MINUTES - OCTOBER-6; 19Q3
The Whatcom County Council meeting was called to order on
Thursday, October 21, 198:3 at 7:35 p.m. by Chairperson Cole with
all members present except Van lar,ten.
_MINUTES The Minutes of the September 15, 1983 meeting were approved
as presentedC Committee of the Whole minutes of September 26, 1983
were approved as amended to include that Hawley was in attendance.
EXECUTIVE ITEMS
BID AWARDS
1) Executive Louws withdrew the bid for the Bayview Drive
Bulkhead.
2) Executive Louws presented various bid awards for
equipment as Follows:
a. Tractor - Parmers Equipment of Lynden at $19,500.00
b. Pick ups 112 ton (3) -- Hinton Chevrolet /Oldsmobile
of Lynden at $21,833.95
c. Pick up, four wheel drive, 1/2 ton - Hinton
Chevrolet /Oldsmobile of Lynden at $10,565.86
d. Pick up, 3/4 tc:n, crew cab - Bellingham Chrysler at
$9,988.56
e. Truck, one tors (2) - Bellingham Chrysler at
$17,371-76
f. Trailer, 20 ton, tilt bed - N.C. Machinery of
Seattle, at $9,500.00
g. Truck, boom/basket, - Elder Equipment of Portland,
Oregon at $72,282.16
Hansey reported the Finance Committee recommended approval
of the bid awards.
HANSEY SO MOVED TO APPROVE SAID BID AWARDS. Motion carried.
3. Executive Louws presented the bid of Coral Sales Company in
the amount of $14,310.45, including tax, for ten 100 -foot
guardrail installations.
Hansey reported the Finance Committee recommended approval of
the bid with the adjustment Qvthe rate of tax to 7.5%
instead of 7.8%.
HANSEY SO MOVED TO APPROVE THE BID WITH THE RATE OF TAX TO
BE ADJUSTED. Motion carried.
4. Executive Louws preserved the bid of One Way Construction,
Inc., in the amount of $56,898.05 for the slide repair to
North Approach Bridge No. 1 15 , Lake Whatcom Boulevard.
Hansey reported the Finance Committee recommended approval
of the bid.

5. Executive Lours presented the bid of Robinson Textiles in
the amount of $13,119.40, plus tax, for purchase of
mattresses and mattress covers.
Hansey reported the Finance Committee recommended approval
of said bid.
HANSEY SO MOVED TO APPROVE THE BID. Motion carried.
LIQUOR LICENSE
Executive Louws requested approval. of a Class H liquor license
for the Blue Max Restaurant at the Bellingham Airport.
Roehl reported the Law and Justice Committee recommended approval
of the liquor license.
ROEHL SO MOVED TO APPROVE THE LICENSE. Motion carried.
AGREEMENT -- ARCHITECT SERVICES FOR JUVENILE FACILITY
The agreement for architect services relative to the proposed
Juvenile Detention Facility, Court, and Administration Offices was
held in Finance Committee.
APPOINTMENT OF PURCHASING AGENT
Executive Louws requested confirmation of the appointment of
Nat Dickinson to the position of Purchasing Agent.
A roll call vote was taken with the vote being 6 -0. The
appointment was so confirmed.
1984 BUDGET
Executive Louws stated he would be presenting the 1984 budget to
the Council at its meeting of October 20, 1983.
INTRODUCTION OF NEW STAFF MEMBER
At this time Planning Director Bill Trimm introduced to the
Council Vernon Umetsu, a new employee in his department, who will be
working with the comprehensive sewer and water plans.
SPECIAL ORDER OF BUSINESS
A presentation of certificates was made to Dr. John Miles, Daniel
Kirkpatrick, Dr. Daniel Brown, Diana Wood, Wayne Smith, Dennis Connor,
Mike Barnes and Kevin Bowan, by Parks Director Roger DeSpain, for the
rescue of persons on Mount Baker and also from the Lake Samish air
craft. Council confirmed the awards by motion.
Van Zanten entered the meeting.
OPEN SESSION
Levuon Williams, 1120 Puget Street, presented the Council with a
"You've gotta be kidding award" from the Out -of -hand Group.
HEARINGS
ORDINANCE -- BUDGET FOR BOND FUND. SEWER CONSTRUCTION
Hearing was declared open .regarding the ORDINANCE ADOPTING A 1983
BUDGET FOR THE WHATCOM COUNTY LIMITED TAX BOND FUND, 1983 (Sewer
Construction). No testimony was received and the hearing was closed.
Roehl reported the Finance Committer recommended "do pass" of the
ordinance.

ROEHL SO MOVED THE ORDINANCE FOR FINAL PASSAGE. Motion carried
unanimously.
ORDINANCE -- SPEED ON CERTAIN COUNTY ROADS
Hearing was declared open regarding the ORDINANCE IN THE MATTER
OF ESTABLISHING LIMITS ON CERTAIN COUNTY ROADS. No testimony was
received and the hearing was closed. Roehl reported the Law and
Justice Committee recommended "do pass" of the ordinance.
ROEHL SO MOVED THE ORDINANCE FOR FINAL PASSAGE. Motion carried
unanimously.
ORDINANCE -- STOP SIGN ON COUNTRY LANE
Hearing was declared open regarding the ORDINANCE IN THE MATTER
OF REMOVING THE STOP SIGN CONTROL AT THE RAILROAD CROSSING OF COUNTRY
LANE. No testimony was received and the hearing was closed. Roehl
reported the Law and Justice Committee recommended "do pass" of the
ordinance.
ROEHL SO MOVED THE ORDINANCE FOR FINAL PASSAGE. Motion carried
unanimously.
ROAD IMPROVEMENT DISTRICT NO. 6
Hearing was declared open in the matter of the formation of
Whatcom County Road Improvement District No. 6 for improvements to
Bayview Seawall. The following testimony was received:
James Battin - Object to being placed in the
Michael Palisades proposed assessment area.
Mary Forrester - President Maple Beach Assoc.

VAN ZANTEN MOVED TO RECESS THE HEARING TWO WEEKS IN ORDER TO
RECEIVE•MORE INFORMATION ON THE COSTS FROM THE ENGINEERING DEPARTMENT,
BUT THAT IT IS THE INTENT OF THE COUNCIL TO EXCLUDE ELIZABETH AND
MICHAEL PALISADES SUBDVISIONS FROM THE BOUNDARIES OF THE DISTRICT.
Motion carried.
ROAD IMPROVEMENT DISTRICT NO. 1
Hearing was declared open in the matter of reassessment of
property within the boundaries of Whatcom County Road Improvement
District No. 1 (Birch Bay Lighting District ).
Richard McCoy of Birch Bay spoke in favor of the reassessment.
No further testimony was received and the hearing was closed.
FRIDEN FLEXOWRITER
Hearing was declared open in the matter of declaring certain
property surplus, Friden Flexowriter. No testimony was received and
the hearing was closed.
HANSEY SO MOVED TO DECLARE SAID EQUIPMENT SURPLUS. Motion
carried.

FINAL CONSIDERATION OF ORDINANCES
RESOLUTION -- SEWER IMPROVEMENT DISTRICT NO. 1
Consideration was held of the RESOLUTION IN THE MATTER OF
ABANDONMENT AND DISSOLUTION OF WHATCOM COUNTY SEWER IMPROVEMENT
DISTRICT NO. 1, A SEWER IMPROVEMENT DISTRICT ESTABLISHED FOR THE PUR-
POSE OF PROVIDING SEWER SERVICE TO THE RESIDENTS RESIDING IN THE
BIRCHWOOD AREA OF WHATCOM COUNTY.
Van Zanten's motion of September 15, 1983 for final passage of
the resolution carried.
R E S O L U T I O N - A M E N D R E S O L U T I O N 7 9- 1
VAN ZANTEN MOVED FOR FINAL PASSAGE THE RESOLUTION AMENDING
RESOLUTION NO. 79 -1, REGARDING RULES OF PROCEDURE GOVERNING TIME,
PLACE AND CONDUCT OF COUNTY COUNCIL MEETINGS, AND THE ADOPTION OF
ORDINANCES (as amended by Resolution No.'s. 79 -11, 80 -42, 82 -1 and
82-8).
Van Zanten reported the Committee of the Whole recommended "do
pass" of the resolution.
VAN ZANTEN MOVED TO ACCEPT THE SUBSTITUTE DRAFT OF THE
RESOLUTION. Motion carried.
VAN ZANTEN MOVED TO AMEND THE RESOLUTION ON PAGE FOUR, LINE FOUR,
TO DELETE THE WORDS "and resolutions ". Motion to amend carried.
MUENSCHER MOVED TO AMEND THE RESOLUTION ON PAGE SIX, TO DELETE
LINES ONE THROUGH FOUR. Motion to amend failed.
Motion to adopt the resolution as amended carried.
ORDINANCE -- EXECUTIVE BUDGET
HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A
REVISED BUDGET FOR THE 1983 CURRENT EXPENSE FUND, - COUNTY EXECUTIVE
BUDGET THEREIN.
Hansey reported the Finance Committee recommended "do pass" of
the ordinance.
Motion carried unanimously.
OTHER BUSINESS
LIQUOR LICENSES
Roehl reported the Law and Justice Committee recommended approval
of the following liquor license applications:
1) Uncle Luigi's Pizzeria, Class A and C
2) Diebert's Store, Class E and F
3) Coal Creek Cookhouse, Class A and C
ROEHL SO MOVED TO APPROVE THE LIQUOR LICENSE APPLICATIONS.
Motion carried.
APPOINTMENT TO HEALTH BOARD
Consideration of the appointment to the Health District Board was
before the Council. Those nominated at the September 15, 1983 meeting
were Fred Wendover, Margaret .Laidl.aw, and Stan Jones. Johnson
withdrew the name of Stan Jones. A roll call vote was taken with
Wendover - 4, Laidlaw - 3. Wendover was so appointed to the
position.

At this time Roehl introduced and MOVED FOR FINAL PASSAGE THE
RESOLUTION IN THE MATTER OF SETTING THE TERM OF OFFICE OF THE MEMBER
OF THE BELLINGHAM /WHATCOM COUNTY HEALTH DISTRICT BOARD WHO REPRESENTS
THE UNINCORPORATED RURAL AREA OF WHATCOM COUNTY. Motion carried.
RATE REVIEW BOARD
Those nominated to the rate review board on September 15, 1983

APPEAL OF WILDER
Administrative Appeal of Hearing Examiner decision of Promac
Industrial Wood Components, Inc., filed by Chuck and Betty Wilder was
received and referred to Committee of the Whole.
OPEN SPACE
Open Space Application of Tom B. Philpott was received and
referred to the Planning Commission.
CORRESPONDENCE
1) Received from Treasurer Landy Bowen regarding Bakerview
Spur property sale, for information only
2) Received from Pearl Zender, Whatcom County 4 -H Leader's
Committee regarding proposed development of a race tract
at the Northwest Road site, referred to Public Services
Committee
3) Received from Peter J. Visser, attorney for Whatcom County
Water District No. 8, regarding change of the districts name,
referred to Public Services Committee, resolution will also
be drafted per request
4) Received from McCaw Communications regarding cablevision
rate change in the Lynden area.
ROEHL MOVED TO INSTITUTE THE RATE REVIEW BOARD MECHANISM.
Motion carried.
The Chair will also draft a letter to the Lynden City Council
regarding this matter.

Claims for reduction of assessment were filed by Alan Emmott and
James and Amy Shelley and referred to Finance Committee.

Hansey introduced and MOVED FOR FINAL PASSAGE THE RESOLUTION
REGARDING WHATCOM COUNTY SPONSORSHIP OF A PROJECT PROPOSED BY THE
WORKSHOP TRAINING CENTER TO USE STATE REFERENDUM 37 FUNDS TO CONSTRUCT
A STORAGE BUILDING AND INS^1ALL DOORS AND PAVING.
Hansey reported the Finance Committee recommended "do pass" of
the resolution. Motion carried.
RESOLUTION NON -UNION SALARY SCHEDULE
Hansey introduced and MOVED FOR FINAL PASSAGE THE RESOLUTION IN
THE MATTER OF AMENDMENT THE SALARY SCHEDULE FOR NON -UNION WHATCOM
COUNTY EMPLOYEES FOR 1983.
Hansey reported the Finance Committee recommended "do pass" of
the resolution. Motion carried.
The following ordinances were introduced by Hansey and referred
to the Finance Committee:
1) Ordinance authorizing a revised budget to the 1983 Federal
Shared Revenue Fund
2) Ordinance authorizing a revised budget to the Mental Health
Fund
3) Ordinance authorizing a revised budget to the Park Fund
4) Ordinance authorizing a revised budget to the Prosecuting
Attorney's Revolving Account
5) Ordinance of the County Council of Whatcom County, Washington
providing for the issuance of bonds for Consolidated Drainage
Improvement DistrictNo. 31; creating a bond fund; in the
aggregate principal amount of $61,329.51, and confirming
the sale of said bands
Hansey also introduced the ORDINANCE AMENDING WHATCOM COUNTY CODE
SECTION 8.12.010, REGARDING THE FEE SHCEDULE FOR SOLID WASTE DISPOSAL
AT ALL WHATCOM COUNTY SOLID WASTE SITES. The ordinance was referred
to the Finance Committee and Special Committee on Transportation and
Solid Waste. A Hearing will also be set on the matter.
Roehl introduced the following ordinances and they were referred
to the appropriate Council meeting:
1) Ordinance amending Ordinance No. 83 -55 amending Whatcom
County Code Section 1.08.050 providing for procedures as to
the form of petitions for initiatives and referendums
2) Ordinance establishing a no- shooting zone in the area of
Wiser Lake

REPORT OF COMMITTEES AND OTHER ITEMS FROM COUNCIL MEMBERS
Chairperson Cole requested that each Council member contact the
Council office if they were planning to attend the Committee of the
Whole meeting tentatively scheduled for 7:30 p.m. on October 10, 1983.
