Minutes
The Whatcom County Council meeting of Thursday, June 3, 1982 was
called to order by Chairman Roehl at 7:34 p.m. with all members present.
Also present were Paul Rushing, Public Works Director, and Ed Henken,
County Engineer.
The minutes of the May 20, 1982 Council meeting were approved as
presented.
EXECUTIVE ITEMS
The nominations were opened for appointments to the Northwest
Senior Services Board. Hawley moved that Council nominate Van Zanten
and cast a unanimous ballot. Nominations closed. Van Zanten was re-
appointed for a term from July 1, 1982 to June 30, 1985.
Nominations for the second position will remain open until the
next Council meeting.
Council approved the Bid Award for Northwest Washington Fair premium
books as presented by the Executive and recommended by Bob Thomas,
County Purchasing Agent, to Union Printing Company of Bellingham, in
the amount of $3,600.18 including taxes.
HEARINGS
Hearing opened on Whatcom County's Six -Year Comprehensive Road
Program. No testimony was given for or against and the hearing was
closed. Rushing commented that the Planning Staff has not yet reviewed
the Program, and requested that the Council defer their decision for
two weeks. Cole moved for referral to the Public Services Committee.
Motion carried.
Hearing opened on,the ordinance relating to the regulation of
privately -owned burglary or robbery alarm systems, establishing permit
requirements; and prescribing fees and penalties. No testimony was
given for or against the ordinance and the hearing was closed. Johnson
presented the Law and Justice Committee's recommendation of "do pass."
He so moved. Motion carried by unanimous votd.
Hearing opened on the ordinance regarding the matter of modifying
the stop sign control at the intersection of Bennett Drive and Airport
Drive. No testimony was given for or against the ordinance and the

hearing was closed. Johnson presented the Law and Justice Committee's
recommendation of "do pass." He so moved. Motion carried unanimously.
Hearing opened on the ordinance regarding the matter of changing
a stop sign control at the intersection of Seacrest Drive and Sunrise
Road, Lummi Island. No testimony was given for or against the ordinance
and the hearing was closed. Johnson presented the Law and Justice
Committee's recommendation of "do pass." He so moved. Motion carried
by unanimous vote
FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES
Johnson moved for final passage the resolution relating to robbery
and burglary alarm regulations and setting an annual fee for monitoring
service and false alarms. He presented the Law and Justice Committee's
recommendation of "do pass." Motion carried.
The ordinance amending Ordinance No. 80 -8, adopted February 7,
1980; and repealing Chapters 2.60 Vacations; 2.62 Sick Leave; Sections
2.64.010 and 2.64.020 Employees, Miscellaneous Provisions; and Chapter
1.15, Ordinance establishing merit system for employees of the Depart-
ment of Public Works, of the Whatcom County Code, was before the Council
for final consideration.
Cole moved for final passage and also moved to amend page 2 by
deleting lines 22 and 23 and substituting "Deputy Prosecuting Attorneys."
He commented that State Law supports the exemption of Deputy Prosecuting
Attorneys but not others of the staff.
Motion to amend carried.
Motion for final passage of the amended ordinance carried unanimously.
Van Zanten moved for final passage the ordinance authorizing a
revised budget for the Grant Management Budget within the Current Expense
Fund. She presented the Finance Committee's recommendation of "do pass."
She commented that the County Grants Department is administering the
HUD Community Development Block Grant for the City of Blaine. Motion
for final passage carried.
Van Zanten moved for final passage an ordinance authorizing a
revised budget for the Planning Budget within the Current Expense Fund.
She presented the Finance Committee's recommendation of "do pass,:,' The
ordinance incorporates funding in the amount of $28,000 for the Small -
Scale Hydro Power Project into the Planning Budget. Motion for final
passage carried unanimously.

Van Zanten moved for final passage the ordinance adopting a supple-
mental budget for the Public Works Department County Road Fund. She
presented the Finance Committee's recommendation of "do pass." Motion
carried unanimously.
Van Zanten moved for final passage the ordinance authorizing a
revised budget in the Federal Shared Revenue Fund to provide funding
for the final phase of the Nor -Bell Wastewater Facility Plan. She pre-
sented the Finance Committee's recommendation of "do pass." The funds
are for paying Harper -Owes for preliminary work done on the Nor -Bell
Plan. Motion carried by a vote of 6 - 0 (Hansey abstained due to a
possible conflict of interest).
OPEN SESSION
Rosemary Flora asked the Council about the ordinance relating to
board appointments. Cole responded that the ordinance is being re- drafted.
OTHER
The decision regarding Preliminary Plat of Raspberry Ridge Golf
Community was before the Council for consideration. Muenscher was
excused (3/18) due to a conflict of interest.
Van Zanten moved that Council uphold the Hearing Examiner's recom-
mendation for denial of the Preliminary Plat. She commented that she
considers the proposal well - planned, but feels that the urban /rural
compatibility issue has not been satisfied, and that the project is not,
therefore, in the best long -term interest of the public.
After further discussion, motion failed.
Hansey moved to remand the preliminary plat approval to the Hearing
Examiner.
Van Zanten commented that a density of one unit per acre would be
appropriate only if suburban policies were satisfied.
Hansey moved to remand the application to the Hearing Examiner and
request that he review the application as expeditiously as possible in
regard to:
1) those areas which require variances or conditional use permits,
and in regard to standards for variances and conditional use
permits
2) suburban policies, particularly that of compatibility �'•�
3) Building and Codes memorandum received by Council subsequent to
the Hearing, relating to clustering

limit should be specified).
The decision regarding Preliminary Plat approval of Birch Crest
Terrace was before the Council for consideration. Hansey presented the
Planning and Development Committee's recommendation for preliminary plat
approval subject to the conditions as set forth by the Hearing Examiner.
He so moved. Motion carried.
The decision regarding the Nor -Bell Wastewater Facility Plan final
phase was before the Council for consideration. Hansey was excused due
to a possible conflict of interest.
Steve Carlin, Department of Ecology Grants Administration, stated
that June 4 is the deadline for the priority list. He suggested that the
application be filed no later than August 15, 1982, as the project must
be underway by October 1, 1982.
Rushing stated that the allocation of grant monies was made on
submittal of the preliminary application, which has already been done.
Carlin suggested that the Council consider requesting supplemental
grant monies.
Harper suggested that the Council decide on a project plan by or
before July 1, 1982 in order to allow time for negotiations with the
City of Ferndale and other public entities involved.
Johnson moved to tentatively approve Alternative #3 which has a
total project cost of $2,305,000. Tentative approval will authorize
the Public Works Director to enter into negotiations with the various
entities involved (City of Ferndale, Nor -Bell Nursing Home, Ferndale
School District, Whatcom Community College, and the Rural Library),
and to establish more definite revenue projections for repayment of the
Councilmatim.bond. The Council would reserve the right to grant final
approval subsequent to receipt of that information.
Motion carried by unanimous vote. Hansey re- entered the meeting.
The application requesting Open Space classification filed by ,
Alvin and Pauline Ash was received and referred to the Planning Commission.
Johnson left the meeting.
Correspondence was received from Jack D. Hills regarding his resigna-
tion as Supervisor of Drainage District No. 7 to be effective June 1,
1982. Chairman Roehl referred the matter to the County Executi4e.
Correspondence from Birch Bay residents in regard to parking and
other problems was received. Muenscher reported that the Law and Justice
Committee will be meeting on this matter with the local and State Parks

Departments in two weeks.
INTRODUCTION OF RESOLUTIONS AND ORDINANCES
Van Zanten introduced and moved for final passage the resolution in
the matter of the sale of Whatcom County Surplus property and the setting
of a date for public hearing thereof pursuant to the Revised Code of
Washington 36.34.020. Motion carried.
Cole introduced and moved for referral to the Law and Justice
Committee the ordinance establishing a Prosecuting Attorney's Victim/
Witness Fund. Motion carried.
COMMITTEE REPORTS
There were no committee reports.
Hawley reported that the Rate Review Board for Delta Cable Television
will be meeting June 14 at 7:00 p.m. in the Whatcom County Courthouse.
Chairman Roehl commented that the Committee of the Whole will be
meeting June 8, 1982 at 7:30 p.m. to discuss funding cuts to the County
Mental Health program.
A public hearing will be held June 9, 1982 at 7:30 p.m. in the
Council Chambers regarding suggested amendments to the proposed Lake
Whatcom Subarea Comprehensive Plan and the Whatcom County Zoning Ordinance
Title 20 affecting the Lake Whatcom Subarea.
Next regular scheduled meeting of the Council June 17, 1982.
