HomeMy WebLinkAboutCounty Council for May 20 1982WHATCOM COUNTY COUNCIL May 20, 1982 Minutes The Whatcom County Council was called to order by Chairman Roehl at 7:30 p.m. with all members present. The minutes of the May 6, 1982 Council meeting were approved with corrections speci- fying the vote for ordinances under Final Consideration. OPEN SESSION Opportunity was given for interested parties to speak on the Emergency Telephone System resolution. Due to a mailing omission, the resolution was not sent to the County Fire Districts. No one came forward. EXECUTIVE ITEMS The over -limit transfer for the Road Fund was before the Council for consideration. The transfer included line -item transfers under Revenue changes in the amount of $159,000, and line -item transfers under Expenditure changes in the amount of $1,121,500. Hansey moved to authorize the transfers as requested by the Executive. Motion carried. The appointment to Consolidated Drainage Improvement District #21 was before the Council. Executive Louws withdrew his original recommendation of Dan Noteboom. due to Noteboom's residence being outside the district, and requested that Council confirm the appointment of Jake DeHoog, 7357 Everson - Goshen Road. Iluenscher moved that Council confirm the appointment of Jake DeHoog to Drainage Improvement District #21 as requested by the Executive. Motion carried. Executive Louws stated that the Nor -Bell Interceptor and Ferndale Wastewater Treatment Plant Upgrade evaluation package has been submitted to the Council. He requested that it be reviewed by the appropriate committee and returned to Council for decision at the meeting of June 3, 1982. Chairman Roehl stated that he would schedule a meeting of the Committee of the Whole to review the package. FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES The Chair deleted items nos. 5 and 6, the ordinance and Whatcom G,,anty Council May, 20; 1982 Minutes - page two resolution relating to burglary alarm systems, from the agenda, as the ordinance is scheduled for public hearing June 3, 1982. Hansey moved for final passage the resolution approving amend- ments to Whatcom County Water District No. 10's Comprehensive Plan, in accordance with that District's Resolution No. 352, dated April 7, 1982. He presented the Planning and Development Committee's recommendation of "do pass ". The resolution relates to water reservoirs for Eagle Ridge development. Motion for final passage carried. Hansey moved for final passage the resolution approving amend- ments to Whatcom County Water District No. 10's Comprehensive Plan, in accordance with that District's Resolution #353, dated April 7, 1982. He'presented the Planning and Development Committee's recommendation of "do pass." The resolution relates to sewer systems for Eagle Ridge development. Motion for final passage carried. Van Zanten moved for final passage the resolution establishing personnel policies and procedures for Whatcom County employees. She further moved acceptance of Draft 2 as amended at the May 12, 1982 meeting of the Committee of the whole. Motion carried. Motion for final passage of amended Draft 2 of the resolution establishing personnel policies and procedures carried. Van Zanten moved for final passage the ordinance amending Ordinance No. 80 -8, adopted February 7, 1980; and repealing Chapters 2.60 Vacations; 2.62 Sick Leave; Sections 2.64.010 and 2.64.020 Employees, Miscellaneous Provisions; and Chapter 1.15, Ordinance establishing merit system for employees of Department of Public Works, of the Whatcom County Code. She further moved for acceptance of amended Draft 2 of the ordinance. Motion carried. Cole moved to delete page 2 Section D regarding the exemption of the Prosecuting Attorney's Office. He stated that he had read copies of the State Constitution regarding this matter and was not convinced that the position of the Prosecuting Attorney's Office had been satisfactorily determined. Van Zanten and Muenscher felt that the issue had been dealt with previously and that there was no need for reconsideration. Roehl and Johnson agreed with Cole. Hansey moved to postpone Whatcom county Council May 20, 1982 Minutes - page three consideration of the ordinance until June 3, 1982, giving the Prosecuting Attorney's Office opportunity to justify their position in relation to this matter. Motion to postpone carried. The Council then discussed item no. 7 on the Agenda, the ordinance altering the boundaries of electoral precincts within Whatcom County. Cole moved the ordinance for final passage. Joan Ogden, Auditor, explained that five new precincts have been formed. The City of Bellingham passed the ordinance last week, and no conflicts have been encountered. Both political parties concur with the alterations. Motion for final passage of the ordinance altering the bound- aries of electoral precincts carried unanimously. Van Zanten moved for final passage the ordinance authorizing a revised budget for the Prosecuting Attorney Budget within the Current Expense Fund. She presented the Finance Committee's recommendation of "do pass." She explained that the original 1982 budget had been in the amount of $18,500. The Prosecuting Attorney is requesting an additional $23,500. at this time which he expects to cover projected 1982 costs for Professional Services, including negotiations with Seattle City Light ($17,000); a court appointed lawyer for Mrs. Bertha Collier ($5,050.); and the costs for a special deputy in regard to the McIntyre case. Motion for final passage carried by unanimous vote. Van Zanten moved for final passage the ordinance revising the Alcoholism Program Fund to encompass the COSMOS Program. She presented the Finance Committee's recommendation of "do pass" and further moved to amend the revenue figures to read as follows: 0123 -0444 Alcoholism Program Fund Revenue 301 Beginning Fund Balance $22,311.88 334- 67 -00 -13 Community Alcohol Center 11,466.12 346 -90 -19 COSMOS Client Fees 36,000.00 $69,778.00 Motion to amend carried. Motion for final passage of the ordinance revising the Alcoholism Program Fund carried by a vote of 6 -0 (Muenscher). Whatcom ._ounty Council May 20, 1982 Minutes - page four OTHER The Bid Award for official printing of legal ads for Whatcom County was before the Council for consideration. Van Zanten stated that the one legal bid is from the Bellingham Herald. The prices are the same as in the previous bid submitted by the Herald; 7 point type; 10 lines per column inch; but a column width of 7.3 instead of 9.5 ems. The rates are up 15 %. Van Zanten presented the Finance Committee's recommendation to authorize the Auditor to accept the bid and to approve the contract for official printing of legal ads for Whatcom County with the specification that the column width remain 9.5 ems. She so moved. Motion carried. The decision regarding Preliminary Plat approval of Peaceful Valley Division 2 was before the Council for consideration. Hansey moved that the following amendments be added to the decision: 1. Page 29 Section 3 (3): add "except adjacent to the golf course, where pedestrian access shall be provided between golf holes." 2. Page 29 Section 3 (4): add "except for lots 97 -113 and 116 -142 of Phase V." 3. Page 37 #47: add "except as provided by variance." Motion to amend carried. Hansey further moved for approval of the Preliminary Plat of Peaceful Valley Division 2 as amended. Motion carried. Item no. 4, the decision regarding the Shoreline Amendments appeal, was before the Council. Cole introduced and moved for final passage the resolution in the matter of amendments to the Shoreline Management Program of Whatcom County, declaring poli- cies relating to industrial and commercial development and assigning duties to the Planning and Development Committee. Van Zanten moved to amend page 3, striking the three lines following "Prosecuting Attorney." Hansey moved to amend Van Zanten's motion by striking the words "members of the" from lines 1 and 2 of page 3. Motion carried. Chairman Roehl brought the Council's attention to his two resolutions which are simply Cole's resolution divided into two separate resolutions. Whatcom county Council May 20, 1982 Minutes - page five Motion for final passage of the resolution regarding the Shoreline Amendments appeal carried by a vote of 5 -2 ( Roehl and Muenscher). Nominations were opened for the Public Defender Advisory Committee (Council member). Muenscher nominated Cole. Nomina- tions closed. Cole was appointed by unanimous vote. v Nominations were opened for the Public Defender Advisory N Committee non - lawyer member. Cole nominated Dr. Hugh Fleetwood, 1003 17th St., Bellingham. Nominations closed. Dr. Fleetwood was appointed by unanimous vote. The Planning Commission referral of Council amendments to the Comprehensive Plan and Zoning Ordinance Title 20 related to the Lake'Whatcom Subarea were received by the Council. The Planning Commission chose not to hold public hearing. Chairman Roehl scheduled Public Hearing for Wednesday, June 9, 1982 at 7:30 p.m. for Council's proposed changes in the Plan. The Hearing Examiner's recommendations regarding Preliminary Plat approval of Birch Crest Terrace were received and referred to the Planning and Development Committee. The petition requesting vacation of a lot line in the Plat of Sudden Valley filed by James L. and Judith E. Miller was received and referred to the Planning and Development Committee. Item no. 9, the application regarding appeal of the Hearing Examiner decision on shoreline permit of Point Roberts Yacht Basin was deleted from the agenda at the request of the attorney representing the appellant. INTRODUCTION OF RESOLUTIONS 'AND ORDINANCES Cole introduced and moved for.fiiial passage the resolution in the matter of submitting to the voters a proposal to fund an emergency telephone system (911). He presented the Public Services Committee's recommendation. The audience was again given opportunity to speak on this issue. No one spoke. Van Zanten commended Jan Leonardo, Clay Durbin, Sheriff Mount, and members of the 911 Task Force for their work in this matter. Changes to Exhibit A were pointed out, including a statement Whatcom county Council May 20, 1982 Minutes - page six that Council intends to levy the maximum amount of 500 per tele- phone access line. Cole presented a letter from Shirley Travenshek in support of the resolution. Motion for final passage of the resolution carried. Cole introduced and moved for final passage a resolution in the matter of changing County Road No. 115 to "Bear Creek Lane." He presented the Public Services Committee's recommendation of "do pass." Motion carried. Van Zanten introduced and moved for referral to the Finance Committee items nos. 3 -6 on the agenda: 3) Ordinance authorizing a revised budget for the Grant Management budget within the Current Expense Fund 4) Ordinance authorizing a revised budget for the Planning budget within the Current Expense Fund 5) Ordinance adopting a supplemental budget for the Public Works Department Road Fund 6) Ordinance as provided in Article 6, Section 2.72 of the Home Rule Charter and R.C.W. 36.40.190 and authorizing an emergency appropriation from the 1982 Federal Shared Revenue Fund to be expended for a portion of the cost relating to the Nor -Bell Wastewater Facility Plan and authorizing a revised budget to the 1982 Federal Shared Revenue Fund in the amount of $5,000. Motions carried for all of the above. Van Zanten moved to add to the agenda the resolution in the matter of the hearing on Whatcom County's Six -Year Comprehensive Road Plan. Motion carried. Van Zanten introduced and moved for final passage the above - mentioned resolution. Motion carried. COMMITTEE REPORTS Hansey presented a letter from seven members of the Health Board, including himself, to Roehl and Louws regarding the consolidation of social services. He moved to refer the matter to the Public Services Committee. Motion carried. Johnson reported for the Law & Justice Committee's meeting. Hansey reported that a matter regarding lot lines in the Ferndale - Cherry Point Subarea will be discussed at the next meeting of the Planning and Development Committee. . Whatcom county Council May 20, 1982 Minutes - page seven Chairman Roehl read a letter from the Point Roberts Community Association to Council members inviting them to its annual meeting Wednesday, May 26, 1982. Meetings of the Public Services and Planning and Development Committees were scheduled for 3:00 p.m., Wednesday, May 26th. The Committee of the Whole will meet at 4:00 p.m. on the 26th to discuss "Raspberry Ridge Golf Community." Hansey requested that Bruce Disend be present at the Planning & Development Committee meeting. Roehl scheduled a Committee of the Whole meeting to discuss Mental Health funding cuts for June 8, 1982 at 7:30 p.m. The Lake Whatcom Public Hearing will be June 9, 1982, at 7:30 p.m. Meeting adjourned 9:35 p.m. Next regularly scheduled meeting of the County Council June 3, 1982.
