Minutes
August 20, 1981
The meeting was called to order at 7:36 p.m. by Chairperson
Van Zanten with Muensche.r, Hansey, Johnson, and Hawley present for
roll. The minutes of the previous meeting were approved as presented.
EXECUTIVE ITEMS
Executive Louws stated the two overlimit transfers he was to
present mould be held until the next meeting, September 3.
Council confirmed the Executive's request for the appointment
of Mr. Harvey Armintrout to the Development Disabilities Board. This
appointment is to fill the unexpired term of Dale Hershey which will
start immediately and expire December 31, 1981.
FINAL CONSIDERATION'OF ORDINANCES AND RESOLUTIONS
Hansey reported the Finance Committee had reviewed the following
two ordinances and will be holding them two additional weeks because
of a language conformancy problem:
1. Ordinance authorizing reimbursement from the Building
Maintenance Fund, the.County Supply Fund, and the
Ourrent °Expense 'Fund��-to-:Federal:-Shared Revehue:'.Fund
2. Ordinance authorizing.a'.revised budget for the Federal
Shared Revenue Fund
Hansey moved for final adoption the Ordinance authorizing a revised
budget for the Law Library. He stated the Finance Committee reviewed
the ordinance and recommended "do pass." Motion passed unanimously.
Hansey moved for final adoption the Ordinance adopting a supplemental.
budget for Federal Shared Revenue Fund 1.981 budget to provide for
development of the Nor -Bell Wastewater Facility Plan. He stated the
Finance Committee recommended "do pass." Motion passed unanimously.
The Ordinance amending the Whatcom County Shoreline Management
Program was before the Council for final adoption. Before the ordinance
was considered the Chair polled the Council for any conf.lic•t of interest
or appearance of fairness problems. Muenscher, Johnson, McIntyre,
Hansey, and the Chair reported no conflicts. Correspondence was read
into the record from Johnson, Ken King, and an affidavit from Bill Quehrn.
Hawley read a statement saying there may be an appearance of fairness
question for him and so abstained from discussion or voting on the matter.

McIntyre entered the meeting at 7:50 P.M.
Hansey moved for final adoption the ordinance amending the Whatcom
County Shoreline Management Program. He stated that each member should
have had an opportunity to review the ordinance. Muenscher read a three
page memo he wrote into the record stating he would vote against the
amendments and the reasons why.
Van Zanten was concerned with the lack of protection for the
Whatcom County Taxpayer. She was concerned with the continued provision
of mitigation and insuring its effectiveness. She stated an insurance
clause should be included. She stated -the Council could do one of two
things: 1) hold up the amendments until the clause is formed or 2) agree
to vote for the amendments and move to have the Planning commission
expedite the additional amendments which address the question of
mitigation. In the interest of moving the project along she would do
the second.
Roehl entered the meeting at 8:17 p.m. and was polled for any
conflict of interest or appearance of fairness problems. Roehl reported
no conflict.
McIntyre referred to the Chair saying he was not polled for the
appearance of fairness problem. The Chair so polled him with no conflict
reported.
Roehl commented he would vote "no" on the amendments because he
did not see that there was a good basis for altering the program. He
also stated the wording of the amendments is too broad.
Motion to adopt the ordinance passed on a 4 -2 vote. ( Roehl,
Muenscher voting no, Hawley abstaining)
Hansey moved to request the Planning Commission to expedite their
consideration of further amendments (the Clement proposal) which will
address mitigation and compensation as a result of the potential.

Chairperson Van Zanten reported that the Ordinance in the matter of
repealing the Whatcom County Interim Zoning Ordinance and adopting Title
20 Official Whatcom County Zoning Ordinance for the geographic area
commonly known as the Cherry Point- Ferndale Subarea had been discussed
by Committee of the Whole August 18. The Committee is continuing its
discussion next Tuesday, August 25, at 7:30 p.m.

Roehl moved for final adoption the Ordinance amending the Point
Roberts Comprehensive Plan Text and M.'a.p from ro.sidential low density
four dwelling units per acre to resort commercial four dwelling units
per acre. He stated the Planning Committee recommended "do pass."
Motion passed unanimously.
Chairperson Van Zanten stated the Committee of the Whole recommended
adopti.on of the Resolution in the matter of the adoption of an Affirmative
Action Plan and Program for Equal Employment Opportunity for Whatcom
County, Wash. Roehl moved the resolution for final adoption. Harold
Raymond, Personnel Director, stated the plan has been approved by the
Human Rights Commission. He had presented the Council with an amendment
to page 22. Hansey moved to accept the amendment. Motion passed unanimousl.
Motion to adopt the resolution passed unanimously.
OPEN SESSION
No one spoke in the opportunity of open session.
OTHER BUSINESS
Craig McConnell of the Agricultural Extension Office gave a
horticulture program presentation. He reviewed the industry as a whole
in the County stating there was a $5,000,000 loss in'agriculture this
year. He also stated a number of programs, workshops, and seminars
that the Extension office provides during the year.
Roehl stated the Planning Committee discussed the Gerald L. Noe
decision and was concerned with the ramifications of the decision.
The Administration is redrafting the Findings of Fact. Discussion will
be held at the next Council meeting, September 3, 1981.
Communication was received from Puget Sound Power & Light Company
regarding mortgaging their existing franchise. Van Zanten, stated she
had consulted with the Prosecuting Attorney's office, who in turn
said this could be done through resolution. Ellen Vaughn gave a brief
explanation of what the.power company wanted to accomplish. Johnson
introduced and moved for final adoption the Resolution consenting to
an assignment for financing purposes of Puget Sound Power & Light
Company's 25 -year water and waste water franchise on certain roads in
Whatcom County, granted by Ordinance No. 79 -72. Motion passed unanimously.

The decision regarding the request of Progressive Construction, Ltd.
for extension of Preliminary Plat approval to create and develop a
residential subdivision known as "Anderson Park Estates" was before the
Council for consideration. Roehl stated that House Bill 320 applies
here. The Planning Committee reviewed the request and recommended
an extension for a period of 18 months be granted subject to the Hearing
Examiner's conditions. Roehl so moved. motion passed unanimously.
The decision regarding the request of Overlake Properties, Inc.
for an extension of Preliminary Plat approval for the proposed plat of
Tweed Twenty, Division No. 7 was before the Council for consideration.
Roehl stated that House Bill 320 applies here also. The Planning
Committee recommended an extension for a period of 21 months be granted
subject to the original: Hearinft-EXamineir�'s conditions. 1 Roehl so moved.
Motion passed unanimously.
The decision regarding the request of Allan Wawryk for Preliminary
Plat approval and conditional use permit to expand a Mobile Home Park
known as "Evergreen Mobile Home Park was before the Council. Roehl
stated that House Bill 320 also applies here as well. The Planning
Committee reviewed the request and recommended approval of the Plat,
the conditional use permit, and also two variances, subject to the Hearing
Examiner's conditions. Roehl so moved. Motion passed unanimously.
Johnson reported on the Sudden Valley Dog Control Zone situation.
He stated the Executive had spoken with the Prosecuting Attorney's office
and as a result was told the County could have a control zone in this
private area. A map will need to be drawn up to show the boundaries
of the proposed dog control zone and then the Council can proceed with
setting up public hearing.
The following two petitions were received by Council and referred
to the Planning Committee:
1. Petition for lot line adjustment of Lots 2 & 3 in the
Plat of Georgia Point, filed by Donald Hawley
2. Petition for lot line adjustment of Lots 14 & 15 in the
Plat of Cedarbrook Court, filed by Ronald L. Jeffrey

A petition was also filed by Consolidated Drainage Improvement
District No. 31, to extend their district boundaries to include lands
that are benefitted by the improvements and drainage of the district.
JoAnn Miller, Whatcom County Conservation District, stated these areas
had been overlooked in the original project. She stated the
Council will need to assign a board of a appraisers to establish
an assessment amount. Van Zanten was also concerned on whether or
not a public hearing was needed. :"''. This will be clarified. Muenscher
moved to accept the petition and proceed as required by law. Motion
passed unanimously.
INTRODUCTION OF ORDINANCES AND RESOLUTIONS
Hansey introduced the following two ordinances and they were
referred to the Finance Committee by unanimous vote:
1. Ordinance authorizing .revised budgets for salary
increases and.related benefit coverage within the
budgets of the Agricultural Extension Service,
Assigned Counsel, Assessor, Auditor, Building
and Codes, Clerk, County Council., County Executive,
District Court, Grants Management,; Hearing Examiner,
Juvenile Court /Probation, Law Library, Medical
Examiner, Personnel, Planning, Prosecuting Attorney,
Public Works Administration, Treasurer, and Non -
Department`al budgets within the Current Expense
Fund
2. Ordinance authorizing a revised budget for salary
increases and related benefit coverage within the
Federal Shared Revenue Fund
Roehl introduced the Resolution in the matter of submitting to
the voters a proposal to fund. an emergency telephone system. It was
referred to Committee of the Whole by unanimous vote.
Hansey introduced and moved for final adoption the Resolution
regarding final application to the Department of Social and Health Services
for Referendum 37 Funds for a project proposed by the Work Shop to
construct a building. Motion passed unanimously.

Hansey introduced and moved for final adoption the Resolution
regarding final application to the Department of Social and Health
Services for Referendum 37 Funds for a project proposed by Whatcom
Association of Training Centers to remodel a building in Bellingham.
Motion passed unanimously.
COMMITTEE REPORTS
Van Zanten stated there would be a Committee of the Whole meeting
Tuesday, August 25, 1981 to discuss the Ordinance relating to Title 20.
Roehl stated that the application of Baker's Acres for Preliminary
Plat approval would be scheduled for the next Planning Committee meeting.
