HomeMy WebLinkAboutCounty Council for November 18 1982WHATCOM COUNTY COUNCIL Minutes November 18, 1982 The Whatcom County Council meeting was called to.order on Thursday, November 18, 1982 at 7:32 p.m., by Chairman Roehl with all members present. The minutes of the November 4 Council meeting were approved as amended on page five to change the spelling of the name "Holleman" to ".Hallman ". OPEN SESSION Rita Foley, 3878 Blue Canyon Road, stated concerns regarding the Park Board. She submitted three petitions totaling 39 signatures requesting that Boards and Commissions be investigative and advisory only. EXECUTIVE ITEMS Executive Louws presented two bid awards. The first was a bid for a bridge truck to go to McDonald Industries for the net amount of $67,338.65, with trade -in. The County will be trading in four old units. Van Zanten reported the Finance Committee /ecommended acceptance of the bid. She so moved. Motion passed. The second bid was for the construction of Bertrand Creek Bridge, No. 47 to go to One -Way Construction, Inc. in the amount of $174,676.50. Van Zanten reported the Finance Committee recom- mened acceptance of the bid. She so moved. Motion passed. Executive Louws also presented an agreement to be entered into with URS Company for the purpose of providing a restora- tion and management study of Lake Whatcom. Van Zanten reported the Finance Committee had received the agreement only. Van Zanten so moved to authorize the Executive to enter into said agreement and also to recommend that the Finance Committee include the County's cash contribution of $7,400 into the 1983 Budget. Bill Trimm, Planning Director, reported the Council will receive monthly updates of the project in 1983. Motion to enter into agreement passed. J Van Zanten also moved to authorize a line item transfer in the Developmental Disabilities Fund in the amount of $13,041.50. She reported the Finance Committee recommended the transfer be authorized. Motion passed. Whatcom County Council Minutes November 18, 1982 page two -- Hansey excused himself from the meeting. -- Executive Louws presented a new draft of the Resolution accepting the Nor -Bell Wastewater Facility Plan, map of service area, sewer connection agreement, and agreement with Ferndale. He stated if the County 4ccepts. this plan it will need to subsidize the project in the amount of $10,000 for a period of 15 years. This matter will be dealt with at a special council meeting of Monday, November 22, 1982 at 7:00 p.m. HFQRTNaR -- Hansey re- entered the meeting -- Hearing was declared open on.Whatcom County's proposed 1.983 Road Construction Program. The following testimony was given: Ciro Paoll.o -Spoke to the construction of the 3912 Cabrant Road Cabrant Road. Problem with dust. Also a problem with the road freezing in the winter and the water run -off. He submitted a letter from John and Jean Westgate, stating support for the paving of the Cabrant Road. Jim Engels, President -Spoke to the repair of the Sumas Mount Baker Foothills Kendall Road. Chamber of Commerce John Westergreen -Spoke to slide area on road. 4873 South Pass Road Lee Denke - Requested the County fix the Mount Vernon exact location of the Whatcom Connector. Submitted a copy of a letter to Council dated August 18, 1982. David Pierce -Spoke to road safety. Painting of Reese Hill Road the roads should be done in the fall instead of the spring so the lines and such show up better in the winter. Clifford Rohrbacher -Spoke to a road that services 20 Lummi Island homes in the Willows Area. Submitted pictures of the road. Tom Isenhart -Spoke to the Sumas Kendall Road. 8295 Kendall Road The LTI trucks have degraded the road. Rue Grove - Commented on condition of Sumas Kendall 7609 Kendall Road Road. LTI trucks have caused damage to road. Money needs to be put back into the roads. Road employees have already been reduced approximately 30 %. -Spoke to Sumas Kendall Road. -Put more money in the road fund. -When eliminating positions do so by the efficiency of each department. - Concurred with Clifford Rohrbacher. Roads are in bad condition. No further testimony was given and the hearing was closed. The matter will be before the Public Services Committee at a meeting November 24, 1982 at 1:30 p.m. Hearing was declared open on the Ordinance regarding the matter of changing yield signs to stop signs in the Geneva Area. No testimony was received and the hearing was closed. Johnson reported the Law and Justice Committee recommended "do pass" of the ordinance with an amendment in items 4, 5, and 6 to change "Madison street" to " "Morgan Street ". Johnson so moved to final passage of the ordinance. Johnson moved to amend said ordinance as recommended by the Law and Justice Committee. Motion to amend passed. Motion for final passage as amended passed on a 6 -0 vote (Cole out). Hearing was declared open on the Ordinance to establish speed limits on certain County Roads. No testimony was received and the hearing was closed. Johnson reported the Law and Justice Committee Whatcom County C ncil Minutes November 18, 1982 page four recommended "do pass" of the ordinance. Johnson so moved the ordinance for final passage. Motion passed on a 6 -1 vote (Cole out) . ✓ Hearing was declared open on the Ordinance to establish speed limits on certain portions of Silver Lake Road. Jim Engels suggested that there be some kind of law enforcement in the area. Johnson will check with the Sheriff on this. No- further testi- mony was given and the hearing was closed. Johnson stated the Law and Justice Committee recommend "do pass" of the ordinance. Johnson so moved the ordinance for final passage. Motion passed unanimously. Hearing was declared open on the Ordinance to establish speed limit on a portion of Marine Drive. No testimony was received and the hearing was closed. Johnson reported the Law and Justice Committee recommend "do pass" of the ordinance. Johnson so moved the ordinance for final passage. Motion passed unanimously. Hearing was declared open on the Ordinance regarding the matter of modifying the stop sign control at the intersection of Brown Road and North Star Road. No testimony was received and the hearing was closed. Johnson reported the Law and Justice Committee recommended "do pass" of the ordinance. Johnson so moved the ordinance for final passage. Motion passed unanimously. V Hearing was declared open on the Ordinance to establish speed limit on a portion of Grandview Road. No testimony was received and the hearing was closed. Johnson reported the Law and Justice Committee recommend "do pass" of the ordinance. Johnson so moved the ordinance for final passage. Motion passed unanimously. FINAL CONSIDERATION OF ORDINANCES Van Zanten moved for final passage the Ordinance of the Whatcom County Council of Whatcom County, Washington, authorizing the acquisition, construction and installation of an exposition Whatcom County sncil Minutes November 18, 1982 page-five building on the grounds of the Northwest Washington County Fair and the repair and replacement of County roads and drainage facilities; providing for the issuance and sale of limited tax levy general obligation bonds of the County in the principal sum of $1,300,000; providing the date, form, terms and matur- ities of said bonds; providing for the annual tax levy of taxes to pay the principal of and interest on said bonds; and providing for the sale thereof. Van Zanten reported the .Northwest Washington Fair Board wishes to install an exposi- tion building in the amount of $400,000, of which $300,000 will be provided from the County through the sale of said bonds. The other $1,000,000 will go toward the County roads. Van Zanten moved to amend the ordinance on page one, the paragraph "NOW, THEREFORE, BE IT RESOLVED" to change the word "RESOLVED" to "ORDAINED ", and on page three to insert at the botton a new section "D" as follows: "Any work authorized by this ordinance for which the cost estimated herein is $50,000.00 or more shall be contracted out to private firms through the applicable bid procedures contained in Whatcom County Code Chapter 3.08." Motion to amend the ordinance passed. Motion to adopt the ordinance as amended passed on a 6 -1 v to (Hawley). t/ Van Zanten moved for final passage the ordinance amending Ordinance No. 82 -68 imposing a sales and use tax pursuant to R.C.W. 82.14.030(2). Van Zanten moved to accept the substitute draft. Motion passed to accept the draft. Van Zanten reviewed the changes to the ordinance made by the Finance Committee. Hansey moved to.amend the ordinance in Section 2 to change the rate of the tax from "five- tenths (5/10)" to "two - tenths (2/10) ". Motion to amend failed. Motion to adopt the substitute ordinance passed on a 4 -3 vote ( Hansey, Johnson, Hawley). Whatcom County incil Minutes November 18, 1982 page six The ordinance imposing an excise tax on-the use of tele- phone access lines for the purpose of funding an emergency service communication system was held in Finance Committee. The ordinance will be scheduled for a Special Council meeting on; Monday, November 22, 1982. Van Zanten moved for final passage the ordinance author- izing a revised budgt for Federal Shared Revenue Fund. She reported the Finance Committee recommended "do pass" of the ordinance. Motion passed unanimously. V/ Van Zanten moved for final passage .the ordinance authorizing reimbursement from the Building Maintenance Fund, County Supply Fund, Motor Pool Fund and the Current Expense Fund to the Federal Shared Revenue Fund. She reported the Finance Committee recommended "do pass" of the ordinance. Motion passed unani- 76usly . Van Zanten moved for final passage the ordinance author- izing a revised budget for the Current Expense Fund Board of Equalization budget. She reported the Finance Committee recom- 7 me'ded "do "pass" of the ordinance. Motion passed unanimously. J Van Zanten moved for final passage the ordinance author- izing a revised budget for the Mental Health Fund of 1982. She reported the Finance Committee recommended "do pass" of the ordinance. Motion passed unanimously. ✓ Van Zanten moved for final passage the Ordinance establishing a reasonable fee for copies of the budget and portions thereof. She reported the Finance Committee recommended "do pass" of the ordinance with an amendment to add a repealer section. Van Zanten so moved to amend the ordinance to add 'CBE IT FURTHER ORDAINED that Ordinance No..82 -86 is hereby repealed." Motion to amend passed. Motion to adopt the ordinance as amended passed unanimously. The ordinance amending the Whatcom County Zoning Ordinance, Chapter 2.24 of the Whatcom County Code, in order to allow Recreational Vehicle Parks and Campgrounds as a Conditional Use in the S4 Zone was held in Planning and Development Committee. Whatcom County -,uncil Minutes November 18, 1982 page seven Hansey introduced and moved for final passage a resolution in the matter of amending the zoning ordinance to provide for recreational vehcile parks and campgrounds in the S4 zoning district. This resolution will set a public hearing on the said matter for December 16, 1982. Motion passed. OTHER BUSINESS Eii�mett Gaxbett gave a report regarding Crisis Services. He reviewed the services provided and the accomplishments of the 1982 year. He reviewed projects for 1983. i/ Open Space applications of Alan F. Bell and Dennis R. Lenssen were received and referred to the Planning Commission for review. Correspondence was received from the City of Bellingham requesting that the County consider dissolution.of Whatcom County Sewer Improvement District No. I. Hansey moved to forward the correspondence to Executive Louws and.request him to proceed with the analysis of said matter and to report back to Council. Motion passed. INTRODUCTION OF RESOLUTIONS AND ORDINANCES Van Zanten moved to add the following to the agenda: 1) Ordinance establishing Whatcom County Ferry Rates for 1983 2) Ordinance amending Whatcom County Code, Section 8.12.010, regarding the fee schedule for Senior Citizens for solid waste disposal at all Whatcom County solid waste sites 3) Ordinance amending Whatcom County Code Chapter 15.04 by modifying Section 15.04.110'and Chapter 15..08 by modifying Sections 15.08.080, 15.08.170, and 15.08.220 amending permit fees for building, plumbing and mechanical permits and amending and establishing fees and charges in accordance with R.C.W. 19.27.100 and R.C.W. 19.27.110 4) Ordinance establishing a tax refund fund Motion passed. Hansey moved to add to the agenda an ordinance amending Ordinance No. 82 -68 imposing a sales and use tax pursuant to R.C.W. 81.14.030 (2). Motion passed. Whatcom County Cou —il Minutes November 18, 1982 page eight Van Zanten introduced a resolution on capital improvement projects related to buildings and facilities for Whatcom County, Washington.and it was referred to the Public Services Committee. Hansey introduced and moved for final passage a resolution approving an amendment to Whatcom County Sewer District No. 2's Comprehensive Plan in accordance with that District's Resolution No. 20. Hansey reported the Planning and Development Committee recommended passage of the resolution. Motion passed. The resolution regarding the Nor -Bell Wastewater Facility Plan will be considered at a Special Council meeting of Monday, November 22, 1982. Cole introduced an ordinance extending the franchise of Nationwide Cablevision for a period of one (1) year and it was referred to the Public Services Committee. Roehl reported the appellant of the Builder's Administrative Appeal requested the Council to allow oral argument. Cole so moved to allow oral argument. Motion passed. Johnson reported the Engineer is negotiating with the School Board regarding the school crossing light in the Geneva Area. Meeting adjourned at 10:31 p.m.
