HomeMy WebLinkAboutCounty Council for June 17 1982WHATCOM COUNTY COUNCIL Minutes June 17, 1982 The County Council meeting was called to order Thursday, June 17, 1982 at 7 :38 p.m. by Vice -Chair Van Zanten. All members were present with the exception of Chair Roehl., who was out of towm. The minutes of the June 3 meeting were corrected on page one, line nine, delete the word " Hansey" and insert the word "Hawley." The minutes were approved as amended. OPEN SESSION Chuck McCloskey inquired when the Nor -Bell Sewer project would be before the Council. Executive Louws stated it would be presented at the July 1 meeting. EXECUTIVE ITEMS The appointment of the Whatcom County Public Defender was held until the July 1 meeting. Executive Louws presented the proposal for acquiring addi- tional land at Blaine Air Force Station for Whatcom County Parks and Recreation. Louws stated he needed concurrence from Council, authorizing the Executive and the Parks Department to negotiate with GSA to gift the property of 3.69 acres only to the County. This will hold up the bids and revise the bids to include the houses only. Johnson so moved. Muenscher stated he wished to keep one of the houses for the caretaker. Motion passed on a 4 -2 vote. ( Muenscher, Hansey) HEARINGS Hearing was declared open on the vacation of lot line ins the Plat of Sudden Valley filed by J. D. Jones. No testimony' was received and the hearing was closed. Hansey reported the Planning and Development Committee recommended approval of the lot line vacation as per the memo sent from the Prosecuting Attorney's office. The memo was placed on record. HanseA vo moved to approve the vacation of the lot line as per the Pro- secuting Attorney's clarifications. Motion passed unanimously. Whatcom County Council Minutes June 17, 1982 page two Hearing was declared open on the vacation of lot line in the Plat of Sudden Valley filed by J. L. Miller. Donovan Kehrer, Building and Codes Administration, suggested the Council attach a stipulation in the order of vacation to read that no portion of the parcel in question would be able to be sold without concurrence from the County. No other testimony was given and the hearing was closed. Hansey reported the Planning and Development Committee recommended approval of the proposed vacation with the stipula- tion stated by Kehrer. Hansey so moved. Motion passed unanimously. Hansey also moved to incorporate the stipulation that the Final Order of the Jones property be so recorded that no portion of the parcel shall be sold without the County's approval. Motion passed unanimously. FINAL CONSIDERATION OF ORDINANCES The Ordinance establishing a Prosecuting Attorney Victim/ Witness Fund was before the Council for final consideration. McEachran explained that the ordinance will set up a revolving fund to collect monies from the State, of which monies will be eventually used to establish a program to assist victims /wit- nesses, such as counseling. Johnson reported the Law and Justice Committee recommended adoption of the ordinance. Johnson so moved. Motion passed unanimously. OTHER BUSINESS Bid Award - Hawley moved to accept the Bellingham Herald's legal printing bid of $3.29 per column inch, with the column at 7.3 ems width as previously submitted and to authorize the Executive to sign the agreement with the Herald on behalf of the County. Motion passed unanimously. Whatcom County Council Minutes June 17, 1982 page three Council considered the request from the Board of Equaliza- tion to convene the Board early (prior to July 5). Johnson moved.to grant the verbal request of the Board and allow it to convene June 28, 1982 as per R.C.W. 84.46.010, stating the following: "...Provided, further, That the county board of equalization with the approval of the county legislative authority may convene at any time when petitions filed exceed twenty -five, or ten percent of the number of appeals filed in the preceding year, whichever is greater...." Motion passed unanimously. The petition requesting Water District No. 17 to be dis- incorporated was received by the Council. A public hearing will be scheduled. The Request for rate increase to subscribers filed by Whatcom County Cablevision, Inc., was received. Hawley moved to establish a Rate Review Board and designate Hansey to repre- sent the Council. Motion passed unanimously. Correspondence requesting extension of Franchise in the Laurel area, filed by Whatcom County'Cablevision, Inc., was received and sent to the Public Services Committee for review. Hawley left the meeting at 8:17 p.m. The petition for the vacation of a portion of alley in Gallagher's Addition to Sehome was received and sent to the Planning and Development Committee for review. INTRODUCTION OF ORDINANCES AND RESOLUTIONS Hansey moved to add to the agenda a_ Resolution declaring the intention of Whatcom County to withdraw from membership in the Whatcom County - Bellingham Public Health District. Motion passed on a 4 -1 vote. (Johnson) Whatcom County Council Minutes June 17, 1982 page four Johnson introduced the following ordinances, which were unanimously referred to the Law and Justice Committee for review: 1) Ordinance to establish speed limits on certain County Roads (Blaine Road, East Bakerview Road, and Vista Drive) 2) Ordinance to establish speed limits on Lummi Island Roads 3) Ordinance to increase speed limit on Haxton Way and to change a yield sign to a stop sign on Lummi Shore Drive The above ordinances will also be set up for public hearing. Hansey introduced and moved for final consideration the Resolution declaring the intention of Whatcom County to with- draw from membership in the Whatcom County - Bellingham public Health District. Motion passed unanimously. REPORT OF COMMITTEES Johnson reported the Law and Justice Committee had reviewed the petition for a dog control zone inthe Laurel Grove area. There was question in the committee regarding the size of the area. Johnson moved to set hearing on the proposed zone and have an ordinance brought forward for Council consideration. Muenscher moved to table the matter for four weeks and have the Law and Jus- tice Committee review the original ordinance setting up the dog control zones and establish some size criteria. Motion passed on a 3 -2 vote. (Cole, Johnson) It will be further reviewed by the Law and Justice Committee before further action is taken. Johnson also reported the matter of pathways and bicycle trails in the Birch Bay area was turned over to Roger DeSpain, Parks Department for two weeks. He will report back to the Law and Justice Committee. Cole reported the Public Services Committee will meet June 30, 1982 to discuss the issue of Human Services Program. Meeting adjourned at 8:40 p.m.
