HomeMy WebLinkAboutCounty Council for July 15 1982WHATCOM COUNTY COUNCIL Minutes July 15, 1982 The Whatcom County Council meeting was called to order on Thursday, July 15, 1982 at 7:34 p.m. by Chair Roehl with all members present. The minutes of the July 1, 1982 meeting were approved as presented. EXECUTIVE ITEMS The bid award for the Central Shop Fueling Station was withdrawn from the agenda. This matter will be placed on the August 5, 1982 agenda for consideration. u-P AD TAT(_ C Hearing was declared open on the Ordinance to establish speed limits on Lummi Island. No testimony was given and the hearing was closed. Johnson reported the Law and Justice Committee recommended "do pass" of the ordinance. Johnson so moved for passage. ordinance passed unanimously. Hearing was declared open on the Ordinance to increase speed limits on Haxton Way and to change a yield sign to a stop sign on Lummi Shore Drive. No testimony was given and the hearing was closed. Johnson reported the Law and Justice Committee recommended "do pass" of the ordinance. Johnson so moved for passage. Ordinancepassed unanimously. Hearing was declared open on the Ordinance to establish speed limits on certain County roads (Blaine Road, East Baker - view Road and Vista Drive). No testimony was given and the hearing was closed. Johnson reported that the Law and Justice Committee recommended that in item two, East Bakerview Road, the speed limit should be 40 mph between the Bellingham City Limits and Hannegan Road. Johnson so moved to amend the ordinance on line 15 to strike "James Street Road" and insert "the Bellingham City Limits" and to have the Chair look into corresponding the appropriate sections with this amendment. Motion passed unanimously. Motion to adopt the ordinances as amended passed unanimously. Whatcom County Council Minutes July 15, 1982 page two Hearing was declared open on the Petition requesting vaca- tion of a portion of an alley between Block 9 and Block 10, Gallagher's Addition to Sehome, filed by Thomas R. Rawls, et al. Joseph Dunne, attorney, spoke on behalf of the petitioner. He stated that this portion of alley has never been constructed. The request is being made due to the fact that the petitioner needs additional land on which to build an addition to his present home. He stated that a Mr. Domebroske has requested an easement for access to his property. No further testimony was given and the hearing was closed. Hansey reported the Planning and Devel- opment Committee recommended approval of the vacation. He stated the Planning, Engineering and Building and Codes Departments recommended approval of the vacation. Hansey so moved to approve the vacation contigent upon the filing of an easement for access. Motion passed unanimously. Hawley questioned why a value had not been-placed on the parcel. Hansey stated that the 1880 -1890 law provides for this. Hearing was declared open on the Proposed amendments to the Comprehensive Plan Map and the official Whatcom County Zoning Map affecting the geographic area commonly referred to as Upper Geneva. Mr. Lee Denke, Mount Vernon, owner of 160 acres in the area made the following comments - All services have been provided to his property to the North - Cedarhills plat will bring more roads into the area - Property has a benched slope, ideal for building - Property has been under one ownership - Low density zoning increases the home building cost - Against Interim Zoning - Would like his property designated Urban Reserve No further testimony was given and the hearing was closed. Whatcom County L. ,uncil Minutes July 15, 1982 page three FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES Van Zanten stated that the first two ordinances regarding the Lake Whatcom Subarea are to be replaced with two newly re- written ordinances. Van Zanten so moved that the two ordinances be tabled indefinitely. Motion passed unanimously. The two new ordinances will be addressed -under Introductions later in the meeting. Hansey moved for final passage of the Ordinance extending the existing Interim Zoning Ordinance, adopted on July 6, 1982, to July 15, 1984. Roehl explained that the previous emergency ordinance was only temporary and expired in a two week period. Motion to adopt the ordinance passed on a 6 -1 vote. (Hawley) Van Zanten moved for final passage the Ordinance authorizing the distribution of Public Utility District Privilege Tax Revenues. Van Zanten stated the Finance Committee recommended "do pass" of the ordinance. She also explained that these revenues 9xe coming in to the Current Expense Fund. Previously the County distri- buted a portion to the school districts, but this year the State has distributed directly to the school districts. Motion to adopt the ordinance passed unanimously. Van Zanten moved for final passage the Ordinance authorizing a revised budget for the County Alcoholism Fund of 1982. Van Zanten stated the Finance Committee had reviewed the ordinance and recommended "do pass'.'. She stated the revenue increase is due to an increase in private client fees. This is separate from the Cosmo Program. Van Zanten also stated a memorandum was received from James White, Director of Alcoholism Program, explaining the salary category increases. Cole questioned some of the budget line items contained in the ordinance. Cole moved to refer the matter back to the Finance Committee for additional review Motion passed unanimously. Van Zanten moved for final passage the Ordinance authorizing a revised budget for the Juvenile Court /Probation Budget of 1982. Van Zanten stated the Finance Committee reviewed the ordinance and was forwarding it to the full Council without recommendation. Whatcom County Council Minutes July 15, 1982 page four Van Zanten stated that originally the State had sent their own person to fill this Probation Counselor position. Due to other circumstances the State instead has sent the County grant money in the amount of $14,168.00 for the County to hire their own person to fill the position. This person will then be under the County personnel policies as well as the local union contract. She further stated that question arose in Finance as to who would be liable for the payment of the unemployment compensation if the State pulled back their funding and the County discon- tinued the position. Gary Wood, Juvenile Court Probation, addressed the Council saying that the State had rejected the idea and would not take on the responsibility. Wood gave a brief history on the matter. Van Zanten spoke in favor of the ordinance. Motion to adopt the ordinance passed on a 6 -0 vote. (Johnson out) The Ordinance authorizing a revised budget for the Federal Shared.Revenue Fund (Law Library) was before the Council for consideration. Van Zanten stated the Finance Committee is holding this ordinance for an additional two weeks for review. OTHER BUSINESS The petition requesting vacation of a portion of County Road No. 114, filed by Eleanor Nesbitt, et al, was received. Hansey moved to refer the petition to the Planning and Development Committee. Motion passed on a 6 -0 vote. (Johnson out) Applications for Open Space were filed by 1) Phyllis Lockwood, 2) R. Wayne Benson, and 3) Leila McDougal. Hansey moved to refer the applications to the Planning Commission for processing. Motion passed on a 6 -0 vote (Johnson out). Van Zanten reported the Finance Committee had reviewed the 1982 Ferry Rates. She stated that it appears that the rate schedule which Council adopted will be close to generating the sufficient revenue to meet with the 75% of the operating cost. INTRODUCTIONS OF RESOLUTIONS AND ORDINANCES Van Zanten moved to add to the end of the agenda the following: 1) Ordinance authorizing a revised budget for the Law Library Fund 2) Ordinance authorizing a revised budget for the Sheriff budget of the Current Expense Fund Motion passed on a 6 -0 vote (Johnson out). Muenscher moved to add to the end of the agenda the Resolution amending Resolution No. 82 -40, accepting Nor -Bell Wastewater Facility Plan Alternate No. 3. Motion passed on a 6 -0 vote (Johnson out). Van Zanten moved to add to the end of the agenda the.following: 1) Ordinance amending the 1970 Whatcom County Comprehensive Plan Text and map for the geographic area commonly known as the Lake Whatcom Subarea of Whatcom County, Washington 2) Ordinance adopting the official Whatcom County Zoning Ordinance: Text and Map, Title 20 of the Whatcom County Code, for the Lake Whatcom Subarea of the Whatcom County Comprehensive Plan Motion passed on a 6 -0 vote (Johnson out). Hansey introduced and moved for final passage a resolution in the matter of the exemption of County Park property located at Blaine Air Force Base from'the County Zoning Code. This matter had been discussed at the July 1, 1982 meeting. Motion passed on a 6 -0 vote (Johnson out). The following ordinances were introduced by Hawley and referred to the Law and Justice Committee: 1) Ordinance establishing that it shall be unlawful to maintain a disorderly house 2) Ordinance establishing that it shall be unlawful to create a breach of the peace The ordinances will also be set up for public hearing. Whatcom County Cuancil Minutes July 15, 1982 page six Van Zanten introduced the Ordinance authorizing a revised budget to the Law Library Fund. It was referred to the Finance Committee. Van Zanten introduced the Ordinance authorizing a revised budget for the Sheriff budget of the Current Expense Fund and it was referred to the Finance Committee. - - -- Hansey excused himself from the meeting - - -- Muenscher introduced and moved for final passage the Resolution amending Resolution No. 82 -40, accepting Nor -Bell Wastewater Facility Plan Alternate No. 3. This amendment will change the review of the connector agreement and related material from the Finance Committee to a Committee of the Whole. Motion passed on a 6 -0 vote (Johnson out). A Committee of the Whole will be scheduled for July 16, 1982 at 7:30 a.m. Van Zanten introduced the following and they were referred to the Planning and Development Committee: 1) Ordinance amending the 1970 Whatcom County Comprehensive Plan Text and map for the geographic area commonly known as the Lake Whatcom Subarea of Whatcom County, Washington 2) Ordinance adopting the official Whatcom County Zoning Ordinance: Text and Map, Title 20 of the Whatcom County Code, for the Lake Whatcom Subarea of the Whatcom County Comprehensive Plan. Muenscher brought one other item to the Council's attention; the Ordinance to modify the stop sign control at the intersection of Birch Bay - Lynden Road, Harborview Road and Morgan Drive. This was received at the Law and 9ustice Committee from the Public Works Administration. This is a matter which needs immediate attention and should, be an emergency ordinance. It was questioned as to whether or not a public hearing is required on the ordinance before adoption. The Chair will consult the Prosecuting Attorney's Office. Hansey moved to add the ordinance to the agenda and consi- der it immediately. Motion passed on a 6 -0 vote (Johnson out). Hansey moved to amend the ordinance on line 16 to insert the standard emergency clause. Motion to amend passed on a 6 -0 vote (Johnson out). Hansey moved for final passage of the ordinance ,V.. Whatcom County Council Minutes July 15, 1982 page seven as amended, subject to confirmation from the Prosecuting Attorney's Office. Motion passed on a 6 -0 vote (Johnson out). COMMITTEE REPORTS Roehl stated that the matter of disincorporation of Water District No. 17 has been turned over to the County Auditor. Roehl stated a Committee of the Whole has been set for July 20, 1982 at 7:30,p.m. to discuss the 1983 budget. A Committee of the Whole has also been set for July 16, 1982 to discuss Nor -Bell.
