HomeMy WebLinkAboutCounty Council for November 3 1983OFFICIAL PROCEEDINGS WHATCOM COUNTY COUNCIL MINUTES -- NOVEMBER 3, 1983 The Whatcom County Council meeting was called to order on Thursday, November 3, 1983 at 7:34 p.m. by Chairperson Cole with all members present. MINUTES The minutes of the October 20, 1983 Council meeting and the October 26, 1983 Committee of the Whole meeting were approved as presented. EXECUTIVE ITEMS LINE ITEM TRANSFER Executive Louws presented a line item transfer in the Northwest Washington Fair Fund in the amount of $44,300.00. Hansey reported the Finance Committee recommended approval of the transfer. HANSEY SO MOVED TO APPROVE SAID TRANSFER AS PRESENTED. Motion carried. AGREEMENT -- ARCHITECT SERVICES FOR JUVENILE FACILITY The agreement for architect services relative to the proposed Juvenile Detention Facility, Court, and Administration Offices was held in Finance Committee. OPEN SESSION Jim Hawley requested and excused himself from the Council. Jim Hawley, 2295 Ferndale Terrace, spoke as a citizen before the Council regarding the Council's intent of Ordinance No. 81 -29, establishing that service contracts are excluded from the bid procedure. Hansey stated the ordinance provides that any bid exceeding $10,000.00 shall be submitted to the Council for approval. Council Members Johnson and Roehl agreed. Kenneth Bridges, 474 Sudden Valley, spoke to the Preamble of the Whatcom County Charter, Preamble of the State of Washington Constitu- tion, and the Preamble to the United States Constitution. Robert Imhoff, Slater Road, Ferndale, spoke to the work that is to be contracted out regarding the two County landfill sites. __- ;:ix�vua��s�n,=,r;2'�s11 Whatcom County Council Minutes - November 3, 1983 PAGE 2 UVADTMOO ORDINANCE SOLID WASTE FEE SCHEDULE Hearing was declared open in the matter of ORDINANCE AMENDING WHATCOM COUNTY CODE SECTION 8.12.010, REGARDING THE FEE SCHEDULE FOR SOLID WASTE DISPOSAL AT ALL WHATCOM COUNTY SOLID WASTE SITES. No testimony was received and the hearing was closed. HANSEY MOVED TO CONFIRM THAT THE ORDINANCE WILL BE HELD IN COMMITTEE AND WILL BE REPORTED OUT AT SUCH TIME AS THE 1984 BUDGET IS ACTED UPON. Motion carried. ORDINANCE -- NO SHOOTING IN WISER LAKE AREA Hearing was declared open in the matter of ORDINANCE ESTABLISHING A NO SHOOTING ZONE IN THE AREA OF WISER LAKE. Lloyd Bernardy, 2146 W. Bartlett Rd., Lynden, submitted testi- mony and spoke to the ordinance. He requested his property be deleted from the zone. No further testimony was received and the hearing was closed. ROEHL MOVED TO REFER THE ORDINANCE BACK TO THE LAW AND JUSTICE COMMITTEE TO RE- DEFINE THE BOUNDARY LINE. Motion carried. CLAIM FOR REDUCTION OF ASSESSMENT. EMMOTT Hearing was declared open in the matter of the claim for reduc- tion of assessment of Alan H. Emmott. Emmott was present and spoke to the claim. Vic Battson, County Assessor, stated the area where the property is located has been reassessed. He recommended the value be reduced from $3,500 to $500, for a total reduction amount of $2,910.00. HAWLEY MOVED TO ORDER THE REDUCTION PER BATTSON'S RECOMMENDA- TION. Motion carried. FINAL CONSIDERATION OF RESOLUTIONS AND ORDINANCES RESOLUTION -- NAVY HOME PORT BASE HANSEY MOVED FOR FINAL PASSAGE THE RESOLUTION REGARDING THE ESTABLISHMENT OF A "HOME PORT BASE" FOR THE UNITED STATES NAVY AT CHERRY POINT. A letter was entered into the record from the Whatcom Chamber of Commerce and Industry, stating support of the Resolution. Whatcom County Council Minutes - November 3, 1983 PAGE 3 COLE MOVED TO AMEND THE RESOLUTION ON PAGE ONE, LINE 31, TO STRIKE THE WORD "pursuing" AND INSERT "investigating ". Motion to amend carried. Motion for final passage of the resolution as amended carried. ORDINANCE -- RIVER IMPROVEMENT FUND ROEHL MOVED FOR FINAL PASSAGE THE ORDINANCE ADOPTING A SUPPLE- MENTAL BUDGET FOR THE WHATCOM COUNTY RIVER IMPROVEMENT FUND, 1983 BUDGET. Hansey stated the Finance Committee recommended "do pass" of the ordinance. Ordinance passed 6 -0 (Johnson out). ORDINANCE -- HEARING EXAMINER HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A REVISED BUDGET TO THE CURRENT EXPENSE FUND, HEARING EXAMINER BUDGET THEREIN. He reported the Finance Committee recommended "do pass" of the ordinance. Ordinance passed 6 -0 (Johnson out). ORDINANCE -- MENTAL HEALTH HANSEY MOVED FOR FINAL PASSAGE THE ORDINANCE AUTHORIZING A REVISED BUDGET TO THE MENTAL HEALTH FUND. He reported the Finance Committee recommended "do pass" of the ordinance. Ordinance passed 6 -0 (Johnson out). OTHER BUSINESS HANSEY MOVED TO RECEIVE AND REFER THE FOLLOWING ITEMS TO THE PLANNING AND DEVELOPMENT COMMITTEE: 1) Hearing Examiner recommendations regarding preliminary plat approval to create and develop a residential sub- division to be known as "Ten Mile Estates" 2) Hearing Examiner recommendations regarding preliminary plat approval to create and develop a subdivision known as "Point Roberts Yacht Basin Subdivision" and to amend the major development permit for "Point Roberts Marina" Whatcom County Council Minutes - November 3, 1983 PAGE 4 INTRODUCTION OF RESOLUTIONS AND ORDINANCES RESOLUTION -- CANCEL WARRANTS ROEHL INTRODUCED AND MOVED FOR FINAL PASSAGE A RESOLUTION IN THE MATTER OF CANCELLATION OF WARRANTS OVER ONE YEAR OLD IN ACCORDANCE WITH THE PROVISIONS OF R.C.W. 35.32.100 RELATING TO THE CANCELLATION OF WARRANTS. Motion carried. RESOLUTION -- INDUSTRIAL DEVELOPMENT CORPORATION REVENUE BONDS HANSEY INTRODUCED AND MOVED FOR FINAL PASSAGE THE RESOLUTION OF THE COUNTY COUNCIL OF WHATCOM COUNTY APPROVING THE ISSUANCE OF REVENUE BONDS OF THE INDUSTRIAL DEVELOPMENT CORPORATION OF THE PORT OF BELLINGHAM PURSUANT TO R.C.W. 39.84.050. Hansey amended his motion to include referral to the Planning and Development Committee for review before final passage. Motion carried. ROEHL INTRODUCED THE FOLLOWING RESOLUTIONS AND ORDIANCES AND THEY WERE REFERRED TO THE APPROPRIATE COMMITTEE: 1. Resolution in the matter of transfers affecting the 1983 Budget, referred to Finance 2. Resolution in the matter of amending Resolution 83 -0 regarding capital improvement projects related to buildings and facilities for Whatcom county, Washington, referred to Public Services 3. Ordinance in the matter of the adoption of the final budget of Whatcom County for the year 1984, referred to Finance 4. Ordinance authorizing the levy of taxes for County and State purposes in Whatcom County, Washington, for the year of 1984, pursuant to Home Rule Section 6.10, referred to Finance 5. Ordinance regarding the matter of placing a stop sign on Hel -Lyn Place at its intersection with Britton Road, referred to Law and Justice REPORT OF COMMITTEES AND OTHER ITEMS FROM COUNCIL MEMBERS REMINDERS Committee of the Whole scheduled for Friday, November 4, 1983 at 1:00 p.m. regarding Urban Fringe Subarea.
