Minutes of sleeting
March 19, 1981
The meeting was called to order at 7:37 p.m. with all present for
roll. The minutes of the March 5 meeting were approved as presented.

Hearing was opened to declare twelve County owned Motor Pool vehicles
surplus. No testimony was given and the hearing was closed. Hansey
moved to declare the vehicles surplus and direct the Executive to proceed
with the sale. Motion carried by a unanimous vote.
EXECUTIVE ITEMS
The County Executive asks that the bid on a low boy tractor from
Evergreen International of $56,320,00 less tax, with trade -in be approved.
Hansey of the Finance Committee and Hawley of the Public Works Committee
recommended to accept the bid. Hawley so moved. 111.4oti,on is passed by
unanimous vote.
The second item the Executive presents are Assigned Counsel contracts
to be approved two in Superior Court, three in Juvenile Court, and four
in District Court. Hansey of the Finance Committee recommends that the
contracts be approved. Hansey so moved. Motion passed by a majority
vote.
Hansey moved to transfer $21,000.00 in the Federal Shared Revenue
Fund from the Machinery and Equipment category to the Professional
Service category in the Auditor's section of the Federal Shared Revenue.
Motion passed by unanimous vote.
Hansey moved to transfer ;7,000.00 from category 333 to category 338
in'the Juvenile Court /Probation Fund. The money was improperly_ defined
as grant money. Motion is passed by unanimous vote.
Hansey moved to change the BARS numbers in the Non - Departmental
Fund from 519- 80- •53 -01 to 525-10-53 and the title of the fund from Special
Revenue Fund to Agency Fund as requested by the Auditor. Motion passed
by unanimous vote.
The Executive presented names for confirmation for various Boards
all of which were confirmed by Council;

The County Executive John Louws reports meeting with the Finance
Committee on Tuesday, 3/17/81, to discuss the over crowding in the County
Jail. The County has not yet needed to use the Bellingham Jail. The
County Jail can hold 70 persons. Louws said a resolution o:.f Intent would
be provided at the next Council meeting.

No one spoke in the opportunity for Open Session
FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS
The Ordinance authorizing a supplemental budget for -the Whatcom
County Sheriff's 1981 budget was before the Council for consideration.
Hansey moved to adopt the ordinance transferring the $32,000.00 needed
for a traffic officer from the County Road Fund to the Sheriff's
budget. Hansey reports that the Finance Committee recommends "due pass ".
The Ordinance was defeated on a 2 -5 vote, McIntyre, Johnson, Roehl,
Hawley and Muenscher voting no. Roehl moved to reconsider the ordinance
in two weeks.
OTHER BUSINESS
Decision on the appeals on the Hearing Examiner's decisions:
A poll for conflict of interest or any appearance of fairness
problems was taken by Van Zanten with no conflicts reported.
Roehl explains the appeal of Ufkes, No. A.A. 9 -80 -5 and SV 6 -80.
Mr. Ufkes proposed to enclose a deck that is presently encroaching within
the Shorelines program setback. The Hearing Examiner record shows that
Ufkes could do this without a variance. The Hearing Examiner record
states that the expansion of a non - conforming development permit under
the Shorelines program can be done through the conditional use permit
process. The Hearing Examiner found that the variance and the conditional
use requirement were in conflict and found the conditional use was more
specific in this instance. Roehl moved to uphold the Hearing Examiner in the
Ufkes appeal because the deck does not further encroach the Shoreline.
Motion passes by a majority vote.

On the Reasoner, No. A.A. 10 -80, appeal Roehl explains that this
is the construction of an addition to an existing_- building and would be
further encroachment. Roehl moved to grant the appeal_ of the Building
and Codes on the Reasoner appeal and overturn the Hearing Examiner decision
finding an error of law, and that error being incorrectly defining the
issue by not going into the need for a variance. Motion is passed by
majority vote.
In regards to the request to revise Shoreline Substantial Development
S. 19 -75 to allow relocation of parking areas to Point Roberts Marina.
Roehl reports the Planning Committee recommends to grant the request
subject to conditions set out in the findings of fact as received by
the Hearing Examiner, 1) Same conditions will apply as issued in the
original permit S. 19 -75 issued by Whatcom County on April 12, 1976, and
2) Curb or other barrier shall be installed at each exit leading from
the moorage parking area to the public trail in order to discourage
vehicle encroachment on the public trail. '_Motion passes with unanimous
vote.
The application of Western Shelter Projects, Ltd., for a Preliminary
Plat known as McMullen Estates Subdivision is referred to the Planning
Committee and scheduled for consideration on April 16.
The findings reasons and motion in the matter of recommendations
of the Planning Commission on the 1980 Open Space Applications was
received and is referred the the Manning Committee and is scheduled for
consideration on April 2, 1981.
The application for a dance license by Lawrence O'Brien, Jr., Knotty
Pine Restaurant is an annual renewal and is referred to the Executive to
handle under terms of the Whatcom County Code.
INTRODUCTION OF ORDINANCES AND RESOLUTIONS
Roehl moved to add the Ordinance in the matter of issuing a
replacement warrant to the Agenda. Motion is carried.
Hansey introduced the following Ordinances and Resolutions and
referred all to the Finance Committee:
1. Ordinance authorizing the distribution of Public Utility District
.Privilege Tax Revenues
2. Ordinance authorizing a supplemental budget for the Whatcom
County Council 1981 budget
3. Ordinance authorizing a supplemental budget for the Federal
)Shared Revenue Fund, 1981
4. Ordinance authorizing a supplemental budget for the Juvenile
Court /Probation 1981 budget

5. Ordinance authorizing a supplemental budget for the Juvenile
Court /Probation 1981 budget (Grant Funds)
6. Ordinance authorizing a supplemental budget for the Prosecuting
Attorney's 1981 budget
7. Ordinance adopting methods and procedures regarding economic
values will be given appropriate consideration in the rule -
making process along with environmental, social, health and
safety considerations by Whatcom County and all rule- making
entities of Whatcom County
8. Ordinance issuing replacement warrant
Roehl introduced the Ordinance restricting the speed limit on Saxon
Road and referred it to the Public Safety Committee.
Roehl introduced and moved for final passage a resolution in the
matter of the sale of Whatcom County surplus property and the setting
of a date for public hearing thereof, pursuant to R.C.W. 36.34.020 and
that a public hearing be set for April 16. notion passed.
Aluenscher introduced and moved for final passage a Resolution of
intent to vacate a portion of County Road No. 63, Telegraph Road, located
in Section 10, Township 39 North, Range 3 East of W.M. Potion passed.
COMMITTEE REPORTS
Muenscher would like the Council to have a monthly report on the
cash balance of the County.
Roehl reports the next Committee of the Whole meeting on the Cherry
Point /Ferndale subarea Plan will be April 1, at 7:00 p.m.
Muenscher on behalf of the Council thanked Nancy for the great job
she has done and wishes here much success in the future.
