Minutes
May 21, 1981
The meeting was called to order at 7:35 p.m. with all present
for roll with the exception of Hawley. Johnson moved to excuse Hawley
who was on vacation attending his son's graduation from Annapolis.
Motion passed unanimously.
The minutes of the May 7, 1981 meeting were approved as presented.
EXECUTIVE ITEMS
Muenscher moved to accept the Executive items and add them to the
agenda, as the first item. Motion passed.
The Executive introduced the bid for a Pneumatic Compactor,
recommending the bid from Sahlberg Equipment Co., Seattle, be approved.
The bid in the amount of $31,488.25 is for a Ingram Pneumatic Roller
12 ton, Model 9- 2800 -P equipped with a GMC DD 353 N Diesel Engine.
Louws stated this item has been budgeted for in the amount of $35,000.
He also stated that.machines like this cannot be rented. Hansey
reported the Finance Committee recommeded acceptance of the bid.
Hansey so moved. Motion passed unanimously.
The Executive introduced the bid for a Storm Sewer Project for
the Northwest Washington Fair, recommending the bid from Vellema
Construction Company, of Lynden be approved. Hansey stated the Finance
Committee recommended approval of the bid in the amount of $27,122.77.
Hansey so moved. Motion passed unanimously.

The Executive introduced the bid for the construction of the Lummi
Island Ferry Terminal.Tran sfer Space, Bridge No. 507 -A- CRP 38036,
F.A. No. BRS- A371(1), F.A. Contract No. SA -0183, recommending the bid
from Butler Construction andiSealant Systems Co. in the amount of
$281,800.00 be approved. The Finance Committee reviewed this and
recommended approval. Hansey so moved. Motion passed unanimously.
Hansey moved to transfer $44,154.00 from the category 334 -27 -41
to 338- 27 --41 in the Current Expense Revenue Fund under Special Supervision
Program as requested by -the County Executive. The Finance Committee
recommended "do pass." Motion passed unanimously.

Johnson moved to approve the A and C liquor license for the Crawdad
Junction. The Public Safety Committee recommended 'approval. Motion
passed unanimously.
Johnson moved to approve only an A and C liquor license for South
of the Border Restaurant. The Public Safety Committee recommended
"do pass." Motion passed unanimously.
The County Executive presented the Council with a proposed Marine
Construction Facility's Fiscal Impact on Whatcom County. This was received
for information.
OPEN SESSION
Jeffrey Margolis of Van Zandt, Washington, a member of the Mt. Baker
Water Shed Protection Association spoke of his concerns regarding herbicide
and pesticide spraying in the Fork Valley area. He explained there was
not enough warning to residents in the area before the spraying occurred.
He stated the spraying of these herbicides and pesticides is a problem
to game management, human fertility, and the interferring with nitrofication
of soils in the area. He suggested banning all herbicides and pesticides
that contain dioxides. He also suggested a program in which the communit,
would volunter its services to research and study the problem of spraying.
He presented a Federal report for the Council's information.
OTHER BUSINESS
A presentation of the Block Grant program was given by Ralph Rogers,
Nat Dickinson, Scott Finley and Jay Carpenter., Nat Dickinson stated the
purpose of the program is to preserve the existing housing stock in the
area. Thirty -six homes in Sumas were renovated in 1980 for approximately
$466,000.00. Scott Finley stated this program provided financing and
supervision in the terms of'contracts and the bidding process. Jay
Carpenter presented a slide show of.the overview of Sumas.
The request to reconsider the motion of Preliminary Plat of McMullen
Estates, which was deferred from the April 30, 1981 meeting was before
the Council. Roehl moved to amend the amended Condition No. 12 to strike
all the language and insert the following:
"Subject to the requirements of Condition No. 11,
an acceptable plan for maintenance of the drainage
retention ponds following expiration of the three
(3) year period referred to in Condition No. 11 is
required. This plan shall include a written agree-
ment whereby this responsibility is ),,sumed by the

fee title holder of Community Tract "A" and all
enforcement rights of the developer in such an
agreement shall be transferred at the`expiration of
the three (3) year period to Whatcom County. The
agreement shall be submitted to and approved by
the Chairperson of the Whatcom County Council
following review by the Whatcom County Engineer and
Hearing Examiner."
Motion on the amendment passed by unanimous vote.
Roehl moved to amend on page 32, Condition No. 3 of the words
"City of Bellingham" to add "with Water District No. 10 as the purveyor."
He also moved to amend onpage 33, Condition No. 5 after the words "City
of Bellingham" to add "with Water District No. 10 as the purveyor." Both
motions passed by unanimous vote. Council, by unanimous vote, approved the
preliminary plat subject to the Heating Examiner's Conditions as amended.
Johnson moved to accept the bid award from the Bellingham Herald
for the official printing'of legal notices, etc., for Whatcom County
as recommended by the County Auditor. Hansey moved to request that
all notices be classified under the heading; of "Whatcom County."
Motion on the amendment passed by unanimous vote. Motion on the bid
passed by unanimous vote.
The nominations of Joyce 'Baumann and Phyllis Entrikin to the
Board of Equalization were presented at the May 7, 1981 meeting with
nominations held upon until tonight's meeting. Johnson moved to close
the nominations and to appoint Baumann and Entrikin to the Board. Motion
passed unanimously. j
The petition to alt6r plat lines, filed by Charles Brewer and Lois
Barrett was received by the Council. Roehl moved to refer the petition to
the Planning and Engineers Departments for their reports, and also to
have the Planning committee review the petition. Motion passed unanimously.

A public hearing will be set for June 18, 1981.
FINAL CONSIDERATION OF OR..DINANCES AND RESOLUTIONS
The ordinance adopting a supplemental budget for the Federal Shared
Revenue Fund was reviewed by the Committee of the Whole and the Finance
Committee, both recommending approval. Hanseyy moved the adoption of the
ordinance. The Funds in the amount of $0,000.00 are to be used to
remodel the basement area of the Buildings and Code Administration
building to provide additional office space: for the Council of Governments
and the Bureau of -the Buildings and Code Administration. Motion passed
unanimously.

Hansey moved for the adoption of the Ordinance adopting a supplemenj
budget for the Buildings and Code Department. The-supplement in the amount
of $58,056.00 is needed to employ three regular employees that are needed
for the County land use permit and plat review process to compensate for
the loss of four CETA positions, add two employees to handle current
planning and add a county SEPA official. Mr. Rushing indicated it should

Hansey moved for the adoption of the Ordinance revising the Planning
Department 1981 budget.. This revision in the amount of $27,719.00 is
to reduce the Planning Department staff of two positions, due to the
reorganization of the County land use permit and plat review process.
Motion passed unanimously.
The Ordinance amending Ordinance No. 81 -15 which amended the 1970
Whatcom County Comprehensive Plan Text and Map for that geographic area
commonly known as the Cherry Point /Ferndale Subarea of Whatcom County,
Washington was before the Council for final consideration. Van Lanten
stated subsequent to the public hear on May 19 correspondence had been
received from the City of Ferndale and E. R. Barnett. A petition was
also received from 83 residents in the area endorsing the change in
density in North Bellingham. Roehl moved for final adoption of said
ordinance as amended. Roehl stated that residents at the Public Hearing
of May 19, 1981 at the North Bellingham School, who resided in the Aldrich
Road area would prefer a Rural 5 zoning instead of Rural 10. He stated
he would support this change if so desired. Roehl moved to delete the
New Section K. Economic Policies from the amendments. He had received
correspondence from the Prosecuting Attorney who reported there was
no place in the plan for this section. Hansey stated Economic Policies
should be considered in the plan. He stated the language was taken
right out of SEPA. The motion on the amendment was defeated on a tie vote.
McIntyre stated he would like to deal with the City of Ferndale
correspondence. Bill Trimm stated the concerns of the letter have already
been adopted on page 31 under Community Facilities and Utilities. Roehl
moved to have the Council respond to the Ferndale letter. The Chair
will see this is done.

Roehl moved to amend the title of the Ordinance to add after the
word "'amending" add "Ordinance No. 81 -15 which amended" and on line 1521
to add after the word "County" add "as amended in Ordinance No. 81 -15"
and on line 16. to add after the word "herein" "and further incorporated
into Exhibit A -1 of Ordinance No. 81 -15." Motion on the amendments
passed by unanimous vote.! Motion on the ordinance passed on a 5 -1 vote.

The word "services" in the ordinance amending Ordinance No. 79 -23,
and Title 3 of the Whatcom County Code, for the purpose of establishing
that service contracts are. excluded from the bid procedure, was reviewed
by the Prosecuting Attorney. He recommended the word "Professional"
be added before the word "services" on line 24 and on line 3121 strike
"or other services ". McIntyre moved to amend the ordinance as recommended
by the Prosecuting Attorney. Motion passed by unanimous vote. McIntyre
moved for adoption of the ordinance as amended. Motion passed unanimously.
Hansey moved for the adoption of the Ordinance authorizing a
supplemental budget for the Federal Shared Revenue Fund. The supplemental.
in the amount of $1,585.50 is necessary for the payment of outstanding
charges and additional Federal Shared Revenue monies for the completion
of the agreement for Codification Services. The Finance Committee
recommended approval. Motion passed unanimously.
Hansey reported the Finance Committee was holding the Ordinance
authorizing a supplemental budget for the Federal Shared Revenue Fund
(Mental Health, Involuntary Commitment Office) for an additional two
weeks.
Hansey moved for the adoption of the Ordinance authorizing a
revised budget for the 1981 Northwest.Washington Fair Fund. This
revision is to reflect a true financial picture and to allow for proper'
expenditures of monies in the Fair budget. The Finance Committee
recommended "do pass." Motion passed unanimously.
Hansey moved for the adoption of the Ordinance authorizing a
supplemental budget for the Prosecuting Attorney's 1981 budget. This
supplemental, to be expended out of the current expense cash fund,
is needed to fund one position in the Prosecuting Attorney's office
due to the phaseout of the CETA program. The Department of Social and
Health Services, State of Washington will reimburse Whatcom County for
monies expended. The Council voted unanimously the intent of the Council

is to drop this position if the State decides to drop this program.
Motion on the ordinance passed unanimously.
Hansey moved for the adoption of draft II of the Ordinance authorizing
a supplemental budget for the Federal Shared Revenue Fund, 1981, regarding
Township Halls. This supplemental is necessary for the payment of certain
construction assessments for water lines owing on the Mountain View Town-
ship Hall property. The Finance Committee recommended the funds to come
from the Federal Shared Revenue Fund instead of Current Expense in the
amount of $2,420.00. Motion passed unanimously.
INTRODUCTION OF ORDINANCES AND RESOLUTIONS
Roehl introduced the Ordinance in the matter of a franchise for
Satellite Scanner, Inc., to install, operate and maintain Cable T.V. along
certain Roads in Whatcom County, Washington (Pt. Roberts), and referred
it to an Ad hoc Committee made up of the Chairpersons of the Council,
Finance and Planning Committees. The Committee is to also review it
in terms of a proposed general franchise ordinance being considered and
to do a preliminary review of that ordinance.
Roehl introduced the Ordinance in the matter of a reduction of spec,
limit on the Lake Louise Road and referred it to the Public Safety Committee.
Roehl introduced the Ordinance amending the Whatcom County Shoreline.
Management Program in reference to Agriculture setbacks and referred it to
the Planning Committee.
REPORT OF COMMITTEES
Johnson reported for the Public Safety Committee regarding the Petition
from Sudden Valley for a dog control zone. He stated the petition was
given to the Prosecuting Attorney's office to look into the jurisdiction
of the County on the privately owned property.
Roehl reported the Planning Committee was awaiting information from
the Public Works Department on the petition to vacate a portion of Edwards
Drive, located in Point Roberts. He stated the petition to alter lot
lines, filed by Sean Calla.gher was set for public hearing June 4. Ile
also stated the petition to .r.ez rn e between the Kellog and Horton Roads on
the Guide Meridian was scheduled. for June 18, a one -half hour block
for open session.
