishable foods. There is room for their food bank with the extra storage at the East Whatcom Regional Resource Center, which will allow them an additional distribution day. The councilmembers thanked the presenters for their work on this project and discussed volunteering for the mobile food pantry, the process of food distribution to outlying areas, and providing indoor /outdoor space for youth activities. 2. DISCUSSION WITH EXECUTIVE LOUWS AND CHIEF CIVIL DEPUTY PROSECUTOR DANIEL GIBSON REGARDING ORDINANCE NO. 2015 -011, AN ORDINANCE AMENDING WHATCOM COUNTY CODE 3.08, PURCHASING SYSTEM (AB2015 -042) Jack Louws, County Executive, described the history of the recently- approved ordinance. Jim Karcher, Public Works Department, described the impact of the ordinance on their ability to allow change orders for projects. The modification would add two to eight weeks to the change order approval process, which will incur delay costs and initiate claims. Also, a multitude of regulations already guide the change order process. Existing controls are already in place. Last, federal aid money for projects would also be delayed six to seven weeks. Delaying projects longer will be detrimental to the County. The councilmembers discussed State auditing results, change orders, the Council serving as a check - and - balance to administrative projects, how often delays occur, and how long the change order process is. Dan Gibson, Prosecutor's Office, answered questions. James Lee, Public Works Department, described Public Works Department projects that occur in streams and rivers and the impact of a delayed change order process. Gibson described past situations in which the County declared an emergency to do unexpected work necessary for the operation of the ferry, when emergency provisions apply, and contract requirements for the County to respond promptly to change orders. The councilmembers discussed whether emergency provisions can apply to change orders; the processes of other counties; the Executive's liability if he or she exceeds responsibilities, which are established by the County Charter, and; Executive cooperation with the County Council. Buchanan stated he would like to define an effective date of the ordinance. He moved to recommend to the full Council that the Council delay the implementation date until October 1, 2015. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A GRANT AGREEMENT AMENDMENT BETWEEN WHATCOM COUNTY AND THE STATE OF WASHINGTON DEPARTMENT OF ECOLOGY FOR SOLID WASTE COMPLIANCE MANAGEMENT AND LITTERING AND ILLEGAL DUMPING ENFORCEMENT ACTIVITIES, IN THE AMOUNT OF $47,247, FOR A TOTAL AMENDMENT AGREEMENT IN THE AMOUNT OF $201,987 (AB2015 -141) Buchanan moved to recommend approval to the full Council. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACT BETWEEN WHATCOM COUNTY AND EDGE ANALYTICAL LABS FOR WATER QUALITY ANALYTICAL TESTING SERVICES, IN THE AMOUNT OF $67,500 (AB2015 -144) Buchanan moved to recommend approval to the full Council. Brenner asked how much is funded through a grant agreement. Erika Douglas, Public Works Department, stated only a small amount, $5,000 to $10,000, is funded with the grant. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO AWARD BID #15 -05 AND ENTER INTO A CONTRACT FOR THE CENTRAL SHOP VEHICLE EXHAUST SYSTEM UPGRADE TO THE LOW BIDDER, BLYTHE PLUMBING & HEATING, IN THE AMOUNT OF $173,755.16 (AB2015 -145) Buchanan moved to recommend approval to the full Council. REQUEST AUTHORIZATION FOR THE COUNTY EXECUTIVE TO AWARD BID #15 -16 FOR RENTAL RATES FOR MAINTENANCE AND CONSTRUCTION EQUIPMENT (WITHOUT OPERATORS) TO ALL BIDDERS, WITH SELECTION FROM THE LIST BASED ON EQUIPMENT AVAILABILITY AND SUITABILITY, WITH PREFERENCE TO LOW BIDDERS (AB2015 -146) Buchanan moved to recommend approval to the full Council.
