HomeMy WebLinkAboutCounty Council for September 1 1983OFFICIAL PROCEEDINGS WHATCOM COUNTY COUNCIL MINUTES -- SEPTEMBER 1, 1983 The Whatcom County Council meeting of September 1, 1983 was called to order at 7:45 p.m. by Chairperson Cole with members Van Zanten, Hansey, Hawley, and Muenscher present. MINUTES The minutes of the August 18, 1983 Council meeting were approved as amended: 1)'' Page 4, Riteway Construction Appeal, line 7, strike "Whalen's" and insert "Wieland's" 2) Page 7, Resolution cancelling taxes, line 7, strike "Motion failed." EXECUTIVE ITEMS Executive Louws requested acceptance of the bid of Alpine H & S, Inc. in the amount of $22,210.58, including tax, for the repairs to the dike at Hovander /Tennant Lake Park. Hansey reported the Finance Committee recommended accep- tance of the bid. HANSEY SO MOVED TO ACCEPT THE BID AS RECOMMENDED BY THE EXECUTIVE. MOTION CARRIED. SPECIAL ORDER OF BUSINESS Introduction was made of Graham Tollefson, President of Washington State Association of Counties and Yakima County Commissioner. Also present was Gary Lowe, Executive Secretary, Washington State Association of Counties. PRESENTATION Sheriff Mount gave a presentation regarding the Crime Prevention Program. Ile will follow -up with a written statement of statistics to the Council. OPEN SESSION No one spoke in the opportunity of open session. Whatcom Count Council Minutes September 1, 1983 page two HEARINGS DISSOLUTION OF SEWER IMPROVEMENT DISTRICT NO. 1 Hearing was declared open in the matter of the proposed dissolution of Whatcom County Sewer Improvement District No. 1. Paul Rushing, Director of Public Works, stated this district has been maintained and administered by the City of Bellingham through an agreement with the County. If the dissolution were to take place the City of Bellingham would directly serve the area. No further testimony was received and the hearing was closed. VAN ZANTEN INTRODUCED AND MOVED FOR FINAL PASSAGE A RESOLUTION IN THE MATTER OF ABANDONMENT AND DISSOLUTION OF WHATCOM COUNTY SEWER IMPROVEMENT DISTRICT NO. 1, A SEWER IMPROVEMENT DISTRICT ESTABLISHED FOR THE PURPOSE OF PROVIDING SEWER SERVICE TO THE RESIDENTS OF THE BIRCHWOOD AREA OF WHATCOM COUNTY. Van Zanten reported the Public Services Committee recommended the dissolution of the district. She stated correspondence has been received from City of Bellingham Mayor Hertz, stating that it is possible and desirable for the City to expand the services to adjacent properties, however final approval will need to be from the Bellingham City Council. The County would also be obligated to participate in providing funding for the additional trunk line. Hansey stated he would vote against the resolution. VAN ZANTEN MOVED TO DEFER ACTION ON THE RESOLUTION UNTIL THE SETPEMBER 15, 1983 MEETING. MOTION CARRIED. RESOLUTION -- GRANT FOR NOR -BELL SEWER PROJECT Hearing was declared open in the matter of a RESOLUTION AUTHORIZING COUNTY EXECUTIVE TO SUBMIT APPLICATION TO THE STATE FOR A COMMUNITY DEVELOPMENT BLOCK GRANT FOR THE NOR -BELL SEWER PROJECT. No testimony was received and the hearing was closed. VAN ZANTEN INTRODUCED AND MOVED FOR FINAL PASSAGE SAID RESOLUTION. MOTION CARRIED ( Hansey abstained). Whatcom County ouncil Minutes September 1, 1983 page three FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES RESOLUTION -- CANCELLATION OF TAXES HANSEY MOVED FOR FINAL PASSAGE THE RESOLUTION IN THE MATTER OF CANCELLATION OF UNCOLLECTABLE PERSONAL PROPERTY TAXES MORE THAN SIX YEARS DELINQUENT. He reported the Finance Committee recommended "do pass" of the resolution. Cole questioned whether or not the lien could remain on the property and at such time as it is sold the purchaser would be obligated to pay all back taxes. HANSEY MOVED TO REFER THE RESOLUTION BACK TO THE FINANCE COMMITTEE. MOTION CARRIED. ORDINANCE -- SEWER CONSTRUCTION The ORDINANCE ADOPTING A 1983 BUDGET FOR THE WHATCOM COUNTY LIMITED TAX BOND FUND, 1983 SEWER CONSTRUCTION was held until public hearing to be held on October 6, 1983. ORDINANCE -- SCAN HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE PROVIDING FOR AN INCREASE IN FUNDS TO THE CENTRAL STORES REVOLVING FUND -- STATE CONTROLLED AREA NETWORK (SCAN). IIe reported the Finance Committee recommended "do pass" of the ordinance. MOTION CARRIED UNANIMOUSLY. ORDINANCE -- PNB HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF THE PACIFIC NORTHWEST BELL REVOLVING FUND. He reported the Finance Committee also recommended "do ,pass" of this ordinance. MOTION CARRIED UNANIMOUSLY. ORDINANCE -- ROAD IMPROVEMENT DISTRICT NO. 5 HANSEY MOVED TO ACCEPT TIIE SUBSTITUTE DRAFT OF THE ORDINANCE OF THE COUNCIL OF WHATCOM COUNTY, WASHINGTON, RATIFYING CREATION OF A ROAD IMPROVEMENT DISTRICT NO. 5 FUND, FIXING INTEREST RATE ON ASSESSMENT AND PROVIDING FOR THE ISSUANCE OF BONDS OF ROAD IMPROVEMENT DISTRICT NO. 5 IN THE PRINCIPAL SUM OF $187,183.55 AND FOR THE SALE THEREOF TO HARPER, MCLEAN & COMPANY, presented to the Council this evening. MOTION CARRIED. Steve Gaidos, Harper, McLean & Company, bonding counsel, presented the Council with an offer to purchase bonds from Whatcom Count- Council t4inutes September 1, 1983 page four Harper, McLean & Company. HANSEY MOVED TO ACCEPT SAID OFFER. MOTION CARRIED. HANSEY MOVED FOR FINAL PASSAGE SAID SUBSTITUTE ORDINANCE MOTION CARRIED UNANIMOUSLY. OTHER BUSINESS POINT ROBERTS COMMERCIAL CENTER SUBDIVISION Hearing Examiner recommendations regarding preliminary plat approval to create and develop a commercial subdivision to be known as "Point Roberts Commercial Center Subdivision were received. VAN ZANTEN MOVED TO REFER THE MATTER TO THE PLANNING. AND DEVELOPMENT COMMITTEE FOR REVIEW. MOTION CARRIED. (Cole abstained) CEDAR HILLS WEST SUBDIVISION Hearing Examiner recommendations regarding preliminary plat approval to create and develop a residential subdivision known as "Cedar Hills West" were received. HANSEY MOVED TO REFER THE MATTER TO THE PLANNING AND DEVELOPMENT COMMITTEE FOR REVIEW. MOTION CARRIED. LIQUOR LICENSES a. Bellingham Area Minor Hockey Association, Class B and C Correspondence was received from the Association setting forth rules for the sale and consumption of the liquor. Muenscher reported the Law and Justice Committee recommended approal of the license. Van Zanten stated she would vote against the license due to the fact that the primary use of the facility is for family and minor age event uses. MUENSCHER MOVED TO APPROVE THE LICENSE. MOTION CARRIED. b. Glynn's Shamrock, Class B, C, E, and F HUENSCHER MOVED TO APPROVE THE LIQUOR LICENSE. Muenscher reported the Law and Justice Committee reconunended approval of the license. Meridian Mercantile, Class E and F Muenscher reported the Law and Justice Committee recommended approval of the license. MUENSCHER SO MOVED TO APPROVE THE LICENSE. MOTION CARRIED. RICHALOU ESTATES Consideration of Hearing Examiner recommendations regarding preliminary plat approval to create and develop a residential subdivision to be known as "Richalou Estates" was held until the September 15 meeting, due to the fact that seven days must pass after the Amended Final E.I.S. was submitted on August 29, 1983. APPOINTMENTS -- HEALTH BOARD Announcement of vacancy on Bellingham /Whatcom County Health District Board, position to be filled from the unincorporated area of Whatcom County, Member Nelda Sigurdson, who was filling the unexpired term of the late Alex Gitts, to August 31, 1983, does not wish to continue to serve on the board. The matter will be researched further. APPOINTMENTS -- RATE REVIEW BOARD Announcement of vacancies on the Whatcom County Rate Review Board. Nominations will be held at the next Council meeting. CORRESPONDENCE -- COUNTY AUDITOR Correspondence was received from Joan Ogden, Auditor, requesting an amendment to Ordinance 83 -55 regarding initiative and referendum. The matter was referred to the Law and Justice Committee for review. INTRODUCTIONS RESOLUTION -- BLAINE AIRFORCE STATION Van Zanten introduced the RESOLUTION IN THE MATTER OF APPLICATION TO THE SECRETARY OF THE INTERIOR FOR AND SECURING TRANSFER OF REAL PROPERTY OWNED BY THE UNITED STATES, MORE COMMONLY KNOWN AS BLAINE AIR FORCE STATION, TO WHATCOM COUNTY AND GIVING THE PARK DIRECTOR THE AUTHORITY TO PERFORM ALL DUTIES IN THE ACQUISITION AND MAINTENANCE OF SAID PROPERTY. The resolution was referred to the Committee of the Whole. Whatcom County _�ouncil Minutes September 1, 1983_ page six RESOLUTION -- ROAD IMPROVEMENT DISTRICT NO. 1 Hansey introduced the RESOLUTION IN THE MATTER OF REASSESS- MENT OF PROPERTY WITHIN THE BOUNDARIES OF WHATCOM COUNTY ROAD IMPROVEMENT DISTRICT NO. 1. The resolution was referred to the Law and Justice Committee for review. ORDINANCE -- AGRICULTURAL, EXTENSION BUDGET Hansey introduced the ORDINANCE AUTHORIZING A REVISED BUDGET TO THE 1983 CURRENT EXPENSE FUND, AGRICULTURAL EXTENSION BUDGET." The ordinance was referred to the Finance Committee for review. ORDINANCE -- SHOOTING ZONE IN WISER LAKE VAN ZANTEN INTRODUCED AND MOVED FOR IMMEDIATE PASSAGE AN EMERGENCY ORDINANCE ESTABLISHING A "NO SHOOTING ZONE" IN THE AREA OF WISER LAKE. Van Zanten reported the Law and Justice Committee recommended "do pass" of the ordinance. MOTION CARRIED UNANIMOUSLY. REPORT OF COMMITTEES AND OTHER ITEMS FROM COUNCIL MEMBERS Van Zanten reported that at a recent meeting with the State regarding the transfer of the Sumas /Kendall Road to the State Highway system the state representative felt it would take 8 -10 years to get the issue on the priority list. Van Zanten also reported the Petition for Water Association in Maple Falls will be held for some time.
