November 19, 1981
The Whatcom County Council meeting was called to order at 7:38 p.m.
November 198, 1981, by Chair Van Zanten, with all members present for
roll. The minutes of the previous meeting were approved as presented.
HEARINGS
Hearing was declared open on the Ordinance establishing Whatcom County
Ferry bates for 1982. The
following testimony was given:

2) Senior Citizen discount: stated
the tax rate limit in the assessor's
office is $14,000. Would like it
raised to this from $7,500.
3) Would like the present year's
punchcards to be used until mid -
January.
4) Start 1982 year with same rates
as 1981 and then review the rates
again in mid -year
5) Would like the rationale explained
for the 100% increase in late night
ferry runs.
Colleen Bates, Public Works
Department Fiscal Manager, explained the
increase in-the later night
rates was due to late night party goers.
It is meant to discourage them.
Late night emergency trips are usually
not charged for.

- Concerns:

1) Should have punchcards for

2) Why the 20% increase in rates?
3) Presented an 11/19/81 clipping
from the Bellingham Herald about the
ferry being closed.
4) Doesn't seem fair that logging
trucks can only use the ferry 2 times
per week.

Would like it retained.
Kelly Turner
-Plait until mid -year to see increase in
Lummi Island
traffic. Against eliminating punch
cards for motorcycles and bicycles.
Council should promote energy efficient
vehicles.

Vern Hawley - Thinks the charges are too high.
Lummi Island
No further testimony was given and the hearing was closed. Hansey
stated the Finance Committee had reviewed the ordinance and recommended
that final consideration be held until the November 30 special council
meeting. Hawley stated the Public Works Committee had also reviewed
the ordinance and made no recommendation. Final Consideration will be
November 30, 1981.
Bearing was declared open on the Ordinance amending the Whatcom
County Shorelines management Program adopted May 27, 1976 and amended
June 26, 1978 and modified by amending Chapter 8, Section 8.3, subsection
B -2, and repealing Ordinance No. 79 -62 adopted the 29th day of November,
1979. No testimony was given and'the hearing was closed. Hansey reported
the administration requested the effective date of the ordinance to be
January 1, 1982. Final consideration will be November 30, 1981.
Hearing was declared open on the Ordinance amending the Whatcom
County Subdivision Regulations by repealing ordinance 79 -62 and by
modifying sections 8.20.030, 8.20.130, 8.20.140, 8.28.020, 8.28.040, and
8.44.015. No testimony was given and the hearing was closed. Final
consideration of the ordinance will be November 30, 1981.
Hearing was declared open on the Ordinance amending the Whatcom
County Interim Zoning Ordinance and amendments thereto originally adopted
July 6, 1972 and repealing Ordinance No. 79 -62 adopted the 29th day of
November, 1979.. No testimony was given and the hearing was closed.
Final consideration will be November 30, 1981.
Hearing was declared open on the Resolution regarding the matter
of adoption of Whatcom County's 1982 Road Construction Program.
Ed Henken, County Engineer, gave a brief review of the proposal. The
following testimony was given:
Si Eldred -Would like West Shore Drive on
Lummi Island Lummi Island looked at and repaired.
Kelly Turner - Agreed that West Shore Drive is in
Lummi Island poor shape. There are also roads
in Lummi Island Scenic Estates and
Bales Passage Road.

Ed Henken explained that in the middle of an upgrading program for Lummi
Island funds ran out and it was not completed in 1981. The Engineer's
do plan to go back in 1982. McIntyre suggests that miscellaneous anti-
cipated funds of $5,000 go towards the Lummi Island project for 1982.
Louws stated the administration is aware of the problem. No further
testimony was given and the hearing was closed. Hawley stated the
Public Works Committee recommended "do pass." Hawley so moved to adopt
the resolution. Motion passed unanimously. The administration will also
report back to the Council on the West Shore Drive situation.
EXECUTIVE ITEMS
The b-id award for consultant's Services for Solid Waste Location
Site Study was before the Council. Hansey, Finance Committee, and
Hawley, Public Works Committee, both stated their Committee's recommended
the matter to the Committee of the Whole. The Chair will set up the
meeting.
Louws presented the following bids for pickup trucks:
1) 3 - New 1982 one -half ton pickup trucks as per our specifi-
cations for a total amount of $20,943.34, including tax and
trade -in allowances on four of our units
2) 1 - New 1982 3/4 ton pickup truck as per our specifications
for a total amount of $7,583.75 including tax and trade -in
allowance on two of our units
The bid to'go to Robinson- Chamber.s,Chevrolet of Ferndale. Hansey,
Finance Committee, and Hawley, Public..Works Committee, stated their.'
committee's recommended approval of the bid award. Hansey so moved
to approve the bid award and authorize the Executive to sign on behalf
of the County. Motion passed unanimously.
Louws also presented the following bid for dump boxes:
1) 2 - Dump Boxes with hydraulics and controls per our
specifications plus option "A" in the bid amount of
$30,170.00

$32,273.48 Total Amount
The bid to go to Mobile Equipment, Inc., of Kirkland. Hansey, Finance
Committee, and Hawley, Public Works Committee, stated both their committee's
recommended acceptance of the bid. Hansey so moved to approve the bid
and authorize the Executive to sign on behalf of the County. Motion
passed unanimously.

Louws stated he.has looked at the West Shore Drive problem on
Lummi Island. Stated there are many other areas that are in urgent
need as well.
OPEN SESSION
Air. Thomas, Sr., Delta Cable Television thanked the Council for
their consideration of his franchise ordinance.
Kelly Turner, Lummi Island, questioned the status of the Chicago,
Bridge and Iron project. Hansey stated he may present the Council with
a proposal concerning the Shoreline Amendments, not CB and I at the end
of the meeting.
William Manthey, who owns a mobile home park on the Axton Road
would like his property to be commercial zoned in the proposed Title 20
document. Van Zanten stated the Council will be having a committee
session on the proposal in the near future.
FINAL CONSIDERATION
Johnson moved for final passage the Ordinance creating Whatcom County
Dog Control Zone No. 2 in the area of the Plat of Sudden Valley in Whatco'
County, Washington. Johnson moved to amend the ordinance as follows:
1) Have the effective date be April 1, 1982
2) Have the licenses purchased between April 1, 1982 and March 31,
1983
3) Insert the new legal description of the area as per the
Building and Codes Administrations recommendation
4) Adopt the official map as presented by the Building and
Codes Administration
Motion to amend the ordinance passed unanimously. )Motion to adopt the
ordinance passed on a 6-0 vote. (McIntyre not present)
The Ordinance in the matter of amending an existing Franchise for
Delta Cable Television Ltd. and extending the term for ten (10) years
or from 1983 to 1993 was before the Council. A memo had been received
from the Prosecuting Attorney's office recommending the following three
primary changes to the first page of the ordinance:
1) Extending the term of the franchise to ten years
2) Increasing the consideration to the County from 4% to
4 1/2% of the gross revenue of the operation
3) Adding certain administrative provisions.

Muenscher moved to incept the substitute first page. Motion passed unani-
mously. Johnson so moved to adopt the ordinance. Motion passed on a
6 -0 vote. (McIntyre not present)
Hansey moved for final passage the Ordinance authorizing a revised
budget for the Northwest Washington Fair. The Finance Committee recommended
"do pass." Motion passed on a 5 -0 vote. (McIntyre and Muenscher not
present.
The Finance Committee had reviewed the Ordinance authorizing a
revised budget for the Personnel budget, 1981 with the Executive and
its was established that the ordinance was not needed. The ordinance
was withdrawn.
Hansey moved for final passage the Ordinance authorizing a revised
budget for the Mental Health /Drug Abuse Fund. The Finance Committee
recommended "do pass." Motion passed on a 6 -0 vote. (McIntyre not
present.)
The Ordinance authorizing the diverting of a portion of the County
Road Levy to the Current Expense Fund to be used for the support of the
County Law Enforcement Services in the unincorporated areas of Whatcom
County was before the Council. Hansey stated the Finance Committee
recommended holding the ordinance for final consideration until November 30.
Hawley stated the Public Works Committee recommended a "no pass" of the
ordinance. Final consideration will be held November 30, 1981.
The Ordinance authorizing and establishing payments to the Visitor
and Convention Bureau was before the Council. Ilansey stated the Finance
Committee had reviewed the ordinance and was holding it in Committee to
be re- drafted.
Hansey moved for final pssage the Ordinance establishing a reasonable
fee for copies of the budget, supporting tables, and budget message as
provided for in the Whatcom County Home Rule Charter, Article 6 Section
6.50. The Finance Committee reviewed the ordinance. Hansey moved to
amend the ordinance and strike lines 11 through 15. Motion to amend
passed unanimously. Motion to adopt the ordinance as amended passed on
a 6 -0 vote. (McIntyre not present)

Roehl moved for final passage the Ordinance amending the Whatcom
County Zoning Text to clarify 2.24.770.592. Motion passed by a 6 -0
vote. (McIntyre not present)
OTHER BUSINESS
A decision regarding the application of Preliminary Plat of Elden
Park was before the Council. This is a 40 -acre parcel, to include
9 lots. A variance is also included to allow wells in each lot. The
Planning Committee recommended approval of the plat and variance subject
to the Hearing Examiners conditions. Roehl so moved. Motion passed unanimously.
The application for Preliminary Plat of Seapark Estates was received
and referred to the Planning Committee for review.
The application for Open Space, filed by G.L. Anderson, was received
and sent to the Planning Commission for review.
Appraisals and recommendations regarding the proposed land exchange
between Leonard Cowden and Whatcom County were received. Muenscher
moved to direct a resolution to be drafted for the exchange. Motion
passed unanimously.
INTRODUCTION OF ORDINANCES AND RESOLUTIONS
Roehl introduced the Ordinance amending the Fisheries and Aquaculture
Sections of the Whatcom County Shoreline Program and it was referred to
the Planning Committee for review by unanimous vote.
The Ordinance amending the Whatcom County Interim Zoning Ordinance
in order to provide an appeal procedure from administrative decisions
affecting subdivisions was withdrawn from the agenda as it had already
been considered under Final Consideration of Ordinances and Resolutions.
Hansey introduced the Ordinance adopting a revised budget for the
Federal Shared Revenue Fund 1981 to provide for a consultant in wastewater
treatment and it was referred to the Finance Committee for review by
unanimous vote.
Roehl introduced and moved for final passage the Resolution amending
Resolution 81 -37 extending time limits for plat approvals as per House
Bill 320. Motion passed by a 6 -0 vote. (McIntyre not present)
Hansey introduced the Resolution in the matter of adopting a salary
schedule for the non -union Whatcom County Employees and it was referred
to the Finance Committee for review by unanimous vote.

Muenscher introduced and moved for final passage the Resolution of
the County Council of Whatcom County, Washington, authorizing the issuance
of an interim warrant for the purpose of financing part of the cost of
improvements in consolidated Drainage Improvement District No. 31.
Motion passed by a 6 -0 vote. (McIntyre not present)
Hansey moved to add to the agenda as item 8 the resolution regarding
the recently passed Shorelines Management Program amendments, the
Department of Ecology decision. Motion passed by a 6 -0 vote. ( McIntyre
not present)
Roehl introduced and moved for final passage the Resolution in the
matter of approving Whatcom County Water District No. 17 Comprehensive
Plan. The Planning Committee made no recommendation. Hawley questioned
the language on line 27, "rural and agriculture should not be limited
to this." Hawley moved amend the resolution on line 272' to strike the
word "specifically." Motion failed on a 3 -3 vote. (Van Zanten, Roehl,
Muenscher voting no) Motion to adopt the resolution passed by a 5 -1 vote. (Hawley)
Hansey introduced and moved for final passage the resolution
regarding the recently passed Shorelines Management Program amendments.
Hansey stated the County has 30 days in which to file an appeal from the
Lime the four amendments were accepted by the Department of Ecology.
Roehl said he has trouble with directing the administration to go ahead
and negotiate with the Department of Ecology in drafting new language.
Hansey moved to hold final consideration until the December 3, 1981
Council meeting. Motion passed on a 6 -0 vote. (McIntyre not present.)
COMMITTEE REPORTS
Special Council meeting will be November 30, 1981.
Committee of the Whole meeting will be Wednesday, November 25, 1981
on the Title 20 Ordinance.
Hearing on the budget will be November 24, 1981, at 7:30 p.m.
