WHATCOM COUNTY COUNCIL
MINUTES -- OCTOBER 20, 1983
The Whatcom County Council meeting was called to order on
Thursday, October 20, 1983 at 7:36 p.m. by Chairperson Cole with
all members present except Hawley.
MINUTES
The minutes of the October 6, 1983 meeting were approved
as presented.
EXECUTIVE ITEMS
BID AWARDS
1) Executive Louws presented the bid award for slide repair
at Rock Point, Lake Whatcom Boulevard, recommending the
bid be awarded to One Way Construction, Inc., in the
amount of $205,491.86, per alternate no. 1.
Hansey reported the Finance Committee recommended approval
of the bid.
HANSEY SO MOVED TO APPROVE SAID BID AS PRESENTED. Motion
carried.
2) Executive Louws presented the bid for the Bayview Drive
Bulkhead at Point Roberts, RID No. 6, recommending the
bid be awarded to Whatcom Builders, Inc. in the amount of
$213,500-00.
Consideration of the bid award was held until after the
public hearing on this matter.
3) Executive Louws resubmitted bids for two 1 -ton trucks, to
correct the vendor to Hinton Chevrolet, in the amount of
$18,371.96.
Hansey reported the Finance Committee recommended approval
of the bid.
HANSEY SO MOVED TO RESCIND COUNCIL'S ACTION OF OCTOBER 6,
1983 AWARDING THE BID TO CHRYSLER, AND TO AWARD THE BID
AS SUBMITTED BY LOUWS. Motion carried.
OVERLIMIT TRANSFERS
1) Executive Louws presented the overlimit transfer in the
1983 River Improvement Fund in the amount of $10,000.00.

2) Executive Louws presented an overlimit transfer in the
Equipment Rental and Revolving Fund in the amount of
$98,000.00.
Hansey reported the Finance Committee recommended approval
of both transfers.
HANSEY SO MOVED TO AUTHORIZE THE TRANSFERS. Motion passed.
AGREEMENT -- ARCHITECT SERVICES FOR JUVENILE FACILITY
The agreement for architect services relative to the proposed
Juvenile Detention Facility, Court, and Administration Offices was
held in Finance Committee.
1984 BUDGET
Executive Louws presented the proposed 1984 budget and messege.
The matter will be reviewed by Finance Committee.
OPEN SESSION
No one spoke at open session.

UVA DTUnO
ROAD IMPROVEMENT DISTRICT NO. 6
Hearing was continued from the meeting of October 6, 1983 in the
matter of creating a Whatcom County Road Improvement District No. 6.
Cole reported the number of ballots voting yes - 129 112 for a
total amount of $18,777.60, and the number of ballots voting no -
64 for a total amount of $8,845.00.
Henken stated FEMA will pick up 75% of the total cost of the
project, which is $213,500.00. FEMA's share will be $160,125.00. The
remaining balance will be paid by the RID at a cost of $159.00 per lot
or parcel.
No further testimony was received and the hearing was closed.
VAN ZANTEN INTRODUCED AND MOVED FOR FINAL PASSAGE A RESOLUTION IN
THE MATTER OF CREATING WHATCOM OCUNTY ROAD IMPROVEMENT DISTRICT NO. 6
AND ESTABLISHING SUCH DISTRICT AS THE BAYVIEW DRIVE IMPROVEMENT
DISTRICT AND ORDERING THE IMPROVEMENTS. Motion carried.
At this time the bid award for the bulkhead was considered.
HANSEY MOVED TO APPROVE THE BID OF WHATCOM BUILDER'S, INC. IN THE
AMOUNT OF $213,500.00. Motion carried.

FINAL CONSIDERATION OF ORDINANCES
ORDINANCE -- FEDERAL SHARED REVENUE
HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A
REVISED BUDGET TO THE 1983 FEDERAL SHARED REVENUE. Hansey reported
the Finance Committee recommended "do pass" of the ordinance.
Ordinance passed unanimously.
Chairperson Cole left the meeting and Vice -Chair Roehl continued
the meeting.
ORDINANCE -- MENTAL HEALTH
HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A
REVISED BUDGET TO THE MENTAL HEALTH FUND. Hansey reported the Finance
Committee recommended "do pass" of the ordinance. Ordinance passed
on a 6 -0 vote.
Chairperson Cole entered the meeting.
ORDINANCE -- PARKS
HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A
REVISED BUDGET TO THE PARK FUND. Hansey reported the Finance
Committee recommended "do pass" of the ordinance. Ordinance passed
unanimously.
ORDINANCE -- PROSECUTING ATTORNEY'S REVOLVING ACCOUNT
HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A
REVISION TO THE PROSECUTING ATTORNEY'S REVOLVING ACCOUNT. Hansey
reported the Finance Committee recommended "do pass" of the ordinance.
Ordinance passed unanimously.
ORDINANCE -- DID NO. 31
HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE OF THE COUNCIL OF
WHATCOM COUNTY, WASHINGTON PROVIDING FOR THE ISSUANCE OF BONDS FOR
CONSOLIDATED DRAINAGE IMPROVEMENT DISTRICT NO. 31; CREATING A BOND
FUND; IN THE AGGREGATE PRINCIPAL AMOUNT OF $61,329.51, AND CONFIRMING
THE SALE OF SAID BONDS.
Cynthia Weed, bonding counsel, spoke to the proposed ordinance.
She also stated an offer has been received from a Mr. Harold Walton to
purchase the bonds at 11% interest. A letter has also been received
from Steve Gaidos, Harper, McLean, recommending to the Council to
accept said offer. Weed also recommended the Council set the interest
1/2$ higher than the rate to provide for administration costs.
HANSEY MOVED TO AMEND THE ORDINANCE -ON PAGE 3, LINE 25, to insert
"11 • 5$"
Ordinance passed unanimously.

ORDINANCE -- INITIATIVE AND REFERENDUM FORM
ROEHL MOVED FINAL PASSAGE OF THE ORDINANCE AMENDING ORDINANCE
NO.83 -55 AMENDING WHATCOM COUNTY CODE SECTION 1.08.060 PROVIDING FOR
PROCEDURES AS TO THE FORM OF PETITIONS FOR INITIATIVES AND
REFERENDUMS. Roehl reported the Law and Justice Committee recommended
approval of the ordinance. Ordinance passed unanimously.
OTHER BUSINESS
RATE REVIEW BOARD

ATTORNEY POSITION -- Johnson moved to appoint Waters to the
position. Motion carried.
FINANCIAL /ACCOUNTANT POSITION -- A roll call vote was taken for
this position between Merrifield - 4 votes, O'Neil - 3 votes,
Brunner - 0 votes. Merrifield was so appointed.
LAY POSITION -- A roll call vote was taken for two lay positions
between Post, Primm, Beletz, Miles, O'Neil, Brunner, with each
Council member voting for two as follows: Post - 1, Primm - 1,
Beletz - 1, Miles - 1, O'Neil - 7, Brunner - 4. O'Neil and
Brunner were so appointed.
VAN ZANTEN MOVED TO APPOINT THE MEMBERS FOR THE FOLLOWING TERMS:
Waters -- one year
Merrifield -- two year
Brunner -- three year
O'Neil -- four year
Motion carried.
CEDAR HILLS WEST PRELIMINARY PLAT
Consideration was held of the preliminary plat of Cedar Hills
West.

Phil Serka, representing the proponent, and Bob Tull,
representing land owners in the area, spoke to the point of procedure.
Johnson reported the Planning and Development Committee
recommended approval of the plat and suggested the Council consider
holding a public hearing on the matter.
Johnson so moved to hold a public hearing on the matter. Motion
carried.
Hawley moved to set the hearing for Thursday, November 3, 1983 at
6:30 p.m. to 7:30 p.m. Motion carried. A Special Council Meeting
will be set.
CORRESPONDENCE
1) Bill Clement, Chairman of the Lake Whatcom Advisory
Committee, suggesting an amendment to the Lake Whatcom
Comprehensive Plan extending the North Shore Service
Improvement moratorium to December 31, 1984, was re-
referred to the Committee of the Whole.
2) Petition requesting the vacation of a portion of Pleasant
Bay Road, filed by Walter Ruf, et al, was referred to the
Planning and Development Committee.
APPEAL OF WILDER
Administrative Appeal of Hearing Examiner decision of Promac
Industrial Wood Components, Inc., filed by Chuck and Betty Wilder was
withdrawn from consideration by the Council after receiving
correspondence from the Wilder's requesting to withdraw their appeal.
INTRODUCTION OF RESOLUTIONS AND ORDINANCES
RESOLUTION -- RID NO. 1
ROEHL INTRODUCED AND MOVED FOR -FINAL PASSAGE A RESOLUTION
CONFIRMING THE ASSESSMENT ROLL OF PROPERTY WITHIN THE BOUNDARIES OF
WHATCOM COUNTY ROAD IMPROVEMENT DISTRICT NO. 1 (BIRCH BAY LIGHTING

RESOLUTION -- CANCEL WARRANTS
HANSEY INTRODUCED AND MOVED FOR FINAL PASSAGE A RESOLUTION
AUTHORIZING THE CANCELLATION OF OUTSTANDING WARRANTS ON VARIOUS FUNDS
FOR 1983. Hansey reported the Finance Committee recommended passage
of the resolution. Motion carried.
RESOLUTION -- WATER DISTRICT NO. 8
VAN ZANTEN INTRODUCED AND MOVED FOR FINAL PASSAGE THE RESOLUTION
CHANGING THE NAME OF WHATCOM COUNTY WATER DISTRICT NO. 8 TO BIRCH BAY
WATER DISTRICT N0. 8. Motion carried.
RESOLUTION -- NOR -BELL WASTEWATER FACILITY PLAN
JOHNSON INTRODUCED AND MOVED FOR FINAL PASSAGE A RESOLUTION
AMENDING RESOLUTION NO. 82 -59 DATED NOVEMBER 23, 1982, ACCEPTING THE
NOR -BELL WASTEWATER FACILITY PLAN FOR THE CONSTRUCTION OF A SIX -INCH
FORCE SEWER LINE ... BY MODIFYING SECTION 3 AND IN ACCORDANCE WITH
SECTION 7 OF SAID RESOLUTION, AMENDING EXHIBIT "D" FOR THE PURPOSE OF
PROVIDING FOR SEWER CONNECTIONS TO THE SIX -INCH FORCE MAIN FOR BETHANY
BAPTIST FELLOWSHIP CHURCH SITE TO BE LOCATED ON THE FIVE -ACRE.
VAN ZANTEN MOVED TO AMEND THE RESOLUTION ON PAGE TWO, LINE TEN,
TO INSERT AFTER THE WORD "follows:" THE FOLLOWING LANGUAGE: ", pro-
vided that the agreement set forth in the attached Exhibit A is
executed by the City of Ferndale and Whatcom County; ". Motion
carried.
Motion to adopt the resolution carried.
EMERGENCY ORDINANCE -- NO SHOOTING AT WISER LAKE
ROHEL INTRODUCED AND MOVED FOR FINAL PASSAGE AN EMERGENCY
ORDINANCE ESTABLISHING A NO SHOOTING ZONE IN THE AREA OF WISER LAKE.
Ordinance passed unanimously.
The following ordinances were introduced by Hansey and referred
to the Finance Committee:
1. Ordinance adopting a supplemental budget for the Whatcom
County River Improvement Fund 1983 Budget
2. Ordinance adopting a 1983 budget for the Whatcom County
Limited Tax Bond Fund, 1983 (Road Improvements and
Fairground Building)
3. Ordinance authorizing a revised budget for the 1983
Current Expense Fund, Hearing Examiner Budget therein
4. Ordinance authorizing a budget for the 1983 Mental Health
and Drug Abuse Fund

Hansey also introduced a RESOLUTION OF THE WHATCOM COUNTY COUNCIL
REGARDING THE ESTABLISHMENT OF A "HOME PORT BASE" FOR THE UNITED
STATES NAVY AT CHERRY POINT. Hansey will have the resolution reviewed
by the Prosecuting Attorney.
REPORT OF COMMITTEES AND OTHER ITEMS FROM COUNCIL MEMBERS
Hawley presented a petition to the Council requesting the speed
on Vista Drive in Ferndale be raised to 45 mph. The matter was
referred to the Law and Justice Committee.
A Committee of the Whole meeting will tentatively be scheduled
for Wednesday, October 26, 1983 at 3:00 p.m. to continue review of the
Comprehensive Plan and Zoning Texts for the Urban Fringe Subarea.
Meeting adjourned at 9:50 p.m.
