HomeMy WebLinkAboutCounty Council for November 22 1982WHATCOM COUNTY COUNCIL Special Meeting November 22, 1982 Minutes The Whatcom County Council meeting was called to order at 7:17 p.m., Monday, November 22, 1982, by Chairman Roehl with all members present. Also present were Executive John Louws; Marty Harper, Harper -Owes; Steve Carley, Department of Ecology; an Ron Pederson, Ferndale City Manager. Consideration was first held of the ordinance imposing an excise tax on the use of telephone access lines for the purpose of funding an emergency service communication system. Van Zanten moved the ordinance for final passage. Van Zanten moved to accept draft II of the ordinance, which came out of the Finance Committee. Motion to accept draft II passed. Van Zanten described the changes in the ordinance that came from the Finance Committee. Cole questioned if the telephone company receives a partial payment of a billing will the fifty cent (500) tax come off the top. Cole so moved to amend the ordinance on page two, to add anew subsection "e" under section five to read as follows: "In the event the telephone company shall receive a partial payment of a billing effected by this ordi- nance, the tax by this ordinance shall be deducted prior to any remittance of any balance due and owing to the company." Cole's motion failed. In response to Cole's question, Hansey pointed out Section 11 of the ordinance ,'which states if a subscriber knowingly fails to remit the tax imposed by the ordinance they shall be guilty of a misdemeanor. Motion to adopt draft II of the ordinance passed unani- mously. -- Hansey excused himself from the meeting. -- Whatcom County Council Special Meeting November 22, 1982 Minutes page two Council next considered the Resolution accepting Nor -Bell Wastewater Facility Plan for the construction of force sewer line for the public entities including Nor -Bell Nursing Home, North Bellingham School, Whatcom County Community College, Whatcom County Library, and other structures and buildings within the County -owned 160 acres at the intersection of Smith and Northwest Roads plus additional 175 connections from properties abutting said force main from Byers Road to Axton .pump station on Smith Road and Barrett Road and providing for the upgrading and enlargement of the Ferndale Sewage Treat- ment Plant and authorizing the County Executive to enter into a contractural agreement by and between the State of Washington Department of Ecology and Whatcom County. This Resolution supersedes Resolution No. 82 -43. Executive Louws submitted a cost summary of the project. He stated that with the adoption of this plan the County will need to subsidize it in the amount of $10,000 per year for a total of 15 years. Louws recommended the $10,000 to come from the Real Estate Excise Tax. Louws also suggested that the County may want to open requests for the 175 residential connections for a period of seven (7) days and limit the number of hookups per owner to four (4). If any connections are left at the end of the seven day period that they be prorated out. Louws pointed out if the County does not go with this plan Ferndale very likely will not be able:to bring their plant-up:to-standards'_-with the use of grant money. Roehl questioned the -cost of the drainfield. Louws stated he felt the cost was high. It could probably be done for approximately $150,000. Roehl felt Nor -Bell should be taken care of by itself for a much lower cost to the County. Carley stated that at this time DOE would not fund an on -site plant with Referendum 39 funds. Muenscher,introducdd °and moved for ffnal passage._the resolution in concept. Cole suggested the Council first decide which direction it will take; whether on -site facility of a tight -line system. Muenscher withdrew his motion and moved to adopt,:in concept, a tight -line system as proposed. Motion passed. Muenscher so moved to adopt the resolution. Cole moved to accept draft.JI of the resolution. Motion passed. The following motions were made to the resolution: -Cole moved on page three, line 12., to strike the period at the end of the sentence and add "within any twelve- month period.." Motion passed. -Cole moved on page three, lines 24 and 25 to strike "by the equivalent residential users will require a local pump station which ". Motion passed. -Cole moved on page three, to strike lines 27 through 29 and add a new paragraph as follows: "This resolution neither prevents nor requires annexation." Motion passed. -Cole moved on page three to add a new paragraph at the end of section three as follows: "Annexation to the City of Ferndale shall not be required for connection to the sewer line and the agreements referenced as Exhibits B and C shall set forth this provision." Motion passed. -Cole moved on page four, to strike the first sentence in the last paragraph which reads "Payments by public entities for bond debt service will be approximately $38,200, and $35,000 for the first Ten (10) years will be paid through the sale of 175 equivalent residential connections, for a total of $73,200 per year." Motion passed. -Cole moved on page five, Section 6, line 4 to insert the number 1185" in the blank. Motion failed. - Hawley moved on page five, Section 6, line 4 to insert the number 1150" in the blank. Motion failed. Motion passed. -Van Zanten moved on page three, line 12 to strike. the period at the end of the sentence and add the following: "provided, however the total sold to any one party be limited to 85." Motion passed. -Cole also moved on page three, line 6 to add after the word "as ", "defined in Exhibit C." Motion passed. Motion to adopt the resolution as amended passed. No further business came before the Council, Adjourn- ment was made at 10:14 p.m.
