HomeMy WebLinkAboutCounty Council for November 17 1983c OFFICIAL PROCEEDINGS WHATCOM COUNTY COUNCIL MINUTES -- NOVEMBER 17, 1983 The Whatcom County Council meeting was called to order on Thursday, November 17, 1983 at 7:37 p.m. by Chairperson Cole with members Johnson, Roehl, Hansey, and Hawley present. MINUTES The minutes of the November 3, 1983 Council meeting were approved as amended on page one, Open Session, to add the sentence "Jim Hawley requested and excused himself from the Council." and to add new language after the first paragraph under Open Session as follows: "Council Members Johnson and R o e h 1 agreed. The minutes of the Council meeting of November 10, Committee of the Whole meetings of November 4 and 10, 1983 were approved as presented. EXECUTIVE ITEMS LINE ITEM TRANSFER Hansey reported the Finance Committee recommended approval of the line item transfer in the Solid Waste Fund in the amount of $25,000.00. HANSEY SO MOVED TO APPROVE SAID TRANSFER. Motion carried. BOARD APPOINTMENTS HANSEY MOVED TO CONFIRM THE FOLLOWING BOARD APPOINTMENTS TO THE WHATCOM COUNTY T.V. RECEPTION BOARD, DISTRICT NO. 1: Re- appointment of Marjorie Philpott of 3760 E. Smith Road, for another three year term to expire August 31, 1986 Re- appointment of Richard L. Monaghan of Deming, WA, for another three year term to expire August 31, 1986 Appointment of Randy Carson of 5473 Allison Road to fill the unexpired term of Nelda Zwick, term to expire August 31, 1985 Motion carried. SPECIAL ORDER OF BUSINESS The Resolution regarding the "E1 Nino" Fishing Disaster was before the Council. Don White, 2601 Vining, Bellingham, representing the fishermen of Whatcom County spoke to the matter. He stated El Nino is a result of a change in the ocean current patterns. r°` \Whatcom County Counci.L Minutes -- November 17, 1983 PAGE 3 Jan Leonardo, Emergency Services, stated a Economic Disaster Declaration has been signed by the County Executive and forwarded to the Governor for consideration. HAWLEY SO MOVED TO INTRODUCE AND MOVE THE RESOLUTION, DRAFT II, FOR FINAL PASSAGE. Motion carried. HEARING ORDINANCE ESTABLISHING FERRY RATES FOR 1984 Hearing was declared open in the matter of the Ordinance /establishing Whatcom County Ferry Rates for 1984. The following testimony was received: Earle Jewell - Representing Islanders. Spoke Lummi Island to proposal to eliminate the maintenance costs from the ferry budget and place them in the road budget. Propose a 20% reduction in fares and still meet the 75% operational costs. Remove limit on Senior Citizen earnings. County road vehicles pay fare. Anne Jewell - Agreed with proposals. Lummi Island Donald VanWalkenberg -Spent 10% of income on ferry Lummi Island passes last year. Daniel Cutter -like to see rates lowered Lummi Island Kathryn Galoin -In favor of lower rates Lummi Island Dave Dickinson -In 1983 spend $500.00 on ferry Lummi Island rates. Don White -Fares are too high Bellingham Bill Hamess -Rates too high 2640 McKenzie Gooseberry Point John ? -Rates to high Lummi Island Jean Hamess - Recently visited Boston, at Gooseberry Point which the ferry operations is part of the park system. { .lp. `j(hatcom County Council v. °'Minutes -- November 17, 1983 PAGE 4 Gordon Ford Lummi Island Harris Purvis Lummi Island -His tax dollars support other road repairs in the County -Agree with Jewell No further testimony was received and the hearing was closed. Consideration of this matter by the Council will be at its November 29, meeting. PRESENTATION Roger DeSpain, Parks Director, and Ray Doubt gave a presentation of a proposed park in the Cherry Point area. The Park Board will be considering this matter. U V A D T M n a VACATION PLEASANT BAY ROAD 4' Hearing was declared open in the matter of vacation of a portion of Pleasant Bay Road, petition filed by Walter N. Ruf, et al. Ruf was present and spoke in favor of the vacation. He stated the area will be used for play by the children. No further testimony was received and the hearing was closed. Hansey reported the Planning and Development Committee recommended approval of the vacation with the following condition: "A roadway and utility easement through said vacation, of a width to be specified by the County Engineering and Operations Bureau, shall be made a part of the deed of Tract 1 and /or 2 at the time of vacation." Motion to amend carried. Ordinance passed unanimously. RESOLUTION -- BONDS FOR INDUSTRIAL DEVELOPMENT CORPORATION HANSEY MOVED FOR FINAL PASSAGE THE RESOL[ COUNCIL OF WHATCOM COUNTY APPROVING THE ISSUANCE THE INDUSTRIAL DEVELOPMENT CORPORATION OF THE PURSUANT TO R.C.W. 39.84.060. He reported Development Committee recommended passage of the carried. `-1 RESOLUTION -- TRANSFERS 4TION OF THE COUNTY OF REVENUE BONDS OF PORT OF BELLINGHAM the Planning and resolution. Motion HANSEY MOVED FOR FINAL PASSAGE THE RESOLUTION IN THE MATTER OF TRANSFERS AFFECTING THE 1983 BUDGET. He reported the Finance Committee recommended "do pass" of the resolution. Motion carried. OTHER BUSINESS PRELIMINARY PLAT OF TEN MILE ESTATES Hansey reported the Planning and Development Committee recommended approval of the Hearing Examiner recommendations regarding preliminary plat approval to. create and develop a residential sub- division to be known as "Ten Mile EatatesIt. HANSEY SO MOVED TO APPROVE THE PRELIMINARY PLAT WITH ALL CONDITIONS ATTACHED. Motion carried. PRELIMINARY PLAT OF PT. ROBERTS YACHT BASIN SUBDIVISION y The Hearing Examiner recommendations regarding preliminary plat approval to create and develop a subdivision known as "Point Roberts Yacht Basin Subdivision" and to amend the major development permit for "Point Roberts Marina" were held in the Planning and Development Committee for two weeks. The following matters were referred to their respective committees: 1. Petition requesting that the discharge of firearms be prohibited in the Nooksack area, filed by Richard Holmes, et al, r e f e r r e d t o L a w a n d J u s t i c e C o m m i t t e e 2. Resignation of Warren Bursick, Hearing Examiner, received ,.3. Correspondence from Bill Clement, Chairman, Lake Whatcom Advisory Committee, requesting additional funds for expanded monitoring of the water quality of Lake Whatcom, referred to Finance Committee "Whatcom County Council Minutes -- November 17, 1983 PAGE 6 OPEN SESSION Kenneth Bridges, 474 Sudden Valley, spoke to the proposed public park at Cherry Point. Ben Hinkle, North Shore Road, spoke to the Federal Reserve System. INTRODUCTION OF RESOLUTIONS AND ORDINANCES Hansey introduced and moved for final passage the Resolution in the matter of establishing a public hearing on the Whatcom County 1984 Road Construction Program. Motion carried. Hansey introduced the following: v,'-1. Resolution in the matter of adopting Whatcom County's 1984 Road Construction Program, referred to Public Services Committee 2. Ordinance adopting a supplemental budget for the Current Expense Fund, Public Works Administration 1983 budget, referred to Finance Committee 3. Ordinance authorizing a revised budget to the 1983 Current Expense Fund, Juvenile budget therein, referred to Finance Committee % 4. Ordinance authorizing a revised budget to the 1983 Current Expense Fund, Board of Equalization budget therein, referred to Finance Committee v/ 5. Ordinance in the matter of granting an area extension to the Maple Falls Water Co -Op Franchise to operate and maintain water mains and water distribution lines along roads within the unincorporated areas of Whatcom County, State of Washington, for a period of fourteen (14) ,years, referred to Public Services Committee f 6. Ordinance authorizing a revised budget to the 1983 Sheriff budget, referred to Finance Committee ;_7) Ordinance amending Ordinance No. 82 -68 reducing the sales tax rate in Whatcom County pursuant to the RCW 82.14.020(2) Hansey introduced and moved for final passage the Resolution declaring an emergency and authorizing the County Executive to employ special engineering consultants to evaluate and investigate county landfill disposal sites. HANSEY MOVED TO INDEFINITELY POSTPONE CONSIDERATION OF THE RESOLUTION. Motion carried. F co m County Coun.,il utes -- November 17, 1983 E 7 HANSEY MOVED TO REQUEST THE ADMINISTRATION TO IMMEDIATELY PROCEED IN THE NORMAL MANNER TO STUDY GROUNDWATER AND LEACHATE CONTROL IN CONNECTION WITH COUNTY LANDFILLS, IN ACCORDANCE WITH THE REQUIREMENTS OF THE BELLINGHAM AND WHATCOM COUNTY HEALTH DISTRICT AND THE DEPART- MENT OF ECOLOGY. HANSEY MOVED TO AMEND HIS MOTION TO INCLUDE THAT THE STUDIES SHALL BE LIMITED TO THE CEDARVILLE AND Y ROAD SOLID WASTE DISPOSAL SITES, AND ANY CONTRACT AWARD SHALL BE APPROVED BY THE COUNCIL. Motion to amend carried. Motion as amended carried. Hansey introduced the Resolution finding that continuation of Ordinance No. 82 -68 as amended by Ordinance No. 83 -20, is necessary for the operation of necessary county governmental services in 1984. The Resolution was referred to the Finance Committee. REPORT OF COMMITTEES AND OTHER ITEMS FROM COUNCIL MEMBERS Fawley stated the sales and use tax included in the budget should be clarified as to where it appears in the budget. Hansey stated there is no one specific area. Included in total revenue package. HANSEY MOVED TO REQUEST THE CHAIRPERSON TO ANNOUNCE THE UPCOMING VACANCY ON THE COUNCIL OF THE AT -LARGE POSITION AND THAT NAMES OF THOSE INTERESTED SHOULD BE SUBMITTED TO THE COUNCIL OFFICE BY DECEMBER 1, 1983. Motion carried and the Chair so announced the vacancy.
