HomeMy WebLinkAboutCounty Council for April 1 1982r l WHATCOM COUNTY COUNCIL April 1, 1982 Minutes The County Council meeting of April. 1, 1982 was called to order by Chairman Roehl at 7:34 p.m. with all members present. The March 4, 1982 minutes were approved as corrected and the March 18, 1982 minutes approved as presented. OPEN SESSION Ellen Vaughn, 2212 D Street, spoke in regard to amending the ordinance establishing procedures for making and confirming appoint- ments to citizen boards, commissions, and committees to include the development of a portfolio of job descriptions for all boards. Henry Feenstra spoke in regard to the length of time involved in rezoning his property. Gary Orr of Pacific Concrete also urged the Council to expedite the process of rezoning. Chairman Roehl suggested the Council meet with the Planning Commission to discuss ways of shortening the rezoning process. Robert Frost, 5602 Guide Meridian, requested that Council revise the ordinance regarding second -hand dealers and junkers' licenses. EXECUTIVE ITEMS Council approved the following three bid awards presented by the Executive: 1. Bid award to Whatcom,Builders, Inc. for the construction of the Cedarville Road Cross - Culvert, in the amount of $12,500.00 including taxes. 2. Bid award to Pottle & Sons Construction Company for the alterations to WATCI which are to.be funded by Referendum 37 Grant monies, in the amount of $44,767.86. 3. Bid award to EDAW, Seattle, Washington, for Small Scale Hydro -power Policy and Permit Analyst, the amount not to exceed the current CEIP Grant. of $25,904.00. Council approved the following overlimit transfer as requested by the Executive: Motor Pool Budget From: 595 -10 -22 Operating Supplies $20,000.00 To: 595 -10 -38 Repair and Maintenance $10,000.00 595 -90 -64 Machinery and Equipment $10,000.00 HEARINGS Hearing opened on the vacation of a portion of the County Road y Whatcom County Cor-cil a April 1, 1982 Minutes page two No. 475 (Lampman Road). Larry Illman stated that he feels the valuation of $2,000 per acre is excessive but that he did not wish to delay the vacation by seeking a private appraisal. Hearing closed. Cole presented the Public Services'Committee's recommendation that the vacation of a portion of County Road No. 475, as described in the revised legal description, be approved for the value of $2,000 per acre. He so moved. Motion carried. Hearing was declared open on the vacation of Section 10 of the Telegraph Road. No testimony was given and the hearing was closed. Cole presented the Public Services Committee's recommenda- tion that the vacation be approved. He so moved. Motion carried. FINAL CONSIDERATION OF ORDINANCES AND RESOLUTIONS Hansey presented the Planning and Development Committee's recommendation of "do pass" on the Resolution Approving the Annexation of Certain Properties to the City of Blaine with the corrected legal description. He so moved. Motion carried. Cole presented the Public Services Committee's amendments to the ordinance-amending Whatcom County Code so as to establish the County Fire Marshal as a position of the Department of Public Works, Bureau of Building and Codes Administration, and repealing all County ordinances and resolutions inconsistent herewith. Cole moved to accept Draft 2 of the ordinance. Motion carried. Draft 2 of the County Fire Marshal ordinance being before the Council for final consideration, Cole and Van Zanten explained the amendments to the ordinance. Van Zanten moved to further amend the title of the ordinance to read "the Office of County Fire Marshal as a pesitiex function "; line. 13: Ovi94:en function; line 18: pesitien function; line 20: "as the Office of Whatcom County Fire Marshal "; and line 20 page 2: "!�4:r9t Thirty -first of January ". Motion to amend the ordinance carried. Cole moved to amend the ordinance to delete from Section F: "The Fire Marshal shall be directly responsible in this capacity to the Deputy Administrator of the Bureau of Building and Codes Adminis- tration." Motion carried. Cole moved for final passage Draft 2 as amended of the ordinance establishing the County Fire Marshal. Motion carried unanimously. 11 Whatcom County ^ouncil Minutes April 1, 1982 page three Rushing, Public Works Director, announced that Dave Langford has been selected as the County Fire Marshal. OTHER Van Zanten presented the Finance Committee's recommendation for denial of the bid award for the Official County Newspaper. She explained that the original figures were incorrect and pointed out the following corrections: First insertion rate increases from $3.25 to $3.64; paragraph three, the increase is from $2.94 to $3.29; and the minimum charge is increased from $3.50 to $4.00. The average increase is 12.70. The bid award also includes a decrease in type point size from point 7 to point 6, and an increase in lines per column inch from 10 to 12. Van Zanten moved to reject all bids and to authorize the Audi- tor to re -bid. Hawley stated that he had spoken to Bob Partlow, who said that the point size has been the same for the past two years. Partlow stated that the point size would be the same as last year, but different from three years ago. Van Zanten stated that the bid award as corrected includes a reduction in point size. No further discussion. Motion to reject the bid and to authorize the Auditor to re -bid carried. The application for a rate increase to subscribers in the Point Roberts area, filed by Delta Cable Television, Ltd., was received and before the Council for consideration. Chairman Roehl called the attention of the Council to the 3/2/82 letter from Delta Cable Tele- vision stating proposed increases and asking for the creation of a Rate Review Board in the second quarter of the year. Mr. John Thomas has been designated as Delta Cable Television's member of the Board. Cole moved that Council establish a Rate Review Board and that the Chair designate Council's member. Johnson moved to amend the motion to designate Hawley as the Council's member to the Board. Hawley stated reasons that it would be appropriate for the Council to select him for the position. Van Zanten questioned procedures used by Hawley on the previous incorrect- ly formed Rate Review Board. No further discussion. Motion to Whatcom County Council ` April 1, 1982 Minutes - page four amend the motion to designate Hawley as the Board member carried. Cole moved to amend the motion so as to establish a Rate Review Board with Hawley to serve as the Council's member to the Board, with assistance from the Prosecuting Attorney's Office. Motion carried. The Council then discussed the decision regarding the Planning Commission's recommendations for the 1981,0pen Space applications. Hansey presented the Planning and Development Committee's recommend- ation to accept the Planning Commission's recommendations as presented. Ile so moved. Motion carried. Hansey presented the Planning and Development Committee's recommendation that the Council grant the time extension for Major Development Permit 1 -76, a 45 -unit Town House Condominium in the Maple Falls area, as requested by the applicant. He so moved. The extension would change dates to: Phase Z, June, 1984; Phase II, June, 1985. Motion carried. Johnson presented the Law and Justice Committee's recommendation that Council approve the Class EF Liquor License for Whalen's \ Recreational Vehicle Center, Point Roberts, Washington, provided that Sheriff Mount's letter of approval be received by the Executive; and that the applicant meets all conditions as set forth by the Sheriff, Building Codes, Environmental Health Codes, and ordinances of Whatcom County. He so moved. Cole further moved'to delete the condition that Sheriff Mount's letter in favor of approval be received by the Executive. Motion failed. Motion for approval of the application with conditions as stated above carried. INTRODUCTION OF RESOLUTIONS AND ORDINANCES Van Zanten introduced and moved for final passage the resolution to exchange County real property for private property owned by Donald C. Pulver. She commented -that the Finance Committee had recommended this resolution in January. Motion carried. Hansey introduced and moved to refer to the Planning and Development Committee the resolution approving the annexation of certain property to the City of Bellingham. Motion carried. Van Zanten introduced and moved to refer to the Committee of Whatcom County Council Minutes April 1, 1982 page five the Whole the resolution establishing Personnel Policies and Procedures for Whatcom County Employees. Motion carried. Cole introduced and moved to refer to the Public Services Committee the ordinance establishing procedures for making and confirming appointments to citizen boards, commissions and commit- tees. Hansey moved to amend the motion to refer the ordinance to the Committee of the Whole rather than to the Public Services Committee. Motion to amend carried. Motion to refer the ordinance to the Committee of the Whole carried. Van Zanten introduced and moved to refer to the Committee of the Whole the ordinance amending Ordinance No. 80 -8, adopted February 7, 1980; and repealing Chapter 2.60 Vacations; 2.62 Sick Leave; and Section 2.64.01 Employee Miscellaneous Provisions of the Whatcom County Code. Motion carried. Chairman Roehl set a tentative date of April 8, 1982 at 7:30 p.m. for the-meeting of the Committee of the Whole. COMMITTEE REPORTS Hansey reported that the Planning and Development Committee will hold its regular monthly meeting with the City Planning Committee next Monday at 7:30 a.m. to discuss items of concern regarding Lake Whatcom. Hansey also presented the request that the County Council cooperate with the City Council in a discussion of the development of a regional mall. Cole reported that the County Public Services /City Public Works Committees will be holding a joint hearing on lowering the minimum level.of Lake Whatcom. The meeting is scheduled for April 29 at 7:30 p.m. at the Bloedel Donovan Field House. Meeting adjourned at 9:50 p.m. 5
