HomeMy WebLinkAboutCounty Council for August 19 1982WHATCOM COUNTY COUNCIL Minutes August 19, 1982 The Wh.atcom County Council meeting was called to order on Thursday, August 19, 1982 at 7 :34 p.m., by Chair Roehl with all members present with the exception of Hawley. The minutes of the August 5, 1982 Council meeting were approved as presented. OPEN SESSION No one spoke in the opportunity of open session. EXECUTIVE ITEMS Executive Louws presented the bid award for a card acti- vated control system at the Central Shop. He recommended the bid be awarded to Ace Tank and Equipment Company in the amount of $17,771.09. Van Zanten reported the Finance Committee recommended acceptance of the bid as presented by the Executive. Van Zanten so moved to authorize the Executive to accept the bid of Ace Tank and Equipment Company. Motion passed. The Executive presented the following to Council: 1) Preliminary 1983 budget material 2) Proposal regarding Solid Waste Both items will be scheduled for a Committee of the Whole meeting on Tuesday, August 24, 1982, at 7:30 p.m., for review. FINAL CONSIDERATION OF ORDINANCES Van Zanten moved for final passage the Ordinance authorizing a revised budget for the Convention Center Fund of 1982. She stated the Finance Committee reviewed the ordinance and recommended it to the full Council without recommendation. The revision in the amount of $2,540 is for the purpose of printing a visitors map for distribution upon request to tourists. Marvin Wolff, Visitor and Convention Bureau, stated the monies will be used to print a new map with Bellingham on one side and Whatcom County on the other and to attach a visitors guide of County accomodations to the map. The $2,540 will purchase 10,000 copies of the map and attachment. The County has already budgeted $2,900 for the Bureau from a revenue projection of $8 - 9,000. Authorizing this revision would far exceed the 15% Whatcom County Council Minutes August 19, 1982 page two of the County's annual revenue which had been felt to be a fair contribution to the Visitor and Convention Bureau. Cole stated he could take exception with this request. Motion to adopt the ordinance passed on a 4 -2 vote (Van Zanten, Muenscher). Council next considered the Ordinance adopting the official Whatcom County Comprehensive Plan Text and Map, Title 20 of the Whatcom County Code, for the Lake Whatcom Subarea of the Whatcom County Comprehensive Plan. This ordinance had been tabled from the August 51 1982 Council meeting. Roehl stated additional language needs to be inserted into Section 20,89.011 for clarifi- cation of legal right of transfer. Hansey so moved to amend 20 89.011, line two, insert after the word "title ", "or other legal right to transfer density''., Motion passed. Cole moved to amend the ordinance on page two, line 26J, to insert after the word "watershed" the following: "and for those areas located outside the boundaries of the watershed Motion passed. Cole moved to amend the ordinance on page two, line 29, at the end of the sentence to strike the period and insert "and any areas located outside the watershed regardless of urban or non -urban classifications." Motion passed. Cole moved to amend the ordinance on page two, line 32 after.the word "densities" to insert "within the watershed ". Motion passed. Cole moved to amend the ordinance on page three, section 5, line 25, at the end of the sentence to strike the period and insert "and other appropriate areas." It was the consensus of the Council to deal with this as a separate matter. Cole with- drew his motion. The Chair will send a letter regarding this matter to the Planning Commission. , Cole also moved to amend the ordinance on page three, to add a new section 6 to read as follows: "All prior ordinances,are hereby repealed to the extent that they are in conflict with this ordi- nance. " The language will be adjusted as needed by the Prosecuting Attorney's office. Motion passed. Whatcom County )until Minutes August 19, 1982 page three Motion to adopt the grdinance As amended passed unanimously, Cole moved to request the Executive and Planning Depart- ment to produce along with the report regarding Lake Whatcom, County wide design and development performance standards covering drainage, land clearing, road construction and land filling.by. December '31, 1982. Motion passed. The Chair will send a letter regarding this matter. Van Zanten moved for final passage the Ordinance author- izing a revised budget for the Medical Examiner Budget within the Current Expense Fund of 1982. She stated the Finance Committee recommended "do pass" of the ordinance. This $8,800 revision to the Medical Examiner's budget is due to the increase in autopsies performed from January to July. The average cost is $413 per case. Van Zanten stated Snohomish County averages $1,000 per case and King County $1,800 per case. Motion to adopt the ordinance passed unanimously. Van Zanten moved for final passage the Ordinance adopting a revised budget for the County Garage -Shop Construction Fund. The amount of $182,028.65 is $162,028.65 cash balance not budgeted plus•$20,000 interest earned on investments not previously budgeted. Motion to adopt the ordinance passed unanimously. OTHER BUSINESS The request for Preliminary Plat approval to create and develop a subdivision known as Hollinger Replat was before the Council for consideration. Hansey moved to recommend approval of preliminary plat. Roehl stated the Planning and Development Commmittee recommend approval of the plat. Muenscher stated the only amendment to the Hearing Examiner's recommendations was in item 12, page 10,.to read as follows: "Required fire flow shall be provided." Muens-oher so moved to amend the recommendations accordingly. Motion passed. Motion to approve the preliminary plat as amended passed. Whatcom County C.-ancil Minutes August 19, 1982 page four The Open Space applications of Thorstenson Trust I and II, Ash, Hall, and Kerschner were before the Council for considera- tion. Muenscher moved to accept the Planning Commission's recommendations and grant open space classification for Ash, Kerschner, and Thorstenson Trust I and II and to deny the application of Hall. Motion passed. Petition to vacate Drayton Avenue, Brown Avenue, and California Avenue all in Brown's Addition to Blaine, filed by Pat Doran,'et al, was received and sent to the Planning and Development Committee and the necessary departments for review. A public hearing will also be scheduled on the matter. INTRODUCTION OF RESOLUTIONS AND ORDINANMS Hansey introduced and moved for final passage the Resolution for the purpose of providing guidelines to County departments in evaluating design variance request in land use matters. Roehl stated the Planning and Development Committee reviewed this matter and requested the resolution be drafted, recommending "do pass" of the resolution. Motion to adopt the resolution passed. Hansey introduced the Ordinance amending the Whatcom County Shoreline Management Program Section 6.6 and 6.13, Whatcom County Code Title 20, affecting stream control works and to explicitly provide for small scale hydro electrical projects. The ordinance was referred to the Planning and Development Committee. Van Zanten introduced the ordinance in the matter of grant- ing a non - exlcusive franchise to Nationwide Cablevision, Inc., for a period of Twenty -five (25) years or from December 22, 1982 to December 21, 2007 pursuant to State Law, Section 9.30 of the Whatcom County Home Rule Charter, to operate and maintain a cable communication system within the unincorporated areas of Whatcom County. The ordinance was referred to'the Public Services Committee for review. A public hearing will also be set on this matter. Whatcom County ( mci1 Minutes August 19, 1982 page five COMMITTEE REPORTS Roehl stated the ordinance amending subdivision regulations and subdivision laws was sent to the Planning Commission for review. Johnson:reported the Law and Justice Committee had reviewed several items as follows: 1) Ordinance to modify the stop sign control at the intersection of Birch Bay - Lynden Road, Harborview Road and Morgan Drive Committee recommended "do pass ". The ordinance is scheduled for public hearing September 2, 1982. 2) Ordinance establishing certain acts of trespass as infractions and establishing penalties therefor. Committee tabled this ordinance until further infor- mation was received. Public hearing will be held on the ordinance September 2, 1982. 3) Ordinance creating County Dog Control Zone No. 3 in the area of Woodlawn Cemetery and the Plat of Laurel Grove in Whatcom County. Committee forwarded the ordinance to Council with- out recommendation. A public hearing will be held on the ordinance September 2, 1982. Cole reported the Public Services Committee would meet on Wednesday, August 25, 1982 at 3:00 p.m. to discuss cable franchises and Human Services Program. Muenscher moved to excuse Johnson from the next Council meeting of September 2, 1982 due to a Jail Commission meeting. Motion passsed. Meeting adjourned at 9:15 p.m.
